52-4-201.3. Local school boards — Public comment.

As used in this section, “local school board” means a board elected under 2. |

- Germane: On the subject of the pending bill or other business; a strict standard of relevance.
- Meeting: means the convening of a public body or a specified body, with a quorum present, including a workshop or an executive session, whether in person or by means of electronic communications, for the purpose of discussing, receiving comments from the public about, or acting upon a matter over which the public body or specified body has jurisdiction or advisory power. See Utah Code 52-4-103

(a) |
A local school board holding a meeting that is open to the public under Section 52-4-201 shall allow a reasonable opportunity for the public to provide verbal comments that are germane to the authority of the local school board. |
(b) |
Subsection (2)(a) does not apply to a meeting that is:
(ii) |
an emergency meeting as described in Subsection 52-4-202(5). |

(3) |
No later than July 1, 2023, a local school board shall adopt a written policy that provides a reasonable opportunity for the public to provide both verbal and written comments in a meeting of the local school board that:
(a) |
is open to the public; and |
(b) |
is not a meeting described in Subsection (2)(b). |

(4) |
The written policy described in Subsection (3) may limit public verbal and written comments to topics that are germane to the authority of the local school board. |
