  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Department: means the department of labor and industry provided for in 2-15-1701. See Montana Code 50-71-112
  • Department: means the department of labor and industry and the state coal mine inspectors employed by the department. See Montana Code 50-73-102
  • department: means the department of labor and industry. See Montana Code 50-74-101
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Employee: has the meaning provided in 39-71-118. See Montana Code 50-71-112

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Health: means protection against occupational illness. See Montana Code 50-71-112
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Inspection: means an onsite review of a workplace by the department to determine compliance with standards adopted under this part. See Montana Code 50-71-112
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Knowingly: means only a knowledge that the facts exist which bring the act or omission within the provisions of this code. See Montana Code 1-1-204
  • Mine examiner: means a person charged with the examination of the condition of the mine before the miners are permitted to enter the mine and who is commonly known as the "fire boss". See Montana Code 50-73-102
  • Mine supervisor: means a person who is charged with the general direction of the underground work or both the underground work and the outside work of a coal mine and who is commonly known and designated as "mine boss". See Montana Code 50-73-102
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: includes a corporation or other entity as well as a natural person. See Montana Code 1-1-201
  • Process: means a writ or summons issued in the course of judicial proceedings. See Montana Code 1-1-202
  • Property: means real and personal property. See Montana Code 1-1-205
  • Public sector employee: means an employee of a public sector employer. See Montana Code 50-71-112
  • Public sector employer: means :

    (a)a state agency;

    (b)each county in the state;

    (c)each municipality in the state;

    (d)each school district or community college; and

    (e)any other political subdivision of the state. See Montana Code 50-71-112

  • Safety: means protection against occupational injury or death. See Montana Code 50-71-112
  • Safety consultation services: has the meaning provided in 39-71-1503. See Montana Code 50-71-112
  • Shaft: means any vertical opening through the strata that is or may be used for the purpose of ventilation or escape or for hoisting or lowering of workers or material in connection with the mining of coal. See Montana Code 50-73-102
  • Standard: means a rule adopted by the department pursuant to this part that is designed to promote or ensure safety or health in the workplace. See Montana Code 50-71-112
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201
  • State agency: means any branch of government, including a department, board, commission, office, bureau, institution, university system entity, or unit of state government recognized in the state budget. See Montana Code 50-71-112
  • United States: includes the District of Columbia and the territories. See Montana Code 1-1-201
  • Workplace: means any site or location where an employee performs work for the employee's employer. See Montana Code 50-71-112
  • Writing: includes printing. See Montana Code 1-1-203
  • Written inspection report: means a report prepared by the department identifying safety and health hazards noted during a mine inspection. See Montana Code 50-73-102
