No health insurer, including a group health plan, as defined in Section 607(1) of the Employee Retirement Income Security Act of 1974 or health maintenance organization as defined in § 38-33-20, may deny enrollment of a child under the health plan of the child’s parent on the grounds that the child:

(1) was born out of wedlock;

  • Insurer: includes a corporation, fraternal organization, burial association, other association, partnership, society, order, individual, or aggregation of individuals engaging or proposing or attempting to engage as principals in any kind of insurance or surety business, including the exchanging of reciprocal or interinsurance contracts between individuals, partnerships, and corporations. See South Carolina Code 38-1-20

(2) is not claimed as a dependent on the parent’s federal tax return; or

(3) does not reside with the parent or in the insurer’s service area.
