  • Action: means any civil lawsuit or action or arbitration proceeding for damages or indemnity asserting a claim for injury or loss to a dwelling or personal property caused by an alleged defect arising out of or related to the design, construction, condition, or sale of the dwelling or a remodel of a dwelling. See South Carolina Code 40-59-820
  • Active duty military: means full-time duty status in the active uniformed service of the United States, including members of the National Guard and Reserve on active duty orders pursuant to 10 U. See South Carolina Code 40-67-520
  • Active treatment: means the standard of reasonable professional care that would be rendered by a physician to a patient in the absence of a declaration including, but not limited to, hospitalization and medication. See South Carolina Code 44-77-20
  • Addiction counselor: means a professional who practices individual, family, and group addiction counseling. See South Carolina Code 40-75-20
  • Administer: means the direct application of an epinephrine auto-injector to the body of an individual. See South Carolina Code 44-99-10
  • Administrator: means the individual to whom the director has delegated authority to administer the programs of a specific board or of a professional or occupational group for which the department has regulatory authority or has delegated authority to administer the programs of a specific board;

    (2) "Authorization to practice" or "Practice authorization" means the approval to practice the specified profession, engage in the specified occupation, or use a title protected under this article, which has been granted by the applicable board. See South Carolina Code 40-1-20
  • Administrator: means the administrator of the South Carolina Department of Consumer Affairs. See South Carolina Code 44-79-20
  • Administrator: means the Executive Director for the South Carolina Residential Builders Commission provided for under § 40-59-50. See South Carolina Code 40-59-500
  • Adolescent: means an individual nineteen years of age and under. See South Carolina Code 44-122-10
  • Advance directive: means a written statement such as a health care power of attorney executed in accordance with § 62-5-504, in which an individual expresses certain wishes relating to life-sustaining treatment, including resuscitative services. See South Carolina Code 44-80-10
  • Adverse action: means any administrative, civil, equitable, or criminal action permitted by a state's laws which is imposed by a licensing board or other authority against an audiologist or speech-language pathologist, including actions against an individual's license or privilege to practice such as revocation, suspension, probation, monitoring of the licensee, or restriction on the licensee's practice. See South Carolina Code 40-67-520
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Alcohol and drug counseling services: means those services offered for a fee as part of the treatment and rehabilitation of persons with a substance abuse disorder, at risk of developing a substance abuse disorder, or is negatively affected by someone with a substance abuse disorder. See South Carolina Code 40-75-20
  • Allegation: something that someone says happened.
  • Alternative program: means a nondisciplinary monitoring process approved by an audiology or speech-language pathology licensing board to address impaired practitioners. See South Carolina Code 40-67-520
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Amusement device: means any mechanical device or combination of devices which carries or conveys passengers on, along, around, over, or through a fixed or restricted course or within a defined area for the purpose of giving its passengers amusement, pleasure, or excitement. See South Carolina Code 41-18-40
  • Amusement park: means a tract or area used principally as a permanent location for amusement devices or structures. See South Carolina Code 41-18-40
  • Analysis: means a study of real estate or real property other than one estimating value. See South Carolina Code 40-60-20
  • Animal: means an animal that is not a human and includes fowl, birds, reptiles, and fish which are wild or domestic, living or dead. See South Carolina Code 40-69-20
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Appraisal: A determination of property value.
  • appraisal: means of or pertaining to appraising and related functions including, but not limited to, appraisal practice and appraisal services. See South Carolina Code 40-60-20
  • Appraisal Foundation: means the Appraisal Foundation established on November 30, 1987, as a not-for-profit corporation under the laws of Illinois, containing the Appraisal Standards Board (ASB), Appraiser Qualifications Board (AQB), a board of trustees, and other advisory bodies. See South Carolina Code 40-60-20
  • Appraisal report: means any communication, written or oral, of an appraisal. See South Carolina Code 40-60-20
  • Appraisal subcommittee: means the designees of the heads of the federal financial institutions regulatory agencies established by the Federal Financial Institutions Examination Council Act of 1978 (12 U. See South Carolina Code 40-60-20
  • Appraiser: means a person who holds a permit, license, or certification issued by the board that allows the person to appraise real property. See South Carolina Code 40-60-20
  • Apprentice appraiser: means an individual authorized by permit to assist a state-certified appraiser in the performance of an appraisal if the apprentice is actively and personally supervised by the certified appraiser. See South Carolina Code 40-60-20
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Approved supervisor: means a licensee who has met the requirements for approval as a professional counselor supervisor, marriage and family therapy supervisor, or addiction counselor supervisor as provided in regulation. See South Carolina Code 40-75-20
  • Arrest: Taking physical custody of a person by lawful authority.
  • Asbestos abatement entity: means any individual, partnership, firm, association, corporation, sole proprietorship, or other business concern, as well as an employee or member of a governmental, religious, or social organization, that is involved in asbestos abatement. See South Carolina Code 44-87-10
  • Asbestos project: means an activity associated with abatement, including inspection, design, air monitoring, in-place management, encapsulation, enclosure, renovation, repair, removal, any other disturbance of regulated asbestos-containing materials, and demolition of a regulated facility. See South Carolina Code 44-87-10
  • ASHA: means the American Speech-Language Hearing Association. See South Carolina Code 40-67-20
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Associate: means an individual who has met the requirements for licensure as a professional counselor associate, marriage and family therapy associate, or addiction counselor associate under the provisions of this article and has been issued a license by the board. See South Carolina Code 40-75-20
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Audiologist: means an individual who is licensed by a state to practice audiology. See South Carolina Code 40-67-520
  • Audiologist: means an individual who practices audiology. See South Carolina Code 40-67-20
  • Audiology: means the care and services provided by a licensed audiologist as set forth in the member state's statutes and rules. See South Carolina Code 40-67-520
  • audiology service: means screening, identifying, assessing, diagnosing, habilitating, and rehabilitating individuals with peripheral and central auditory and vestibular disorders; preventing hearing loss; researching normal and disordered auditory and vestibular functions; administering and interpreting behavioral and physiological measures of the peripheral and central auditory and vestibular systems; selecting, fitting, programming, and dispensing all types of amplification and assistive listening devices including hearing aids, and providing training in their use; providing aural habilitation, rehabilitation, and counseling to hearing impaired individuals and their families; designing, implementing, and coordinating industrial and community hearing conservation programs; training and supervising individuals not licensed in accordance with this chapter who perform air conduction threshold testing in the industrial setting; designing and coordinating infant hearing screening and supervising individuals not licensed in accordance with this chapter who perform infant hearing screenings; performing speech or language screening, limited to a pass-fail determination; screening of other skills for the purpose of audiological evaluation; and identifying individuals with other communication disorders.   • Authorized entity: means any entity or organization, other than a school described in § 59-63-95, in connection with or at which allergens capable of causing anaphylaxis may be present including, but not limited to, recreation camps, colleges and universities, daycare facilities, places of worship, youth sports leagues, amusement parks, restaurants, places of employment, and sports arenas. See South Carolina Code 44-99-10
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Birthing center: means a facility or other place where human births are planned to occur. See South Carolina Code 44-89-30
  • Board: shall mean the South Carolina Board of Health and Environmental Control. See South Carolina Code 44-69-20
  • Board: means the South Carolina Board of Health and Environmental Control. See South Carolina Code 44-71-20
  • Board: means the board of the South Carolina Radiation Quality Standards Association. See South Carolina Code 44-74-20
  • Board: means the South Carolina Board of Health and Environmental Control. See South Carolina Code 44-89-30
  • Board: means any of the boards created pursuant to Title 40, as amended, to license, certify, or register health care professionals. See South Carolina Code 44-113-20
  • Board: means the South Carolina Real Estate Appraisers Board established pursuant to the provisions of this chapter. See South Carolina Code 40-60-20
  • Board: means the South Carolina State Board of Examiners in Speech-Language Pathology and Audiology. See South Carolina Code 40-67-20
  • Board: means the South Carolina Board of Licensed Professional Counselors, Marriage and Family Therapists, Addictions Counselors, and Psycho-Educational Specialists. See South Carolina Code 40-75-20
  • Board: means the South Carolina State Board of Veterinary Medical Examiners. See South Carolina Code 40-69-20
  • bracelet: means a standardized identification bracelet that:

