Terms Used In Ohio Code > Chapter 102 - Public Officers - Ethics

  • Abortion facility: means any of the following in which abortions are induced or performed:

    (1) Ambulatory surgical facility as defined in section 3702. See Ohio Code 3726.01

  • Administer: means the direct application of a drug, whether by injection, inhalation, ingestion, or any other means to a person or an animal. See Ohio Code 3719.01
  • Administer epinephrine: means to inject an individual with epinephrine using an autoinjector in a manufactured dosage form. See Ohio Code 3728.01
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • agriculture: includes farming; ranching; aquaculture; algaculture meaning the farming of algae; apiculture and related apicultural activities, production of honey, beeswax, honeycomb, and other related products; horticulture; viticulture, winemaking, and related activities; animal husbandry, including, but not limited to, the care and raising of livestock, equine, and fur-bearing animals; poultry husbandry and the production of poultry and poultry products; dairy production; the production of field crops, tobacco, fruits, vegetables, nursery stock, ornamental shrubs, ornamental trees, flowers, sod, or mushrooms; timber; pasturage; any combination of the foregoing; the processing, drying, storage, and marketing of agricultural products when those activities are conducted in conjunction with, but are secondary to, such husbandry or production; and any additions or modifications to the foregoing made by the director of agriculture by rule adopted in accordance with Chapter 119 of the Revised Code. See Ohio Code 1.61
  • Allegation: something that someone says happened.
  • Alter: means to change by making substantive replacements of, additions to, or deletions in the design or materials or to change the location of an existing sewage treatment system. See Ohio Code 3718.01
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Amidone: means any substance identified chemically as 4-4-diphenyl-6-dimethylamino-heptanone-3, or any salt thereof, by whatever trade name designated. See Ohio Code 3719.01
  • Animal shelter: means a facility operated by a humane society or any society organized under Chapter 1717 of the Revised Code or a dog pound operated pursuant to Chapter 955 of the Revised Code. See Ohio Code 3719.01
  • Another: when used to designate the owner of property which is the subject of an offense, includes not only natural persons but also every other owner of property. See Ohio Code 1.02
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • anything of value: includes :

    (A) Money, bank bills or notes, United States treasury notes, and other bills, bonds, or notes issued by lawful authority and intended to pass and circulate as money;

    (B) Goods and chattels;

    (C) Promissory notes, bills of exchange, orders, drafts, warrants, checks, or bonds given for the payment of money;

    (D) Receipts given for the payment of money or other property;

    (E) Rights in action;

    (F) Things which savor of the realty and are, at the time they are taken, a part of the freehold, whether they are of the substance or produce thereof or affixed thereto, although there may be no interval between the severing and taking away;

    (G) Any interest in realty, including fee simple and partial interests, present and future, contingent or vested interests, beneficial interests, leasehold interests, and any other interest in realty;

    (H) Any promise of future employment;

    (I) Every other thing of value. See Ohio Code 1.03

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appraisal: A determination of property value.
  • appropriate ethics commission: means :

    (1) For matters relating to members of the general assembly, employees of the general assembly, employees of the legislative service commission, and candidates for the office of member of the general assembly, the joint legislative ethics committee;

    (2) For matters relating to judicial officers and employees, and candidates for judicial office, the board of commissioners on grievances and discipline of the supreme court;

    (3) For matters relating to all other persons, the Ohio ethics commission. See Ohio Code 102.01

