  • Agriculture: means :
    1. The land, buildings and machinery used in the commercial production of farm products and nursery stock. See Tennessee Code 1-3-105
    2. Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
    3. Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
    4. Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
    5. Brand name: means any word, name, symbol, or device, or any combination thereof, identifying the commercial feed of a distributor or registrant and distinguishing it from that of others. See Tennessee Code 44-6-103
    6. Code: includes the Tennessee Code and all amendments and revisions to the code and all additions and supplements to the code. See Tennessee Code 1-3-105
    7. Commercial feed: means all materials except unmixed seed, whole and unprocessed, when not adulterated within the meaning of this chapter, that are offered for sale as feed or mixing for feed. See Tennessee Code 44-6-103
    8. Commissioner: means the commissioner of agriculture, or the commissioner's authorized agent. See Tennessee Code 44-6-103
    9. Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
    10. Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
    11. Contract: A legal written agreement that becomes binding when signed.
    12. Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
    13. Customer-formula feed: means commercial feed that consists of a mixture of two (2) or more commercial feeds or a mixture of one (1) or more commercial feeds and one (1) or more feed ingredients or a mixture of two (2) or more feed ingredients, each batch of which is manufactured according to the specific instructions of the final purchaser. See Tennessee Code 44-6-103
    14. Deed: The legal instrument used to transfer title in real property from one person to another.
    15. Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
    16. Distribute: means to offer for sale, sell, exchange, or barter commercial feed or customer-formula feed. See Tennessee Code 44-6-103
    17. Distributor: means any person who distributes. See Tennessee Code 44-6-103
    18. Drug: means any article intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in animals other than humans, and articles other than feed intended to affect the structure or function of any part of the animal body. See Tennessee Code 44-6-103
    19. Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
    20. Feed ingredient: means each of the constituent materials making up a commercial feed. See Tennessee Code 44-6-103
    21. Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
    22. Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
    23. Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
    24. Jurisprudence: The study of law and the structure of the legal system.
    25. Label: means a display of written, printed, or graphic matter upon or affixed to the container in which a commercial feed is distributed, or on the invoice or delivery slip with which a commercial feed is distributed. See Tennessee Code 44-6-103
    26. Labeling: means all labels and other written, printed, or graphic matter:
      1. Upon commercial feed or any of its containers or wrapper. See Tennessee Code 44-6-103
      2. Lands: includes lands, tenements and hereditaments, and all rights thereto and interests therein, equitable as well as legal. See Tennessee Code 1-3-105
      3. Manufacture: means to grind, mix or blend, or further process a commercial feed for distribution. See Tennessee Code 44-6-103
      4. Minor: means any person who has not attained eighteen (18) years of age. See Tennessee Code 1-3-105
      5. Misdemeanor: Usually a petty offense, a less serious crime than a felony, punishable by less than a year of confinement.
      6. Official sample: means a sample of feed taken by the commissioner or the commissioner's agent in accordance with § 44-6-111(c), (e) or (f). See Tennessee Code 44-6-103
      7. Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
      8. percentage: means percentage by weight. See Tennessee Code 44-6-103
      9. Person: includes individual, partnership, corporation, association, or other legal entity. See Tennessee Code 44-6-103
      10. Person: includes a corporation, firm, company or association. See Tennessee Code 1-3-105
      11. Pet: means any domesticated animal normally maintained in or near the household of its owner. See Tennessee Code 44-6-103
      12. Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
      13. Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
      14. Product name: means the name of the commercial feed that identifies it as to kind, class, or specific use. See Tennessee Code 44-6-103
      15. Quantity statement: means the net weight (mass), net volume (liquid or dry) or count. See Tennessee Code 44-6-103
      16. Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in a perceivable form. See Tennessee Code 1-3-105
      17. Representative: when applied to those who represent a decedent, includes executors and administrators, unless the context implies heirs and distributees. See Tennessee Code 1-3-105
      18. signed: includes a mark, the name being written near the mark and witnessed, or any other symbol or methodology executed or adopted by a party with intention to authenticate a writing or record, regardless of being witnessed. See Tennessee Code 1-3-105
      19. State: when applied to the different parts of the United States, includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105
      20. Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
      21. Venue: The geographical location in which a case is tried.
      22. written: includes printing, typewriting, engraving, lithography, and any other mode of representing words and letters. See Tennessee Code 1-3-105
      23. Year: means a calendar year, unless otherwise expressed. See Tennessee Code 1-3-105
