Terms Used In Tennessee Code 40-17-206

  • Person: includes a corporation, firm, company or association. See Tennessee Code 1-3-105
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in a perceivable form. See Tennessee Code 1-3-105
  • State: includes any territory of the United States and the District of Columbia. See Tennessee Code 40-17-202
  • Summons: includes a subpoena, order or other notice requiring the appearance of a witness. See Tennessee Code 40-17-202
  • Summons: Another word for subpoena used by the criminal justice system.
  • Testify: Answer questions in court.
  • Witness: includes a person whose testimony is desired in any proceeding or investigation by a grand jury or in a criminal action, prosecution or proceeding. See Tennessee Code 40-17-202

If the witness who is summoned as provided in §§ 40-17-203 – 40-17-205, after being paid or tendered, by some properly authorized person, compensation in accordance with title 24, chapter 4 for expenses incurred for each day the witness is required to travel and attend as a witness, fails without good cause to attend and testify as directed in the summons, the witness shall be punished in the manner provided for the punishment of any witness who disobeys a summons issued from a court of record in this state.