  • Arrest: Taking physical custody of a person by lawful authority.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Bailiff: a court officer who enforces the rules of behavior in courtrooms.
  • Bedrock: means hard stratum that underlies unconsolidated surface materials or soil. See Ohio Code 3718.01
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Benzodiazepine: means a controlled substance that has United States food and drug administration approved labeling indicating that it is a benzodiazepine, benzodiazepine derivative, triazolobenzodiazepine, or triazolobenzodiazepine derivative, including the following drugs and their varying salt forms or chemical congeners: alprazolam, chlordiazepoxide hydrochloride, clobazam, clonazepam, clorazepate, diazepam, estazolam, flurazepam hydrochloride, lorazepam, midazolam, oxazepam, quazepam, temazepam, and triazolam. See Ohio Code 3719.01
  • Board of health: means a board of health of a city or general health district or the authority having the duties of a board of health under section 3709. See Ohio Code 3717.01
  • Board of health: means the board of health of a city or general health district or the authority having the duties of a board of health in any city as authorized by section 3709. See Ohio Code 3718.01
  • Bond: includes an undertaking. See Ohio Code 1.02
  • Building: means a publicly or privately owned structure consisting of any combination of foundations, walls, columns, girders, beams, floors, or roofs, with or without other elements or appurtenances. See Ohio Code 3723.01
  • Business entity: means a corporation, partnership, association, firm, sole proprietorship, or other entity engaged in business. See Ohio Code 3723.01
  • Camp operator: means the operator of a recreational vehicle park, recreation camp, combined park-camp, or temporary park-camp. See Ohio Code 3729.01
  • Campsite user: means a person who enters into a campsite use agreement with a camp operator for the use of a campsite at a recreational vehicle park, recreation camp, combined park-camp, or temporary park-camp. See Ohio Code 3729.01
  • Catering food service operation: means a food service operation where food is prepared for serving at a function or event held at an off-premises site, for a charge determined on a per-function or per-event basis. See Ohio Code 3717.01
  • Certified nurse practitioner: means an advanced practice registered nurse who holds a current, valid license issued under Chapter 4723 of the Revised Code and is designated as a certified nurse practitioner in accordance with section 4723. See Ohio Code 1.64
  • Certified nurse-midwife: means an advanced practice registered nurse who holds a current, valid license issued under Chapter 4723 of the Revised Code and is designated as a certified nurse-midwife in accordance with section 4723. See Ohio Code 1.64
  • Child: includes child by adoption. See Ohio Code 1.59
  • Clinical nurse specialist: means an advanced practice registered nurse who holds a current, valid license issued under Chapter 4723 of the Revised Code and is designated as a clinical nurse specialist in accordance with section 4723. See Ohio Code 1.64
  • Coca leaves: includes cocaine and any compound, manufacture, salt, derivative, mixture, or preparation of coca leaves, except derivatives of coca leaves, that does not contain cocaine, ecgonine, or substances from which cocaine or ecgonine may be synthesized or made. See Ohio Code 3719.01
  • Combined park-camp: means any tract of land upon which a combination of five or more self-contained recreational vehicles or portable camping units are placed and includes any roadway, building, structure, vehicle, or enclosure used or intended for use as part of the park facilities. See Ohio Code 3729.01
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Compensation: means money, thing of value, or financial benefit. See Ohio Code 102.01
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Controlled substance: means a drug, compound, mixture, preparation, or substance included in schedule I, II, III, IV, or V. See Ohio Code 3719.01
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Dependent: A person dependent for support upon another.
  • Development: means any artificial change to improved or unimproved real estate, including, without limitation, buildings or structures, dredging, filling, grading, paving, excavation or drilling operations, or storage of equipment or materials, and the construction, expansion, or substantial alteration of a recreational vehicle park, recreation camp, or combined park-camp, for which plan review is required under division (A) of section 3729. See Ohio Code 3729.01
  • Director of health: means the director of health or the director's authorized representative. See Ohio Code 3729.01
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Dispense: means to sell, leave with, give away, dispose of, or deliver. See Ohio Code 3719.01
  • Distribute: means to deal in, ship, transport, or deliver but does not include administering or dispensing a drug. See Ohio Code 3719.01
  • Domestic septage: means the liquid or solid material removed from a sewage treatment system, portable toilet, or type III marine sanitation device as defined in 33 C. See Ohio Code 3718.01
  • Donor: The person who makes a gift.
  • Drug enforcement administration: means the drug enforcement administration of the United States department of justice or its successor agency. See Ohio Code 3719.01
  • Employer: means any person who, directly or indirectly, engages an executive agency lobbyist or legislative agent. See Ohio Code 102.01
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Federal drug abuse control laws: means the "Comprehensive Drug Abuse Prevention and Control Act of 1970" 84 Stat. See Ohio Code 3719.01
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Fetal remains: means the product of human conception that has been aborted. See Ohio Code 3726.01
  • Fiduciary: A trustee, executor, or administrator.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Flood plain: means the area adjoining any river, stream, watercourse, or lake that has been or may be covered by flood water. See Ohio Code 3729.01
  • flooding: means either of the following:

