Terms Used In Texas Insurance Code 541.204

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Rule: includes regulation. See Texas Government Code 311.005

In addition to requesting a temporary or permanent injunction under § 541.201, the attorney general may request a civil penalty of not more than $10,000 for each violation on a finding by the court that the defendant has engaged in or is engaging in an act or practice defined as unlawful under:
(1) this chapter or a rule adopted under this chapter; or
(2) § 17.46, Business & Commerce Code.
