§ 278-a. Exceptions to drug prescription supply during an emergency. The commissioner shall promulgate a list of prescription drugs that shall not be subject to subsection (c) of section three thousand two hundred forty-two and subsection (c) of § 4329 of the insurance law. Such list shall include, but not be limited to, all schedule II and schedule III controlled substances.

- drug: means a drug defined in subdivision seven of § 6802 of the education law, for which a prescription is required under the federal food, drug and cosmetic act. See N.Y. Public Health Law 270