    (1) A general and temporary condition of partial or complete inundation of normally dry land areas from any of the following:

    (a) The overflow of inland or tidal waters;

    (b) The unusual and rapid accumulation or runoff of surface waters from any source;

    (c) Mudslides that are proximately caused by flooding as defined in division (G)(1)(b) of this section and that are akin to a river of liquid and flowing mud on the surface of normally dry land areas, as when earth is carried by a current of water and deposited along the path of the current. See Ohio Code 3729.01

  • Food: includes ice, water or any other beverage, food ingredients, and chewing gum. See Ohio Code 3717.01
  • food service operation: includes a catering food service operation, food delivery sales operation, mobile food service operation, seasonal food service operation, temporary food service operation, and vending machine location. See Ohio Code 3717.01
  • Food service operation: means a place, location, site, or separate area where food intended to be served in individual portions is prepared or served for a charge or required donation. See Ohio Code 3717.01
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Government entity: means this state, a political subdivision of this state, another state, or a political subdivision or other local government body of another state. See Ohio Code 3717.01
  • Government entity: means the state, a state agency as defined in section 1. See Ohio Code 3723.01
  • Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • health maintenance organization: means a public or private organization organized under the law of any state that is qualified under section 1310(d) of Title XIII of the "Public Health Service Act" 87 Stat. See Ohio Code 3727.01
  • Health care service: means any of the following:

    (1) Pediatric intensive care;

    (2) Solid organ and bone marrow transplantation;

    (3) Stem cell harvesting and reinfusion;

    (4) Cardiac catheterization;

    (5) Open heart surgery;

    (6) Operation of linear accelerators;

    (7) Operation of cobalt radiation therapy units;

    (8) Operation of gamma knives. See Ohio Code 3722.01

  • Honorarium: means any payment made in consideration for any speech given, article published, or attendance at any public or private conference, convention, meeting, social event, meal, or similar gathering. See Ohio Code 102.01
  • Hospital: means a facility registered as a hospital with the department of health under section 3701. See Ohio Code 3719.01
  • Hospital: includes a children's hospital. See Ohio Code 3722.01
  • Hospital: means an institution classified as a hospital under section 3701. See Ohio Code 3727.01
  • Household sewage treatment system: means any sewage treatment system, or part of such a system, that receives sewage from a single-family, two-family, or three-family dwelling. See Ohio Code 3718.01
  • Hypodermic: means a hypodermic syringe or needle, or other instrument or device for the injection of medication. See Ohio Code 3719.01
  • Immediate family: means a spouse residing in the person's household and any dependent child. See Ohio Code 102.01
  • in writing: includes any representation of words, letters, symbols, or figures; this provision does not affect any law relating to signatures. See Ohio Code 1.59
  • Income: includes gross income as defined and used in the "Internal Revenue Code of 1986" 100 Stat. See Ohio Code 102.01
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Infiltrative surface: means the point or area of application of treated or partially treated sewage to the soil or sand fill for purposes of treatment, dispersal, or both. See Ohio Code 3718.01
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Inspection: means the on-site evaluation or analysis of the design, installation, and operation of a sewage treatment system. See Ohio Code 3718.01
  • Installer: means any person who engages in the business of installing or altering or who, as an employee of another, installs or alters any sewage treatment system. See Ohio Code 3718.01
  • Inter vivos: Transfer of property from one living person to another living person.
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Interment: means the burial or entombment of fetal remains. See Ohio Code 3726.01
  • Internet: means the international computer network of both federal and nonfederal interoperable packet switched data networks, including the graphical subnetwork known as the world wide web. See Ohio Code 1.59
  • Isoamidone: means any substance identified chemically as 4-4-diphenyl-5-methyl-6-dimethylaminohexanone-3, or any salt thereof, by whatever trade name designated. See Ohio Code 3719.01
  • Isonipecaine: means any substance identified chemically as 1-methyl-4-phenyl-piperidine-4-carboxylic acid ethyl ester, or any salt thereof, by whatever trade name designated. See Ohio Code 3719.01
  • Joint commission: means the commission formerly known as the joint commission on accreditation of healthcare organizations or the joint commission on accreditation of hospitals. See Ohio Code 3727.01
  • Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Ketobemidone: means any substance identified chemically as 4-(3-hydroxyphenyl)-1-methyl-4-piperidyl ethyl ketone hydrochloride, or any salt thereof, by whatever trade name designated. See Ohio Code 3719.01
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Licensing period: means the first day of March to the last day of February of the next succeeding year. See Ohio Code 3717.01
  • Licensor: means one of the following:

