Terms Used In Utah Code 57-29-202

  • Division: means the Division of Real Estate created in Section 61-2-201. See Utah Code 57-29-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Undivided fractionalized long-term estate: means an ownership interest in real property by two or more persons that is:
              (8)(a)(i) a tenancy in common; or
              (8)(a)(ii) a fee estate. See Utah Code 57-29-102

     Except as provided by Section 61-2f-202, a person may not offer, sell, or otherwise dispose of an undivided fractionalized long-term estate unless the person is licensed by the division under Title 61, Chapter 2f, Real Estate Licensing and Practices Act, as a principal broker, associate broker, or sales agent.
