  • Fraud: Intentional deception resulting in injury to another.

In the review and approval of rate filings submitted pursuant to section two thousand three hundred twenty-eight or section two thousand three hundred fifty of this article, the superintendent shall take steps appropriate to ensure that the rates of each insurer reflect that insurer’s savings resulting from reduced theft and fraud due to the impact of anti-theft and anti-fraud programs supported by the New York motor vehicle theft and insurance fraud prevention fund.
