Terms Used In Texas Estates Code 255.102
- Devise: To gift property by will.
- Devisee: includes a legatee. See Texas Estates Code 22.009
- Property: means real and personal property. See Texas Government Code 311.005
- Testator: A male person who leaves a will at death.
Property given in partial satisfaction of a devise shall be valued as of the earlier of:
(1) the date the devisee acquires possession of or enjoys the property; or
(2) the date of the testator‘s death.