    (1) A board of health approved under section 3717. See Ohio Code 3717.01

  • Licensor: means either the board of health of a city or general health district, or the authority having the duties of a board of health in any city as authorized by section 3709. See Ohio Code 3729.01
  • Limiting condition: means a restrictive soil layer, bedrock, a water table, or ground water that limits or precludes the treatment or dispersal of sewage in the soil of a property where a household sewage treatment system is located. See Ohio Code 3718.01
  • Manufacturer: means any person that manufactures sewage treatment systems or components of systems. See Ohio Code 3718.01
  • Manufacturer: means a person who manufactures a controlled substance, as "manufacture" is defined in section 3715. See Ohio Code 3719.01
  • Marihuana: means all parts of a plant of the genus cannabis, whether growing or not; the seeds of a plant of that type; the resin extracted from a part of a plant of that type; and every compound, manufacture, salt, derivative, mixture, or preparation of a plant of that type or of its seeds or resin. See Ohio Code 3719.01
  • Mobile food service operation: includes a food service operation that does not remain at any one location for more than forty consecutive days and serves, in a manner consistent with division (F) of this section, only frozen desserts; beverages, nuts, popcorn, candy, or similar confections; bakery products identified in section 911. See Ohio Code 3717.01
  • Mobile retail food establishment: means a retail food establishment that is operated from a movable vehicle or other portable structure, and that routinely changes location, except that if the establishment operates from any one location for more than forty consecutive days, the establishment is no longer a mobile retail food establishment. See Ohio Code 3717.01
  • Narcotic drugs: means coca leaves, opium, isonipecaine, amidone, isoamidone, ketobemidone, as defined in this division, and every substance not chemically distinguished from them and every drug, other than cannabis, that may be included in the meaning of "narcotic drug" under the federal drug abuse control laws. See Ohio Code 3719.01
  • No true bill: A legal procedure to dismiss charges against a defendant when the grand jury does not find enough evidence to charge the defendant with violating a law. Also called a "no bill."
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Official written order: means an order written on a form provided for that purpose by the director of the United States drug enforcement administration, under any laws of the United States making provision for the order, if the order forms are authorized and required by federal law. See Ohio Code 3719.01
  • Ohio uniform food safety code: means the food safety and related standards adopted under section 3717. See Ohio Code 3717.01
  • One-hundred-year flood: means a flood having a one per cent chance of being equaled or exceeded in any given year. See Ohio Code 3729.01
  • Operator: means the person who has responsible charge of a recreational vehicle park, recreation camp, combined park-camp, or temporary park-camp and who is licensed under this chapter. See Ohio Code 3729.01
  • Opioid analgesic: means a controlled substance that has analgesic pharmacologic activity at the opioid receptors of the central nervous system, including the following drugs and their varying salt forms or chemical congeners: buprenorphine, butorphanol, codeine (including acetaminophen and other combination products), dihydrocodeine, fentanyl, hydrocodone (including acetaminophen combination products), hydromorphone, meperidine, methadone, morphine sulfate, oxycodone (including acetaminophen, aspirin, and other combination products), oxymorphone, tapentadol, and tramadol. See Ohio Code 3719.01
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Park model: means a recreational vehicle that meets the American national standard institute standard A119. See Ohio Code 3729.01
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: includes an individual, corporation, business trust, estate, trust, partnership, and association. See Ohio Code 1.59
  • Person: means any individual, corporation, government, governmental subdivision or agency, business trust, estate, trust, partnership, association, or other legal entity. See Ohio Code 3719.01
  • Personal property: All property that is not real property.
  • Pharmacist: means a person licensed under Chapter 4729 of the Revised Code to engage in the practice of pharmacy. See Ohio Code 3719.01
  • Physician assistant: means an individual who is licensed under Chapter 4730 of the Revised Code to provide services as a physician assistant to patients under the supervision, control, and direction of one or more physicians. See Ohio Code 1.64
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Plasma: means the fluid portion of blood that has been stabilized against clotting, and is collected by plasmapheresis;