    (a) meets the specifications established under § 44-78-30(B) or that is approved by the department under § 44-78-30(B);

    (b) bears the inscription "Do Not Resuscitate"; and

    (c) signifies that the wearer is a patient who has obtained a do not resuscitate order which has not been revoked. See South Carolina Code 44-78-15
  • Branch office: shall mean a location or site from which a home health agency provides services within a portion of the total geographic area served by the parent agency. See South Carolina Code 44-69-20
  • Carnival: means an itinerant enterprise consisting principally of temporary amusement devices or mechanical rides operated to provide entertainment or amusement to the public. See South Carolina Code 41-18-40
  • Case law: The law as laid down in cases that have been decided in the decisions of the courts.
  • Catapulting amusement ride: means an amusement ride whereby a person, or persons, riding in a safety car, or other suitable safety device, is attached to wire ropes or cables that may be attached to springs or other devices similar in design or use which are engineered to simulate bungee catapulting or reverse bungee jumping as defined in § 52-19-50(5) whereby a person or passenger is released from a fixed position, thus catapulting or otherwise launching the jumper or passenger into the air or toward the ground.   • Catastrophic accident: means an incident resulting in fatality or three or more injuries resulting in hospitalization. See South Carolina Code 41-18-40
  • Center: means any person or organization which, for profit, offers physical fitness services, whether at multiple outlets bearing the same name or a single outlet. See South Carolina Code 44-79-20
  • Certificate: means a certificate issued by the board or by an entity recognized by the board authorizing the certificate holder to use radioactive materials or equipment emitting ionizing radiation on humans for diagnostic or therapeutic purposes in accordance with the provisions of this chapter. See South Carolina Code 44-74-20
  • Child: means a person under the age of eighteen who is neither married nor judicially emancipated and who is medically eligible for hospice care as a result of a terminal condition. See South Carolina Code 44-78-15
  • Claimant: means a homeowner, including a subsequent purchaser, who asserts a claim against a contractor, subcontractor, supplier, or design professional concerning a defect in the design, construction, condition, or sale of a dwelling or in the remodel of a dwelling. See South Carolina Code 40-59-820
  • Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
  • Client: means a person or patient, whether an individual or a member of a group, a group, an agency or an organization, who receives in an office setting any treatment or service that falls within the scope of practice of a Licensed Professional Counselor, Marriage and Family Therapist, Addiction Counselor, or Psycho-Educational Specialist. See South Carolina Code 40-75-20
  • Commission: means the South Carolina Residential Builders Commission. See South Carolina Code 40-59-20
  • Commission: means the South Carolina Residential Builders Commission. See South Carolina Code 40-59-500
  • Commission: means the national administrative body whose membership consists of all states that have enacted the compact. See South Carolina Code 40-67-520
  • Commissions: means the River Basins Advisory Commissions. See South Carolina Code 44-59-10
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Compact privilege: means the authorization granted by a remote state to allow a licensee from another member state to practice as an audiologist or speech-language pathologist in the remote state under its laws and rules. See South Carolina Code 40-67-520
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Concession go-kart: means an amusement ride or device that:

    (i) is a single vehicle, unattached to other vehicles or a common frame system;

    (ii) is powered without connection to a common energy source;

    (iii) is driver-controlled with respect to acceleration, speed, braking, and steering;

    (iv) operates within the containment system of a defined track;

    (v) simulates competitive motor sports; and

    (vi) is used by members of the general public for a fee. See South Carolina Code 41-18-40
  • Construction defect: means a deficiency in or a deficiency arising out of the design, specifications, surveying, planning, supervision, or observation of construction or construction of residential improvements that results from any of the following:

    (a) defective material, products, or components used in the construction of residential improvements;

    (b) violation of the applicable codes in effect at the time of construction of residential improvements;

    (c) failure of the design of residential improvements to meet the applicable professional standards of care at the time of governmental approval of the design of residential improvements; or

    (d) failure to construct residential improvements in accordance with accepted trade standards for good and workmanlike construction at the time of construction. See South Carolina Code 40-59-820
  • Consulting: means the application of scientific principles and procedures in counseling and human development to provide assistance in understanding and solving current or potential problems that the client may have in relation to a third party, individuals, groups, and organizations. See South Carolina Code 40-75-20
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • Contractor: means the department, division, or other unit of a person responsible for the performance under a contract with a state agency. See South Carolina Code 44-107-20
  • Contractor: means a public or private agency or organization receiving money from the fund. See South Carolina Code 44-122-10
  • Controlled substance: means a controlled substance in Article 3, Chapter 53 of this title. See South Carolina Code 44-107-20
  • Conviction: A judgement of guilt against a criminal defendant.
  • Conviction: means a conviction, guilty plea, or plea of nolo contendere and includes being convicted of a violation of a law of any other state or a city or county ordinance. See South Carolina Code 44-54-30
  • Conviction: means a finding of guilt, including a plea of nolo contendere or imposition of sentence, or both, by any judicial body charged with the responsibility to determine violations of the federal or state criminal drug statutes. See South Carolina Code 44-107-20
  • Corporation: means a county business development corporation created under this chapter;

