The medicaid director’s rules governing medicaid are binding on other state agencies and political subdivisions that administer one or more components of the medicaid program, or one or more aspects of a component, pursuant to contracts entered into under section 5162.35 of the Revised Code. No state agency or political subdivision may establish, by rule or otherwise, a policy governing medicaid that is inconsistent with a medicaid policy established, in rule or otherwise, by the director.
Terms Used In Ohio Code 5162.022
- Political subdivision: means a municipal corporation, township, county, school district, or other body corporate and politic responsible for governmental activities only in a geographical area smaller than that of the state. See Ohio Code 5162.01
- Rule: includes regulation. See Ohio Code 1.59
- state: means the state of Ohio. See Ohio Code 1.59
- State agency: means every organized body, office, or agency, other than the department of medicaid, established by the laws of the state for the exercise of any function of state government. See Ohio Code 5162.01
