1.    Except as otherwise provided in subsection 2, if a law of this state requires or permits use of a sworn declaration, an unsworn declaration meeting the requirements of this chapter has the same effect as a sworn declaration.

Terms Used In North Dakota Code 31-14-03

  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Oath: A promise to tell the truth.
  • Oath: includes "affirmation". See North Dakota Code 1-01-49
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See North Dakota Code 1-01-49

2.    This chapter does not apply to:

a.    A deposition; b.    An oath of office; c.    An oath required to be given before a specified official other than a notary public; d.    A document intended for recording in the real estate records in the office of county recorder; or

e.    An oath required by section 30.1-08-04.
