78B-7-903. Penalties.
(1) |
A violation of a permanent criminal stalking injunction issued under this part is a third degree felony in accordance with Subsection 76-5-106.5(3)(b). |

Terms Used In Utah Code 78B-7-903
- Criminal stalking injunction: means a stalking injunction issued under 9. See Utah Code 78B-7-102
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Stalking: means the same as that term is defined in Section 76-5-106. See Utah Code 78B-7-102

A violation of a permanent criminal stalking injunction issued under this part may be enforced in a civil action initiated by the stalking victim, a criminal action initiated by a prosecuting attorney, or both. |