    (2) "Financial institution" means any banking corporation or trust company, building and loan association, insurance company or related corporation, partnership, foundation or other institution engaged primarily in lending or investing funds;

    (3) "Member" means any financial institution authorized to do business within this State which shall undertake to lend money to a corporation created under this chapter, upon its call, and in accordance with the provisions of this chapter;

    (4) "Board of directors" means the board of directors of the corporation created under this chapter; and

    (5) "Loan limit" means, for any member, the maximum amount permitted to be outstanding at one time on loans made by such member to the corporation as determined under the provisions of this chapter. See South Carolina Code 33-39-10
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • County government: means the governing body of a county or the organization or agency in a county that has been designated pursuant to § 44-122-30(C) to assume the duties and responsibilities assigned to county governments. See South Carolina Code 44-122-10
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Data system: means a repository of information about licensees including, but not limited to, continuing education, examination, licensure, investigative, compact privilege, and adverse action. See South Carolina Code 40-67-520
  • Decedent: A deceased person.
  • Declarant: means a person who has signed a declaration in accordance with §§ 44-77-40 and 44-77-50, in accordance with earlier, current, or future versions of this chapter, or in accordance with the law of another state if the declaration provided for by the law expresses an intent that is substantially the same as the intent of the declaration provided in § 44-77-40. See South Carolina Code 44-77-20
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Department: means the South Carolina Department of Labor, Licensing and Regulation. See South Carolina Code 41-18-40
  • Department: means the Department of Employment and Workforce;

    (2) "Director" means the Director of the Office of Statewide Workforce Development;

    (3) "Executive director" means the Executive Director of the Department of Employment and Workforce;

    (4) "Executive committee" means the executive committee of the Coordinating Council for Workforce Development;

    (5) "Unified State Plan" or "USP" means the comprehensive statewide education and workforce development plan that provides a systemwide approach to streamline and unify efforts of entities involved in education and workforce development in the State;

    (6) "Office of Statewide Workforce Development" or "OSWD" means the Office of Statewide Workforce Development created in this chapter; and

    (7) "Coordinating Council for Workforce Development" or "CCWD" means the Coordinating Council for Workforce Development administered by the department. See South Carolina Code 41-30-120
  • Department: shall mean South Carolina Department of Health and Environmental Control. See South Carolina Code 44-69-20
  • Department: means the South Carolina Department of Health and Environmental Control. See South Carolina Code 44-70-20
  • Department: means the South Carolina Department of Health and Environmental Control. See South Carolina Code 44-71-20
  • Department: means the Department of Labor, Licensing and Regulation;

    (5) "Director" means the Director of the Department of Labor, Licensing and Regulation or the director's official designee;

    (6) "Licensee" means a person granted an authorization to practice pursuant to this article and refers to a person holding a license, permit, certification, or registration granted pursuant to this article;

    (7) "Licensing act" means the individual statute or regulations, or both, of each regulated profession or occupation which include, but are not limited to, board governance, the qualifications and requirements for authorization to practice, prohibitions, and disciplinary procedures;

    (8) "Person" means an individual, partnership, or corporation;

    (9) "Profession" or "occupation" means a profession or occupation regulated or administered, or both, by the department pursuant to this article. See South Carolina Code 40-1-20
  • Department: means the South Carolina Department of Health and Environmental Control. See South Carolina Code 44-80-10
  • Department: means the South Carolina Department of Health and Environmental Control. See South Carolina Code 44-87-10
  • Department: means the South Carolina Department of Health and Environmental Control. See South Carolina Code 44-89-30
  • Department: means the South Carolina Department of Health and Environmental Control. See South Carolina Code 44-99-10
  • Department: means the South Carolina Department of Health and Environmental Control. See South Carolina Code 44-113-20
  • Department: means the Department of Labor, Licensing and Regulation. See South Carolina Code 40-59-20
  • Department: means the South Carolina Department of Social Services. See South Carolina Code 44-122-10
  • Dependent: A person dependent for support upon another.
  • Designated health services: means any health care procedure, service, or item provided by a health care provider. See South Carolina Code 44-113-20
  • Direct supervision: means a certified radiographer who:

    (a) reviews the procedure in relation to the student's achievement;

    (b) evaluates the condition of the patient in relation to the student's knowledge;

    (c) is present during the conduct of the procedure;