    (B) "Plasmapheresis" means a procedure in which blood is drawn from a donor, the plasma is separated from the formed elements, and the formed elements are returned to the donor during a single visit to the plasmapheresis center, but excludes such a procedure performed for the purpose of improving the health of the donor;

    (C) "Plasmapheresis center" means a blood bank or other establishment except a hospital that collects plasma. See Ohio Code 3725.01

  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Poison: means any drug, chemical, or preparation likely to be deleterious or destructive to adult human life in quantities of four grams or less. See Ohio Code 3719.01
  • Political subdivision: means a county, township, municipal corporation, or other body corporate and politic responsible for governmental activities in a geographic area smaller than that of the state. See Ohio Code 3722.01
  • Population: means that shown by the most recent regular federal census. See Ohio Code 1.59
  • Portable camping units: means dependent recreational vehicles, tents, portable sleeping equipment, and similar camping equipment used for travel, recreation, vacation, or business purposes. See Ohio Code 3729.01
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Prepared: means any action that affects a food, including receiving and maintaining it at the temperature at which it was received. See Ohio Code 3717.01
  • Prescriber: means an individual who is authorized by law to prescribe drugs or dangerous drugs or drug therapy related devices in the course of the individual's professional practice, including only the following:

    (1) A clinical nurse specialist, certified nurse-midwife, or certified nurse practitioner who holds a certificate to prescribe issued under section 4723. See Ohio Code 3728.01

  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probate: Proving a will
  • Property: means real and personal property. See Ohio Code 1.59
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • public agency: includes a regional council of governments established under Chapter 167 of the Revised Code. See Ohio Code 102.01
  • Public official or employee: means any person who is elected or appointed to an office or is an employee of any public agency. See Ohio Code 102.01
  • Qualified entity: means any public or private entity that is associated with a location where allergens capable of causing anaphylaxis may be present, including child day-care centers, colleges and universities, places of employment, restaurants, amusement parks, recreation camps, sports playing fields and arenas, and other similar locations, except that "qualified entity" does not include either of the following:

    (1) A chartered or nonchartered nonpublic school; community school; science, technology, engineering, and mathematics school; or a school operated by the board of education of a city, local, exempted village, or joint vocational school district;

