(a) This section applies only to a violation related to a well located in the boundaries of the groundwater conservation district seeking to bring an action under this section.
(b) A groundwater conservation district shall enforce compliance with § 1901.255 related to wells located in the boundaries of the district.

  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
  • Rule: includes regulation. See Texas Government Code 311.005

(c) A groundwater conservation district may bring an action to enjoin a person from violating § 1901.255.
(d) A groundwater conservation district may enforce by injunction or other appropriate remedy in a court any rule, decision, determination, or order adopted or entered under this chapter that is related to § 1901.255.
(e) A groundwater conservation district may bring an action to recover a civil penalty under § 1901.401 for a violation of this chapter or a rule adopted under this chapter related to § 1901.255.
(f) The groundwater conservation district may bring the action in the county in which:
(1) the offending activity occurred; or
(2) the person engaging in the activity resides.
