Terms Used In New Hampshire Revised Statutes 613:2-a

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • justice: when applied to a magistrate, shall mean a justice of a municipal court, or a justice of the peace having jurisdiction over the subject-matter. See New Hampshire Revised Statutes 21:12
  • person: may extend and be applied to bodies corporate and politic as well as to individuals. See New Hampshire Revised Statutes 21:9
  • state: shall include any territory of the United States and District of Columbia. See New Hampshire Revised Statutes 613:1
  • Testify: Answer questions in court.
  • Witness: as used in this chapter shall include a person whose testimony is desired in any proceeding or investigation by a grand jury or in a criminal action, prosecution, or proceeding. See New Hampshire Revised Statutes 613:1
A justice of the peace, upon receipt of a certificate of the clerk of a court of record in any jurisdiction contiguous to the state of New Hampshire that a criminal prosecution is pending in such court, and that a resident of this state is supposed to be a material witness therein, shall issue a summons requiring such person to appear and testify at the court in which such case is pending.
