Terms Used In Texas Code of Criminal Procedure 55A.051
- Arrest: Taking physical custody of a person by lawful authority.
- Conviction: A judgement of guilt against a criminal defendant.
- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
This subchapter applies to a person who has been placed under a custodial or noncustodial arrest for commission of a felony or misdemeanor if:
(1) the person has been released;
(2) the charge, if any, has not resulted in a final conviction and is no longer pending; and
(3) there was no court-ordered community supervision under Chapter 42A for the offense, other than for a Class C misdemeanor.