    (2) A camp described in section 5101. See Ohio Code 3728.01

  • Quorum: The number of legislators that must be present to do business.
  • Radon: means both the radioactive, gaseous element produced by the disintegration of radium, and the short-lived radionuclides that are decay products of radon. See Ohio Code 3723.01
  • Radon laboratory: means a business entity or government entity that analyzes air, soil, water, or passive radon detection devices to determine the presence and concentration of radon in them. See Ohio Code 3723.01
  • Radon mitigation: means the application or installation of methods or materials to reduce airborne radon concentrations in a building or to prevent the entry of radon into the indoor atmosphere. See Ohio Code 3723.01
  • Radon test: means the act of examining a building, air, soil, or water for the presence of radon, including taking air, soil, or water samples, or the act of diagnosing the cause of radon contamination in a building. See Ohio Code 3723.01
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
  • Recreation camp: means any tract of land upon which five or more portable camping units are placed and includes any roadway, building, structure, vehicle, or enclosure used or intended for use as a part of the facilities of the camp. See Ohio Code 3729.01
  • Recreational vehicle park: means any tract of land used for parking five or more self-contained recreational vehicles and includes any roadway, building, structure, vehicle, or enclosure used or intended for use as part of the park facilities and any tract of land that is subdivided for lease or other contract of the individual lots for the express or implied purpose of placing self-contained recreational vehicles for recreation, vacation, or business purposes. See Ohio Code 3729.01
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Retail: means the sale of food to a person who is the ultimate consumer. See Ohio Code 3717.01
  • retail food establishment: includes a mobile retail food establishment, seasonal retail food establishment, and temporary retail food establishment. See Ohio Code 3717.01
  • Rule: includes regulation. See Ohio Code 1.59
  • Sale: includes delivery, barter, exchange, transfer, or gift, or offer thereof, and each transaction of those natures made by any person, whether as principal, proprietor, agent, servant, or employee. See Ohio Code 3719.01
  • Seasonal food service operation: means a food service operation, other than a mobile food service operation, that is operated for not more than six months in a licensing period. See Ohio Code 3717.01
  • Seasonal retail food establishment: means a retail food establishment, other than a mobile retail food establishment, that is operated for not more than six months in a licensing period. See Ohio Code 3717.01
  • Self-contained recreational vehicle: includes a park model. See Ohio Code 3729.01
  • Septage hauler: means any person who engages in the collection, transportation, disposal, and land application of domestic septage. See Ohio Code 3718.01
  • served: means a response made to an order for one or more individual portions of food in a form that is edible without washing, cooking, or additional preparation and "prepared" means any action that affects a food other than receiving or maintaining it at the temperature at which it was received. See Ohio Code 3717.01
  • Service provider: means any person who services, but does not install or alter, sewage treatment systems. See Ohio Code 3718.01
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Sewage: includes liquids containing household chemicals in solution commonly discharged from a residence or from commercial, institutional, or other similar facilities. See Ohio Code 3718.01
  • Sewage treatment system: means a household sewage treatment system, a small flow on-site sewage treatment system, or both, as applicable. See Ohio Code 3718.01
  • Small flow on-site sewage treatment system: means a system, other than a household sewage treatment system, that treats not more than one thousand gallons of sewage per day and that does not require a national pollutant discharge elimination system permit issued under section 6111. See Ohio Code 3718.01
  • Soil: means the naturally occurring pedogenically developed and undeveloped regolith overlying bedrock. See Ohio Code 3718.01
  • state: means the state of Ohio. See Ohio Code 1.59
  • Statute: A law passed by a legislature.
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • Subpoena: A command to a witness to appear and give testimony.
  • Summons: Another word for subpoena used by the criminal justice system.
  • Temporary food service operation: means a food service operation that is operated at an event for not more than five consecutive days, except when operated for more than five consecutive days pursuant to division (E)(2) of section 3717. See Ohio Code 3717.01
  • Temporary park-camp: means any tract of land used for a period not to exceed a total of twenty-one days per calendar year for the purpose of parking five or more recreational vehicles, dependent recreational vehicles, or portable camping units, or any combination thereof, for one or more periods of time that do not exceed seven consecutive days or parts thereof. See Ohio Code 3729.01
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Temporary retail food establishment: means a retail food establishment that is operated at an event for not more than five consecutive days, except when operated for more than five consecutive days pursuant to division (E)(2) of section 3717. See Ohio Code 3717.01
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Tract: means a contiguous area of land that consists of one or more parcels, lots, or sites that have been separately surveyed regardless of whether the individual parcels, lots, or sites have been recorded and regardless of whether the one or more parcels, lots, or sites are under common or different ownership. See Ohio Code 3729.01
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • True bill: Another word for indictment.
  • Trustee: A person or institution holding and administering property in trust.
  • Undertaking: includes a bond. See Ohio Code 1.02
  • United States: includes all the states. See Ohio Code 1.59
  • Unprocessed: when used with respect to fruits and vegetables, means that the fruits and vegetables are not processed beyond merely rough trimming and rinsing. See Ohio Code 3717.01
  • vending machine: means a self-service device that automatically dispenses on the insertion of currency, tokens, or similar means a predetermined unit serving of food, either in bulk or in package, without having to be replenished after each use. See Ohio Code 3717.01
  • Vending machine location: means an area or room where one or more vending machines are installed and operated, except that if the machines within an area are separated by more than one hundred fifty feet, each area separated by that distance constitutes a separate vending machine location. See Ohio Code 3717.01
  • Vertical separation distance: means the distance of the infiltrative surface of the distribution system of a soil absorption system, or component thereof, to a limiting condition in the soil. See Ohio Code 3718.01
  • Water table: means the surface of the saturated zone below which all interconnected voids are filled with water and at which the pressure is atmospheric. See Ohio Code 3718.01
  • Whoever: includes all persons, natural and artificial; partners; principals, agents, and employees; and all officials, public or private. See Ohio Code 1.02
  • Wholesaler: means a person who, on official written orders other than prescriptions, supplies controlled substances that the person has not manufactured, produced, or prepared personally and includes a "wholesale distributor of dangerous drugs" as defined in section 4729. See Ohio Code 3719.01
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
