39A-5-118. Service of charges on accused.
(1) |
The trial counsel to whom charges are referred for trial shall cause to be served upon the accused a copy of the charges to be tried. |
Terms Used In Utah Code 39A-5-118
- Military: means any or all of the armed forces of the United States. See Utah Code 39A-5-102
- Military court: means a court-martial, a court of inquiry, or a provost court. See Utah Code 39A-5-102
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.

An individual may not, against his or her objection, be brought to trial or be required to participate in a session called by the military judge under Section 39A-5-216, in a military court case, within five days after the service of charges. |
