(a) The commission by rule shall adopt requirements for:
(1) maintaining evidence of financial responsibility for restoration of a water body affected by an unauthorized discharge from a permitted quarry; or
(2) taking corrective action and compensating for water quality effects caused by an unauthorized discharge resulting from quarrying.
(b) A responsible party commits a violation if the responsible party operates a permitted quarry knowing that financial responsibility required by a permit does not exist.
Terms Used In Texas Water Code 26.554
- Commission: means the Texas Natural Resource Conservation Commission. See Texas Water Code 26.001
- Effects: includes all personal property and all interest in that property. See Texas Government Code 312.011
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Permit: means an order issued by the commission in accordance with the procedures prescribed in this chapter establishing the treatment which shall be given to wastes being discharged into or adjacent to any water in the state to preserve and enhance the quality of the water and specifying the conditions under which the discharge may be made. See Texas Water Code 26.001
- Rule: includes regulation. See Texas Government Code 311.005
