§ 54-0505. Criteria for municipal landfill closure projects.

  • Commissioner: means the commissioner of environmental conservation; except that within and for the purposes of the projects undertaken by the office pursuant to title nine of this article, the term shall mean the commissioner of the office of parks, recreation and historic preservation.   • Landfill: means a disposal facility or part of one at which solid waste, or its residue after treatment, is intentionally placed in or on land, and at which solid waste will remain after closure and which is not a land spreading facility, a surface impoundment, or an injection well. See N.Y. Environmental Conservation Law 54-0501
  • Municipal landfill closure project: means activities undertaken to close, including by reclamation, a landfill owned or operated by a municipality to achieve compliance with regulations promulgated by the department, or activities undertaken to implement a landfill gas management system. See N.Y. Environmental Conservation Law 54-0501

1. State assistance payments shall be approved only for closure projects that include plans for closure, post-closure and construction in accordance with the department's solid waste management regulations applicable to new projects which were in effect six months prior to the date of submittal of the final application.

2. Municipal landfill closure project costs incurred prior to April first, nineteen hundred ninety-three shall not be eligible for state assistance payments funded pursuant to this article.

3. Prior to processing applications for state assistance payments for projects pursuant to this section, the commissioner shall promulgate, in consultation with the director of the budget, rules and regulations which shall include criteria for determining eligible expenditures and procedures governing the commitment and disbursement of funds appropriated in accordance with this section. The commissioner also shall promulgate rules and regulations which shall include application procedures, review processes, and project approval guidelines and criteria.
