Terms Used In Utah Code 63G-4-404

  • Agency: means a board, commission, department, division, officer, council, office, committee, bureau, or other administrative unit of this state, including the agency head, agency employees, or other persons acting on behalf of or under the authority of the agency head, but does not mean the Legislature, the courts, the governor, any political subdivision of the state, or any administrative unit of a political subdivision of the state. See Utah Code 63G-4-103
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Statute: A law passed by a legislature.
(a)  In either the review of informal adjudicative proceedings by the district court or the review of formal adjudicative proceedings by an appellate court, the court may award damages or compensation only to the extent expressly authorized by statute.

(b)  In granting relief, the court may:

(i)  order agency action required by law;

(ii)  order the agency to exercise its discretion as required by law;

(iii)  set aside or modify agency action;

(iv)  enjoin or stay the effective date of agency action; or

(v)  remand the matter to the agency for further proceedings.

(2)  Decisions on petitions for judicial review of final agency action are reviewable by a higher court, if authorized by statute.