    (d) reviews and approves the procedure; and

    (e) is present during student performance of any repeat of any unsatisfactory radiograph. See South Carolina Code 44-74-20
  • Direct supervision: means that a veterinarian currently licensed to practice veterinary medicine in this State is available on the premises and within immediate vocal communication of the supervisee. See South Carolina Code 40-69-20
  • Director: means the Director of the Department of Labor, Licensing and Regulation. See South Carolina Code 40-59-500
  • Director: means the Director of the Department of Labor, Licensing and Regulation. See South Carolina Code 40-67-20
  • Director: means the Director of the Department of Labor, Licensing and Regulation. See South Carolina Code 40-75-20
  • Director: means the Director of the South Carolina Department of Labor, Licensing and Regulation or the director's designee or representative. See South Carolina Code 41-18-40
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Drug-free workplace: means a site for the performance of work done in connection with a specific grant or contract of an entity at which employees of the entity are prohibited from engaging in the unlawful manufacture, distribution, dispensation, possession, or use of a controlled substance in accordance with the requirements of this chapter. See South Carolina Code 44-107-20
  • Dwelling: means a single-family house or duplex or a multifamily unit not to exceed sixteen units and not to exceed three stories in height, and which is intended for residential use. See South Carolina Code 40-59-820
  • Emergency clinic: means a facility having as its primary function the receiving, treatment, and monitoring of emergency patients during its specified hours of operation. See South Carolina Code 40-69-20
  • Emergency hospital: means a facility whose primary function is the receiving, treatment, and monitoring of emergency patients during its specified hours of operation and includes the confinement of emergency patients. See South Carolina Code 40-69-20
  • Employee: means the employee of a grantee or contractor engaged in the performance of work pursuant to the provisions of the grant or contract. See South Carolina Code 44-107-20
  • EMS personnel: means emergency medical personnel certified by the South Carolina Department of Health and Environmental Control including first responders who have completed a Department of Health and Environmental Control approved medical first responder program. See South Carolina Code 44-78-15
  • Encumbered license: means a license in which an adverse action restricts the practice of audiology or speech-language pathology by the licensee and said adverse action has been reported to the National Practitioners Data Bank (NPDB). See South Carolina Code 40-67-520
  • Entity: means an individual, partnership, firm, corporation, or other business entity. See South Carolina Code 44-113-20
  • Epinephrine auto-injector: means a single-use device used for the automatic injection of a premeasured dose of epinephrine into the human body. See South Carolina Code 44-99-10
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Executive committee: means a group of directors elected or appointed to act on behalf of, and within the powers granted to them by, the commission. See South Carolina Code 40-67-520
  • Executive session: A portion of the Senate's daily session in which it considers executive business.
  • Fair: means an enterprise principally devoted to the exhibition of the products of agriculture or industry and at which amusement devices or temporary structures are provided for use by the public. See South Carolina Code 41-18-40
  • Federally related transaction: means any real estate-related financial transaction which a federal financial institution regulatory agency engages in, contracts for, or regulates. See South Carolina Code 40-60-20
  • Finance charge: The total cost of credit a customer must pay on a consumer loan, including interest. The Truth in Lending Act requires disclosure of the finance charge. Source: OCC
  • Firm: means a business entity functioning as a sole proprietorship, partnership, limited liability partnership, professional association, professional corporation, business corporation, limited liability company, joint venture or other legally constituted organization which practices or offers to practice residential building or residential specialty contracting. See South Carolina Code 40-59-20
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fraud: Intentional deception resulting in injury to another.
  • Fund: means the County Grants Fund for Adolescent Pregnancy Prevention Initiatives created by this chapter. See South Carolina Code 44-122-10
  • Grantee: means the department, division, or other unit of a person responsible for the performance under a grant. See South Carolina Code 44-107-20
  • Group practice: means a group of two or more health care professionals legally organized as a partnership, professional corporation, not-for-profit corporation, faculty practice plan, or similar association in which:

    (a) each health care professional who is a member, employee, or independent contractor of the group provides substantially the full range of services which the professional routinely provides including consultation, diagnosis, and treatment through the use of office space, facilities, equipment, and personnel of the group;

    (b) substantially all of the services of the health care professionals who are members of the group are provided through the group and are billed in the name of the group and amounts so received are treated as receipts of the group; and

    (c) the overhead expenses of and the income from the practice are distributed by methods previously determined by the group. See South Carolina Code 44-113-20
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.
  • Health care: means a procedure to diagnose or treat a human disease, ailment, defect, abnormality, or complaint, whether of physical or mental origin. See South Carolina Code 44-66-20
  • Health care facility: means any nonfederal public or private institution, building, agency, or portion thereof, whether for-profit or not-for-profit, that is used, operated, or designed to provide health services; medical treatment; or nursing, rehabilitative or preventive care to any person or persons. See South Carolina Code 44-80-10
  • Health care facility: means a health care facility as defined in § 44-7-130(10). See South Carolina Code 44-113-20
  • Health care practitioner: means a physician, an advanced practice registered nurse authorized to prescribe medication pursuant to § 40-33-34, or a physician assistant authorized to prescribe medication pursuant to §§ 40-47-955 through 40-47-965. See South Carolina Code 44-99-10
  • Health care professional: means an individual who is licensed, certified, or otherwise authorized by the laws of this State to provide health care to members of the public. See South Carolina Code 44-66-20
  • health care professional: means a person licensed, certified, or registered under the laws of this State to provide health care services. See South Carolina Code 44-113-20
  • Health care provider: means a person licensed to practice medicine or osteopathy pursuant to Chapter 47 of Title 40. See South Carolina Code 44-78-15
  • Health care provider: means a person, health care facility, organization, or corporation licensed, certified, or otherwise authorized or permitted by the laws of this State to administer health care. See South Carolina Code 44-80-10
  • Home health agency: shall mean public, nonprofit, or proprietary organization, whether owned or operated by one or more persons or legal entities, which furnishes or offers to furnish home health services. See South Carolina Code 44-69-20
  • Home health services: shall mean those items and services furnished to an individual by a home health agency, or by others under arrangement with the home health agency, on a visiting basis, and except for subsection "e" below, in a place of temporary or permanent residence used as the individual's home as follows:

    (a) Part-time or intermittent skilled nursing care as ordered by a physician, an APRN pursuant to § 40-33-34(D)(2)(h), or a PA pursuant to § 40-47-935(B)(8) and as provided by or under the supervision of a registered nurse and at least one other service listed below;

    (b) Physical, occupational or speech therapy;

    (c) Medical social services, home health aide services and other therapeutic services;

    (d) Medical supplies and the use of medical appliances;

    (e) Any of the foregoing items and services which are provided on an outpatient basis under arrangements made by the home health agency with a hospital, nursing care facility, or rehabilitation center and the furnishing of which involves the use of equipment of such a nature that the items and services cannot be readily made available to the individual in his home, or which are furnished at such facility while the patient is there to receive such items or service, but not including transportation of the individual in connection with any such items or services. See South Carolina Code 44-69-20
  • Home inspection: means the rendering of a written or oral report in exchange for compensation of any sort, regarding the condition of the construction or improvements to a residence including, but not limited to, structural problems or conditions, damage, safety problems, deterioration, equipment, and systems that are visible and readily accessible. See South Carolina Code 40-59-500
  • Home inspector: means an individual who, for compensation of any sort, engages in the business of home inspection. See South Carolina Code 40-59-500
  • Home state: means the member state that is the licensee's primary state of residence. See South Carolina Code 40-67-520
  • Hospice: means a centrally administered, interdisciplinary health care program, which provides a continuum of medically supervised palliative and supportive care for the terminally ill patient and the family including, but not limited to, outpatient and inpatient services provided directly or through written agreement. See South Carolina Code 44-71-20
  • Hospice facility: means an institution, place, or building in which a licensed hospice provides room, board, and appropriate hospice services on a twenty-four hour basis to individuals requiring hospice care pursuant to the orders of a physician. See South Carolina Code 44-71-20
  • Illegal controlled substance: means a controlled substance as defined and covered by Chapter 53 of Title 44, Poisons, Drugs, and Other Controlled Substances, § 44-53-10, et seq. See South Carolina Code 44-54-30
  • Immediate family member: means a health care provider's spouse, child, child's spouse, grandchild, grandchild's spouse, parent, parent-in-law, or sibling. See South Carolina Code 44-113-20
  • In-home care: means care:

    (a) primarily intended to assist an individual with an activity of daily living or in meeting a personal rather than a medical need, but not including skilled care or specific therapy for an illness or injury;

    (b) given to assist an individual in an activity of daily living, such as walking, getting in and out of bed, bathing, dressing, feeding, using the toilet, preparing special diets, and supervising self-administered medication; and

    (c) personal in nature but not mandating continuing attention or supervision from trained and licensed medical personnel. See South Carolina Code 44-70-20
  • In-home care provider: means a business entity, corporation, or association, whether operated for profit or not for profit, that for compensation directly provides or makes provision for in-home care services through its own employees or agents or through contractual arrangements with independent contractors or through referral of other persons to render in-home care services when the individual making the referral has a financial interest in the delivery of those services by those other persons who would deliver those services. See South Carolina Code 44-70-20
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Indirect supervision: means the supervising licensed veterinarian is available for immediate voice contact by telephone, radio, or other means, and shall provide consultation and review of cases at the veterinary facility. See South Carolina Code 40-69-20
  • Individual user: means the individual whose use of an illegal controlled substance that is not obtained directly from or pursuant to a valid prescription or order of a licensed physician or practitioner is the basis of an action brought under this chapter. See South Carolina Code 44-54-30
  • Initiative: means a local program or project funded by a county or consortium of counties pursuant to this chapter. See South Carolina Code 44-122-10
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Intern: means an individual who has met the requirements for licensure as a speech-language pathology or audiology intern under this chapter and has been issued this license by the board. See South Carolina Code 40-67-20
  • Interrogatories: Written questions asked by one party of an opposing party, who must answer them in writing under oath; a discovery device in a lawsuit.
  • Intestate: Dying without leaving a will.
  • Investment interest: means an equity or debt security issued by an entity including, except as provided below, but not limited to, shares of stock in a corporation, units or other interests in a partnership, bonds, debentures, notes, other equity interests, or debt instruments. See South Carolina Code 44-113-20
  • Investor: means a person or entity owning a legal or beneficial ownership or investment interest, directly or indirectly including, but not limited to, through an immediate family member, trust, or corporation, the stock of which is owned in whole or in part by the investor or another entity related to the investor. See South Carolina Code 44-113-20
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Legal representative: means a person with priority to make health care decisions for a patient pursuant to the Adult Health Care Consent Act. See South Carolina Code 44-80-10
  • Level four offense: means the illegal possession with intent to distribute sixteen ounces or more, or the illegal distribution of four ounces or more, of an illegal controlled substance. See South Carolina Code 44-54-30
  • Level one offense: means the illegal possession with intent to distribute less than four ounces or the illegal distribution of less than one ounce of an illegal controlled substance. See South Carolina Code 44-54-30
  • Level three offense: means the illegal possession with intent to distribute eight ounces or more but less than sixteen ounces, or the illegal distribution of two ounces or more, but less than four ounces, of an illegal controlled substance. See South Carolina Code 44-54-30
  • Level two offense: means the illegal possession with intent to distribute four ounces or more but less than eight ounces, or the illegal distribution of one ounce or more, but less than two ounces, of an illegal controlled substance. See South Carolina Code 44-54-30
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • License: shall mean a license issued by the Department. See South Carolina Code 44-69-20
  • License: means a license, registration, or certification issued in accordance with this chapter. See South Carolina Code 40-59-20
  • License: means an authorization to practice speech-language pathology or audiology issued by the board pursuant to this chapter and includes an authorization to practice as a speech-language pathology intern, an audiology intern, and a speech-language pathology assistant. See South Carolina Code 40-67-20
  • License: means an authorization to practice counseling, marriage and family therapy, issued by the board pursuant to this article and includes an authorization to practice as a professional counselor associate, marriage and family therapy associate, or addiction counselor associate. See South Carolina Code 40-75-20
  • License: means any permit, approval, registration, or certificate issued by the board. See South Carolina Code 40-69-20
  • Licensed practitioner: means a person licensed to practice medicine, dentistry, podiatry, chiropractic, or osteopathy in this State. See South Carolina Code 44-74-20
  • Licensed professional counselor: means an individual who practices professional counseling. See South Carolina Code 40-75-20
  • Licensed veterinarian: means a person who is licensed pursuant to this chapter to practice veterinary medicine in this State. See South Carolina Code 40-69-20
  • Licensed veterinary technician: means a person who has received a degree in animal health technology from an American Veterinary Medical Association accredited school offering a program in animal health technology and who has been licensed to practice in this State. See South Carolina Code 40-69-20
  • Licensee: shall mean the individual, corporation, or public entity with whom rests the ultimate responsibility for maintaining approved standards for the home health agency. See South Carolina Code 44-69-20
  • Licensee: means the individual, corporation, or public entity with whom rests the ultimate responsibility for maintaining approved standards for the hospice or hospice facility. See South Carolina Code 44-71-20
  • Licensee: means an individual who currently holds an authorization from the state licensing board to practice as an audiologist or speech-language pathologist. See South Carolina Code 40-67-520
  • Licensee: means an individual who has met the requirements for licensure under this chapter and has been issued a license for speech language pathology or audiology or for speech language pathology or audiology intern or speech-language pathology assistant. See South Carolina Code 40-67-20
  • Licensee: means an individual who has met the requirements for licensure under this article and has been issued a license to practice as a professional counselor or professional counselor associate, marriage and family therapist or marriage and family therapy associate, or addiction counselor associate. See South Carolina Code 40-75-20
  • licensing board: means the agency of a state that is responsible for the licensing and regulation of audiologists and/or speech-language pathologists. See South Carolina Code 40-67-520
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Life-sustaining procedures: means any medical procedures or intervention which would serve only to prolong the dying process and where, in the judgment of the attending physician, death will occur whether or not the procedures are utilized. See South Carolina Code 44-77-20
  • Limited chest radiographer: means a person who conducts diagnostic radiography exams of the chest only, not to include mammography. See South Carolina Code 44-74-20
  • Limited practice radiographer: means a person who conducts diagnostic radiology exams limited to the performance of specific procedures or applications of ionizing radiation to specific parts of the human body. See South Carolina Code 44-74-20
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Local interagency council: means an organized group of representatives of public and private agencies in the county with functions related to youth development. See South Carolina Code 44-122-10
  • Long term outcome: means the measurable reduction in the rate of adolescent pregnancy for a specific target population or defined geographic area. See South Carolina Code 44-122-10
  • Long-term care facility: means an intermediate care facility, nursing care facility, or residential care facility subject to regulation and licensure by the State Department of Health and Environmental Control (department). See South Carolina Code 44-81-30
  • Low risk: means normal, uncomplicated prenatal course as determined by adequate prenatal care and prospects for a normal, uncomplicated birth as defined by reasonable and generally accepted criteria of maternal and fetal health. See South Carolina Code 44-89-30
  • Market analysis: means a study of real estate market conditions for a specific type of property. See South Carolina Code 40-60-20
  • Marketing of an illegal controlled substance: means the possession with intent to distribute or distribution of a specified illegal controlled substance which is a violation of Chapter 53 of Title 44, Poisons, Drugs, and Other Controlled Substances, § 44-53-10, et seq. See South Carolina Code 44-54-30
  • Marriage and family therapy: means the assessment and treatment of mental and emotional disorders, whether cognitive, affective, or behavioral, within the context of marriage and family systems. See South Carolina Code 40-75-20
  • Mass appraisal: means the process of valuing a universe of properties as of a given date using standard methodology, employing common data, and allowing for statistical testing. See South Carolina Code 40-60-20
  • Mass appraiser: means any appraiser who is employed in the office of a tax assessor to appraise real property for ad valorem tax purposes and who is licensed or certified as a mass appraiser. See South Carolina Code 40-60-20
  • member: means a person who contracts for the use of physical fitness services. See South Carolina Code 44-79-20
  • Member state: means a state that has enacted the compact. See South Carolina Code 40-67-520
  • Midwifery: means the application of scientific principles in the care of "with woman" care during uncomplicated pregnancy, birth, and puerperium including care of the newborn, support of the family unit, and gynecologic health care. See South Carolina Code 44-89-30
  • Mistrial: An invalid trial, caused by fundamental error. When a mistrial is declared, the trial must start again from the selection of the jury.
  • Mobile facility: means a vehicle with special medical or surgical facilities or a vehicle suitable only for making house or farm calls. See South Carolina Code 40-69-20
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Multiple location: means a properly registered additional site, other than the licensed primary office, from which a parent hospice organization provides hospice services. See South Carolina Code 44-71-20
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Nuclear medicine technologist: means a person, other than a licensed practitioner, who prepares and administers radiopharmaceutical agents to humans for diagnostic and therapeutic purposes. See South Carolina Code 44-74-20
  • Oath: A promise to tell the truth.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Outlet: means a separate location of a center which is not physically connected with another center but which uses the same name. See South Carolina Code 44-79-20
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Owner: means a person, corporation, partnership, or association who owns an amusement device or, in the event that the amusement device is leased, the lessee. See South Carolina Code 41-18-40
  • Parent hospice: means a properly licensed hospice that, in addition to its primary office, also provides hospice services from a multiple location as defined in item (6). See South Carolina Code 44-71-20
  • Parent or guardian: means a parent, custodian, or guardian responsible for the control, safety, training, or education of a minor or a person who is disabled or incompetent. See South Carolina Code 41-18-310
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Patient: means an individual sixteen years of age or older who presents or is presented to a health care provider for treatment. See South Carolina Code 44-66-20
  • Patient: means an individual who presents or is presented to a health care provider for treatment. See South Carolina Code 44-80-10
  • Permanent device: means a device which is used, or intended to be used, as an amusement device that is erected to remain a lasting part of the premises. See South Carolina Code 41-18-40
  • Permanent unconsciousness: means a medical diagnosis, consistent with accepted standards of medical practice, that a person is in a persistent vegetative state or some other irreversible condition in which the person has no neocortical functioning, but only involuntary vegetative or primitive reflex functions controlled by the brain stem. See South Carolina Code 44-77-20
  • Person: means a natural person, governmental entity, or corporation, partnership, firm, trust, or incorporated or unincorporated association, existing under or authorized by the laws of this State, another state, or a foreign country. See South Carolina Code 44-54-30
  • Person: includes , but is not limited to, an individual, a state agency, or a representative of a state agency. See South Carolina Code 44-66-20
  • Person: means an individual, partnership, committee, association, corporation, hospital, or other organization or group. See South Carolina Code 44-77-20
  • Person: means a natural individual, private or public organization, political subdivision, or other governmental agency. See South Carolina Code 44-89-30
  • Person: means an individual, corporation, partnership, or association, foreign and domestic. See South Carolina Code 40-60-20
  • Person: means an individual, organization, or corporation, except that only individuals can be licensed under this chapter. See South Carolina Code 40-67-20
  • Person: means an individual, organization, or corporation, except that only individuals can be licensed under this article. See South Carolina Code 40-75-20
  • Personal property: All property that is not real property.
  • Physical fitness services: means facilities or services for the development of physical fitness through exercise or weight control. See South Carolina Code 44-79-20
  • Physician: means an individual who is licensed to practice medicine or osteopathy pursuant to Chapter 47 of Title 40. See South Carolina Code 44-66-20
  • Physician: shall mean an individual currently licensed to practice medicine, surgery, or osteopathy in this State. See South Carolina Code 44-69-20
  • Physician: means a person licensed to practice medicine. See South Carolina Code 44-77-20
  • Physician: means a doctor of medicine or doctor of osteopathic medicine licensed by the South Carolina Board of Medical Examiners. See South Carolina Code 44-80-10
  • Physician: means a doctor of medicine or osteopathy with training in obstetrics or midwifery and licensed by the South Carolina State Board of Medical Examiners to practice medicine. See South Carolina Code 44-89-30
  • Physician: means a person authorized to practice medicine pursuant to Article 1, Chapter 47 of Title 40. See South Carolina Code 44-99-10
  • Place of illegal activity: means , in relation to the individual user of an illegal controlled substance, each county in which the individual illegally possesses or uses an illegal controlled substance during the period of the individual's use of an illegal controlled substance. See South Carolina Code 44-54-30
  • Place of participation: means , in relation to a defendant in an action brought under this chapter, each county in which the person participates in the marketing of illegal controlled substances during the period of the person's participation in the marketing of illegal controlled substances. See South Carolina Code 44-54-30
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Podiatric limited practice radiographer: means a person who conducts diagnostic radiology exams limited to the performance of specific procedures or applications of ionizing radiation to specific parts of the human body, working under the supervision of a licensed podiatrist. See South Carolina Code 44-74-20
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • practice of audiology: means the rendering of or the offering to render any audiology service to an individual, group, organization, or the public. See South Carolina Code 40-67-20
  • Practice of professional counseling: means functioning as a psycho-therapist and may include, but is not limited to, providing individual therapy, family counseling, group therapy, marital counseling, play therapy, couples counseling, substance abuse counseling, vocational counseling, school counseling, rehabilitation counseling, intervention, human growth and development counseling, behavioral modification counseling, and hypnotherapy. See South Carolina Code 40-75-20
  • practice of speech-language pathology: means the rendering of or the offering to render any speech-language pathology services to an individual, group, organization, or the public. See South Carolina Code 40-67-20
  • Practice of veterinary medicine: means to:

    (a) diagnose, prescribe, or administer a drug, medicine, biologic, appliance, or application or treatment of whatever nature for the cure, prevention, or relief of a wound, fracture, or bodily injury or disease of an animal;

    (b) perform a surgical operation, including cosmetic surgery, upon an animal;

    (c) perform a manual procedure for the diagnosis or treatment for sterility or infertility of an animal, including embryo transplants;

    (d) offer, undertake, represent, or hold oneself out as being qualified to diagnose, treat, operate, or prescribe for an animal disease, pain, injury, deformity, or physical condition;

    (e) use words, letters, or titles in such connection or under such circumstances as to induce the belief that the person using them is engaged in the practice of veterinary medicine. See South Carolina Code 40-69-20
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Preliminary hearing: A hearing where the judge decides whether there is enough evidence to make the defendant have a trial.
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Primary office: means the main office of a hospice program from which a parent hospice provides hospice services to patients and their families and from which a parent hospice performs oversight, administrative, and coordination of care duties for any multiple location. See South Carolina Code 44-71-20
  • Primary pregnancy prevention: means prevention of first pregnancy. See South Carolina Code 44-122-10
  • Prior convictions: means felonies and misdemeanors, prior convictions not classified at the time of conviction, federal or out-of-state convictions, circuit, magistrate, and municipal court convictions, and juvenile adjudications if the offenses would be felonies if committed by an adult. See South Carolina Code 44-54-30
  • Privilege to practice: means a legal authorization permitting the practice of audiology or speech-language pathology in a remote state. See South Carolina Code 40-67-520
  • Pro se: A Latin term meaning "on one's own behalf"; in courts, it refers to persons who present their own cases without lawyers.
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Provide: means the supply of one or more epinephrine auto-injectors to an individual. See South Carolina Code 44-99-10
  • provider: means a person, health care facility, organization, or corporation licensed, certified, or otherwise authorized or permitted by the laws of this State to administer health care. See South Carolina Code 44-66-20
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Quorum: The number of legislators that must be present to do business.
  • Radiation therapist: means a person, other than a licensed practitioner, who applies radiation to humans for therapeutic purposes. See South Carolina Code 44-74-20
  • Radiographer: means a person, other than a licensed practitioner, who applies radiation to humans for diagnostic purposes including, but not limited to, mammography, cardiovascular-interventional technology, and computed tomography. See South Carolina Code 44-74-20
  • Radiologic technologist: means a person who is a limited practice radiographer, radiographer, podiatric limited practice radiographer, limited chest radiographer, radiation therapist, or nuclear medicine technologist certified by the American Registry of Radiologic Technologists or who is certified by the South Carolina Radiation Quality Standards Association or who has obtained a certificate acceptable to the South Carolina Radiation Quality Standards Association. See South Carolina Code 44-74-20
  • Real estate: means an identified parcel or tract of land including improvements, if any. See South Carolina Code 40-60-20
  • Real estate appraisal activity: means the act or process of performing an appraisal and preparing an appraisal report. See South Carolina Code 40-60-20
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Real property: means the interests, benefits, and rights inherent in the ownership of real estate. See South Carolina Code 40-60-20
  • Referral: means a referral of a patient by a health care provider for health care services including, but not limited to:

    (a) the forwarding of a patient by a health care provider to another health care provider or to an entity outside the health care professional's office or group practice which provides or supplies designated health services or any other health care item or service; or

    (b) the request or establishment of a plan of care by a health care provider, which includes the provision of a designated health service or any other health care item or service outside the health care professional's office or group practice. See South Carolina Code 44-113-20
  • Referral: means evaluating and identifying needs of a client to determine the advisability of referral to other specialists, informing the client of this determination, and communicating as requested or considered appropriate with these referral sources. See South Carolina Code 40-75-20
  • Regionally accredited institution: means a school, college, or university which is a candidate for accreditation or is accredited by any accreditation body established to serve six defined geographic areas in the United States. See South Carolina Code 40-67-20
  • Registered Nurse: shall mean an individual who is currently licensed as such in this State. See South Carolina Code 44-69-20
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Remote state: means a member state other than the home state where a licensee is exercising or seeking to exercise the compact privilege. See South Carolina Code 40-67-520
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Representative: means a resident's legal guardian, committee, or next of kin or other person acting as agent of a resident who does not have a legally appointed guardian. See South Carolina Code 44-81-30
  • Residence: means a structure including, but not limited to, condominiums and townhouses intended to be used or in fact used primarily for living quarters which is not over three floors in height and which does not have more than sixteen units. See South Carolina Code 40-59-500
  • Resident: means a person who is receiving treatment or care in a long-term care facility. See South Carolina Code 44-81-30
  • Residential builder: means one who constructs, superintends, or offers to construct or superintend the construction, repair, improvement, or reimprovement of a residential building or structure which is not over three floors in height and which does not have more than sixteen units in any single apartment building, when the cost of the undertaking exceeds five thousand dollars. See South Carolina Code 40-59-20
  • Residential specialty contractor: means an independent contractor who contracts with a licensed residential builder, general contractor, or individual property owner to do construction work, repairs, improvement, or reimprovement which requires special skills and involves the use of specialized construction trades or craft, when the undertakings exceed five hundred dollars and are not regulated by the provisions of Chapter 11. See South Carolina Code 40-59-20
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Resuscitative treatment: means artificial stimulation of the cardiopulmonary systems of the human body, through either electrical, mechanical, or manual means including, but not limited to, cardiopulmonary resuscitation. See South Carolina Code 44-78-15
  • rider: means a person who is:

    (a) waiting in the immediate vicinity to get on a carnival or amusement device;

    (b) getting on a carnival or amusement device;

    (c) using a carnival or amusement device;

    (d) getting off a carnival or amusement device; or

    (e) leaving a carnival or amusement device and who is still in the immediate vicinity of the carnival or amusement device. See South Carolina Code 41-18-310
  • River basins: means that land area designated as the Catawba/Wateree, Yadkin/Pee Dee River Basins by the North Carolina Department of Environmental and Natural Resources and the South Carolina Department of Health and Environmental Control. See South Carolina Code 44-59-10
  • Rule: means a regulation, principle, or directive promulgated by the commission that has the force of law. See South Carolina Code 40-67-520
  • Rural area: means a county with a population of one hundred thousand persons or less according to the latest United States census. See South Carolina Code 44-113-20
  • Safety coordinator: means a person suited by training or experience and designated by the owner or operator of an amusement park, fair, or carnival as being in charge of the safety of all amusement devices located at the park, fair, or carnival. See South Carolina Code 41-18-40
  • Serious injury: means an injury that results in death or requires immediate in-patient hospitalization. See South Carolina Code 41-18-40
  • service: means personal service or delivery by certified mail to the last known address of the addressee. See South Carolina Code 40-59-820
  • Service of process: The service of writs or summonses to the appropriate party.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Short term outcomes: means the intermediate results that a particular adolescent pregnancy prevention intervention is likely to produce including, but not limited to, increased knowledge, behavior change, or delays or reductions in sexual activity. See South Carolina Code 44-122-10
  • Single-state license: means an audiology or speech-language pathology license issued by a member state that authorizes practice only within the issuing state and does not include a privilege to practice in any other member state. See South Carolina Code 40-67-520
  • Special inspector: means an inspector licensed by the director and not employed by the department. See South Carolina Code 41-18-40
  • Speech-language pathologist: means an individual who is licensed by a state to practice speech-language pathology. See South Carolina Code 40-67-520
  • Speech-language pathologist: means an individual who practices speech-language pathology. See South Carolina Code 40-67-20
  • Speech-language pathology: means the care and services provided by a licensed speech-language pathologist as set forth in the member state's statutes and rules. See South Carolina Code 40-67-520
  • Speech-language pathology assistant: means an individual who provides speech-language pathology services as prescribed, directed, and supervised by a speech-language pathologist licensed under this chapter. See South Carolina Code 40-67-20
  • State: means any state, commonwealth, district, or territory of the United States of America that regulates the practice of audiology and speech-language pathology. See South Carolina Code 40-67-520
  • State-certified general appraiser: means an appraiser authorized to engage in the appraisal of all types of real property. See South Carolina Code 40-60-20
  • State-certified general mass appraiser: means an appraiser authorized to engage in all types of real estate mass appraisal activity for ad valorem purposes. See South Carolina Code 40-60-20
  • State-certified residential appraiser: means an appraiser authorized to engage in the appraisal of one to four residential units without regard to transaction value or complexity and nonresidential appraisals with a transaction value less than two hundred fifty thousand dollars. See South Carolina Code 40-60-20
  • State-certified residential mass appraiser: means an appraiser authorized to engage in the mass appraisal of one to four residential units without regard to value or complexity and nonresidential appraisals with a transaction value less than two hundred fifty thousand dollars. See South Carolina Code 40-60-20
  • State-licensed appraiser: means an appraiser authorized to engage in the appraisal of noncomplex one to four residential units having a transaction value less than one million dollars and complex one to four residential units and nonresidential appraisals having a transaction value less than two hundred fifty thousand dollars. See South Carolina Code 40-60-20
  • Statute: A law passed by a legislature.
  • Subpoena: A command to a witness to appear and give testimony.
  • Subunit: shall mean a semiautonomous organization, which serves patients in a geographic area different from that of the parent agency. See South Carolina Code 44-69-20
  • Super-kart: means an open-wheel motorsport vehicle, with or without gearbox or shifter capability, used for racing in excess of fifty miles per hour. See South Carolina Code 41-18-40
  • Supervision: means the supervision of clinical services in accordance with standards established by the board under the supervision of an approved supervisor. See South Carolina Code 40-75-20
  • Telehealth: means the application of telecommunication technology to deliver audiology or speech-language pathology services at a distance for assessment, intervention, or consultation. See South Carolina Code 40-67-520
  • Temporary device: means a device which is used as an amusement device that is regularly relocated with or without disassembly. See South Carolina Code 41-18-40
  • Temporary license: means temporary permission to practice veterinary medicine or animal technology issued pursuant to this chapter. See South Carolina Code 40-69-20
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Terminal condition: means an incurable or irreversible condition that, within reasonable medical judgment, could cause death within a reasonably short period of time if life-sustaining procedures are not used. See South Carolina Code 44-77-20
  • Terminal condition: means an incurable or irreversible condition that within reasonable medical judgment will cause death within a reasonably short period of time with or without the administration of life-sustaining treatment. See South Carolina Code 44-78-15
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Timberland: means forestland that is producing or is capable of producing timber as a crop. See South Carolina Code 40-60-20
  • Treatment: means the broad range of emergency, outpatient, intermediate, and inpatient services and care that may be extended to a patient to diagnose and treat a human disease, ailment, defect, abnormality, or complaint, whether of physical or mental origin. See South Carolina Code 44-66-20
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trustee: A person or institution holding and administering property in trust.
  • Truth in Lending Act: The Truth in Lending Act is a federal law that requires lenders to provide standardized information so that borrowers can compare loan terms. In general, lenders must provide information on Source: OCC
  • Unable to consent: means unable to appreciate the nature and implications of the patient's condition and proposed health care, to make a reasoned decision concerning the proposed health care, or to communicate that decision in an unambiguous manner. See South Carolina Code 44-66-20
  • Uphold: The decision of an appellate court not to reverse a lower court decision.
  • USPAP: means the National Uniform Standards of Professional Appraisal Practice as adopted by the Appraisal Standards Board of the Appraisal Foundation and adopted by the board. See South Carolina Code 40-60-20
  • Valuation: means an estimate of the value of real estate or real property. See South Carolina Code 40-60-20
  • valuation assignment: means an engagement for which an appraiser is employed or retained to act, or would be perceived by third parties or the public as acting, as a disinterested third party in rendering an unbiased analysis, opinion, or conclusion that estimates the value of real estate. See South Carolina Code 40-60-20
  • Venue: The geographical location in which a case is tried.
  • Verdict: The decision of a petit jury or a judge.
  • Veterinarian: means a person who has received a doctor's degree or equivalent in veterinary medicine. See South Carolina Code 40-69-20
  • Veterinary medicine: includes veterinary surgery, obstetrics, dentistry, and all other branches or specialties of veterinary medicine. See South Carolina Code 40-69-20
  • Veterinary student preceptee: means a person who is a student enrolled and in good standing in a recognized college of veterinary medicine. See South Carolina Code 40-69-20
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
