(a) On the filing of an application for guardianship, the court clerk shall issue a citation stating:
(1) that the application was filed;
(2) the name of the proposed ward;
(3) the name of the applicant; and
(4) the name of the person to be appointed guardian as provided in the application, if that person is not the applicant.
(b) The citation must cite all persons interested in the welfare of the proposed ward to appear at the time and place stated in the notice if the persons wish to contest the application.

Terms Used In Texas Estates Code 1051.102

  • Court: means and includes:
    (1) a county court in the exercise of its probate jurisdiction;
    (2) a court created by statute and authorized to exercise original probate jurisdiction; and
    (3) a district court exercising original probate jurisdiction in a contested matter. See Texas Estates Code 22.007
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Person: includes a natural person and a corporation. See Texas Estates Code 22.027
  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Ward: means a person for whom a guardian has been appointed. See Texas Estates Code 22.033

(c) The citation shall be posted.
(d) The citation must contain a clear and conspicuous statement informing those interested persons of the right provided under § 1051.252 to be notified of any or all motions, applications, or pleadings relating to the application for the guardianship or any subsequent guardianship proceeding involving the ward after the guardianship is created, if any.
