Terms Used In South Carolina Code 59-58-120
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
- Commission: means the South Carolina Commission on Higher Education. See South Carolina Code 59-58-20
- License: means an agency permit, approval, or some similar form of written permission. See South Carolina Code 59-58-20
- Person: means any individual, firm, partnership, association, organization, corporation, trust, or other legal entity or combination of the above. See South Carolina Code 59-58-20
A person aggrieved by the final decision of the commission in refusing to issue a license or permit, or revoking or suspending a license or permit previously granted, is entitled to appeal the commission’s order to the Administrative Law Court in accordance with its appellate rules of procedure.
