For any week beginning on or after January 1, 2020, the department may waive the one-week waiting period described in Subsection 35A-4-403(1)(d) and pay a benefit to an unemployed individual for that week if:
(1) the unemployed individual otherwise qualifies for a benefit for that week; and

- Department: means the Department of Workforce Services created in Section 35A-1-103. See Utah Code 35A-1-102
- State: includes the Commonwealth of Puerto Rico, the Virgin Islands, and the District of Columbia. See Utah Code 35A-4-201
- United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
- Week: means the period or periods of seven consecutive calendar days as the department may prescribe by rule. See Utah Code 35A-4-201

(2)(a) the president of the United States has issued an order declaring a national emergency that is effective in the state during that week;
(2)(b) the governor has issued an executive order declaring a state of emergency as described in Title 53, Chapter 2a, Emergency Management Act, that is effective during that week; or
(2)(c) the federal government has agreed to reimburse the department for the cost of paying the benefit for that week.
