(1) As used in this section, “delinquent lot owner” means a lot owner who fails to pay an assessment when due.

- Assessment: includes :(1)(b)(i) a common expense; and(1)(b)(ii) an amount assessed against a lot owner under Subsection
57-8a-405 (7). See Utah Code 57-8a-102- association: means a corporation or other legal entity, any member of which:
(2)(a)(i) is an owner of a residential lot located within the jurisdiction of the association, as described in the governing documents; and(2)(a)(ii) by virtue of membership or ownership of a residential lot is obligated to pay:(2)(a)(ii)(A) real property taxes;(2)(a)(ii)(B) insurance premiums;(2)(a)(ii)(C) maintenance costs; or(2)(a)(ii)(D) for improvement of real property not owned by the member. See Utah Code 57-8a-102- board: means the entity, regardless of name, with primary authority to manage the affairs of the association. See Utah Code 57-8a-102
- Common expense: means costs incurred by the association to exercise any of the powers provided for in the association's governing documents. See Utah Code 57-8a-102
- Lot: means :
(16)(a) a lot, parcel, plot, or other division of land:(16)(a)(i) designated for separate ownership or occupancy; and(16)(a)(ii)(16)(a)(ii)(A) shown on a recorded subdivision plat; or(16)(a)(ii)(B) the boundaries of which are described in a recorded governing document; or(16)(b)(16)(b)(i) a unit in a condominium association if the condominium association is a part of a development; or(16)(b)(ii) a unit in a real estate cooperative if the real estate cooperative is part of a development. See Utah Code 57-8a-102- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) A board may, if authorized in the declaration, bylaws, or rules and as provided in this section, terminate a delinquent lot owner’s right:(2)(a) to receive a utility service for which the lot owner pays as a common expense; or(2)(b) of access to and use of recreational facilities.(3)(3)(a) Before terminating a utility service or right of access to and use of recreational facilities under Subsection(2) , the manager or board shall give the delinquent lot owner notice in a manner provided in the declaration, bylaws, or association rules.(3)(b)(3)(b)(i) A notice under Subsection(3)(a) shall state:(3)(b)(i)(A) that the association will terminate the lot owner’s utility service or right of access to and use of recreational facilities, or both, if the association does not receive payment of the assessment within the time provided in the declaration, bylaws, or association rules, subject to Subsection(3)(b)(ii) ;(3)(b)(i)(B) the amount of the assessment due, including any interest or late payment fee; and(3)(b)(i)(C) the lot owner’s right to request a hearing under Subsection(4) .(3)(b)(ii) The time provided under Subsection(3)(b)(i)(A) may not be less than 14 days.(3)(b)(iii) A notice under Subsection(3)(a) may include the estimated cost to reinstate a utility service if service is terminated.(4)(4)(a) A delinquent lot owner may submit a written request to the board for an informal hearing to dispute the assessment.(4)(b) A request under Subsection(4)(a) shall be submitted within 14 days after the date the delinquent lot owner receives the notice under Subsection(3) .(5) A board shall conduct an informal hearing requested under Subsection(4) in accordance with the standards provided in the declaration, bylaws, or association rules.(6) If a delinquent lot owner requests a hearing, the association may not terminate a utility service or right of access to and use of recreational facilities until after the board:(6)(a) conducts the hearing; and(6)(b) enters a final decision.(7) If an association terminates a utility service or a right of access to and use of recreational facilities, the association shall take immediate action to reinstate the service or right following the lot owner’s payment of the assessment, including any interest and late payment fee.(8) An association may:(8)(a) assess a lot owner for the cost associated with reinstating a utility service that the association terminates as provided in this section; and(8)(b) demand that the estimated cost to reinstate the utility service be paid before the service is reinstated, if the estimated cost is included in a notice under Subsection(3) . - association: means a corporation or other legal entity, any member of which:
