(a) To exercise a power provided by law, the authority may exercise the power of eminent domain to acquire any property and any interest in property inside the authority’s boundaries. The authority must exercise the power of eminent domain in the manner provided by Chapter 21, Property Code.
(b) The authority is a municipal corporation for the purposes of Section 21.021, Property Code.

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Comptroller: means the state comptroller of public accounts. See Texas Government Code 312.011
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Property: means real and personal property. See Texas Government Code 311.005

(c) The authority is not required to give bond for appeal or bond for costs in any judicial proceeding related to the authority’s exercise of eminent domain.
(d) The authority’s authority to exercise the power of eminent domain expired on September 1, 2013, unless the authority submitted a letter to the comptroller in accordance with Section 2206.101(b), Government Code, not later than December 31, 2012.
