Terms Used In Utah Code > Title 4 > Chapter 25

  • Address: includes :
    (i) a post office box number;
    (ii) a rural free delivery route number; and
    (iii) a street name and number. See Utah Code 16-6a-102
  • Agriculture: means the science and art of the production of plants and animals useful to man, including the preparation of plants and animals for human use and disposal by marketing or otherwise. See Utah Code 4-7-110
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Articles of incorporation: include :
    (a) amended articles of incorporation;
    (b) restated articles of incorporation;
    (c) articles of merger; and
    (d) a document of a similar import to the documents described in Subsections (3)(a) through (c). See Utah Code 16-6a-102
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Assumed corporate name: means a name assumed for use in this state:
    (a) by a:
    (i) foreign corporation pursuant to Section 16-10a-1506; or
    (ii) a foreign nonprofit corporation pursuant to Section 16-6a-1506; and
    (b) because the corporate name of the foreign corporation described in Subsection (4)(a) is not available for use in this state. See Utah Code 16-6a-102
  • board of directors: means the body authorized to manage the affairs of a domestic or foreign nonprofit corporation. See Utah Code 16-6a-102
  • Brand: means any term, design, or trade mark used in connection with one or several grades of commercial fertilizer or soil amendment. See Utah Code 4-25-206
  • Brand name: means one or more words, names, symbols, or devices that:
    (a) identify a distributor or registrant's commercial feed; and
    (b) distinguish the distributor or registrant's commercial feed from the commercial feed of others. See Utah Code 4-25-102
  • Cannabis: means the same as that term is defined in Section 26-61a-102. See Utah Code 4-41a-102
  • Cannabis cultivation facility: means a person that:
    (a) possesses cannabis;
    (b) grows or intends to grow cannabis; and
    (c) sells or intends to sell cannabis to a cannabis cultivation facility or to a cannabis processing facility. See Utah Code 4-41a-102
  • Cannabis processing facility: means a person that:
    (a) acquires or intends to acquire cannabis from a cannabis production establishment or a holder of an industrial hemp processor license under Title 4, Chapter 41, Hemp and Cannabidiol Act;
    (b) possesses cannabis with the intent to manufacture a cannabis product;
    (c) manufactures or intends to manufacture a cannabis product from unprocessed cannabis or a cannabis extract; and
    (d) sells or intends to sell a cannabis product to a medical cannabis pharmacy or the state central fill medical cannabis pharmacy. See Utah Code 4-41a-102
  • Cannabis product: means the same as that term is defined in Section 26-61a-102. See Utah Code 4-41a-102
  • Cannabis production establishment: means a cannabis cultivation facility, a cannabis processing facility, or an independent cannabis testing laboratory. See Utah Code 4-41a-102
  • Commercial feed: means all materials that are distributed for use as feed or for mixing in feed. See Utah Code 4-25-102
  • Commercial fertilizer: means any substance that contains one or more recognized plant nutrients that is used for its plant nutrient content and is designed for use or claimed to have value in promoting plant growth, exclusive of unmanipulated animal and vegetable manures, marl, lime, limestone, wood ashes, gypsum, and other products exempted by rule of the department. See Utah Code 4-25-206
  • Commissioner: means the commissioner of agriculture and food. See Utah Code 4-7-110
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporate name: means :
    (a) the name of a domestic corporation as stated in the domestic corporation's articles of incorporation;
    (b) the name of a domestic nonprofit corporation as stated in the domestic nonprofit corporation's articles of incorporation;
    (c) the name of a foreign corporation as stated in the foreign corporation's:
    (i) articles of incorporation; or
    (ii) document of similar import to articles of incorporation; or
    (d) the name of a foreign nonprofit corporation as stated in the foreign nonprofit corporation's:
    (i) articles of incorporation; or
    (ii) document of similar import to articles of incorporation. See Utah Code 16-6a-102
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • County legislative body: means :Utah Code 48-2e-1156
  • Customer-formula feed: means commercial feed that consists of a mixture of commercial feeds or feed ingredients, each batch of which is manufactured according to the specific instructions of the final purchaser. See Utah Code 4-25-102
  • Deliver: includes delivery by mail or another means of transmission authorized by Section 16-6a-103, except that delivery to the division means actual receipt by the division. See Utah Code 16-6a-102
  • Department: means the Department of Agriculture and Food created in Chapter 2, Administration. See Utah Code 4-7-110
  • Department: means the Department of Agriculture and Food. See Utah Code 4-41a-102
  • Director: means a member of the board of directors. See Utah Code 16-6a-102
  • Distribute: means to:
    (a) offer for sale, sell, exchange, or barter commercial feed; or
    (b) supply, furnish, or otherwise provide commercial feed to a contract feeder. See Utah Code 4-25-102
  • Distributor: means any person who:
    (a) imports, consigns, manufactures, produces, compounds, mixes, or blends commercial fertilizer;
    (b) imports, consigns, manufactures, produces, compounds, sizes, or blends a soil amendment; or
    (c) offers for sale, sells, barters, or otherwise supplies commercial fertilizer or a soil amendment in this state. See Utah Code 4-25-206
  • Division: means the Division of Corporations and Commercial Code. See Utah Code 16-6a-102
  • Drug: means any article intended:
    (a) for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in animals other than humans; and
    (b) to affect the structure or any function of the animal body, unless the article is feed. See Utah Code 4-25-102
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Executive director: means the executive director of the Department of Commerce. See Utah Code 16-6a-102
  • Feed ingredient: means each constituent material in a commercial feed. See Utah Code 4-25-102
  • Felony: A crime carrying a penalty of more than a year in prison.
  • Fertilizer material: means a commercial fertilizer that contains either:
    (a) quantities of no more than one of the primary plant nutrients (nitrogen, phosphoric acid and potash);
    (b) approximately 85% plant nutrients in the form of a single chemical compound; or
    (c) plant or animal residues or by-products, or a natural material deposit that is processed so that its primary plant nutrients have not been materially changed, except through purification and concentration. See Utah Code 4-25-206
  • Foreign corporation: means a corporation for profit incorporated under a law other than the laws of this state. See Utah Code 16-6a-102
  • Foreign nonprofit corporation: means an entity:
    (a) incorporated under a law other than the laws of this state; and
    (b) that would be a nonprofit corporation if formed under the laws of this state. See Utah Code 16-6a-102
  • Fraud: Intentional deception resulting in injury to another.
  • Grade: means the percentage of total nitrogen, available phosphorus or phosphoric acid, and soluble potassium or soluble potash stated in whole numbers in the same terms, order, and percentages as in the guaranteed analysis; provided, that specialty fertilizers may be guaranteed in fractional units of less than one percent of total nitrogen, available phosphorus or phosphoric acid, and soluble potassium or soluble potash and that fertilizer materials such as bone meal, manures, and similar raw materials may be guaranteed in fractional units. See Utah Code 4-25-206
  • Guaranteed analysis: means the minimum percentage by weight of plant nutrients claimed in the following order and form:
    Total nitrogen (N)
    ____ percent. See Utah Code 4-25-206
  • Independent cannabis testing laboratory: means a person that:
    (a) conducts a chemical or other analysis of cannabis or a cannabis product; or
    (b) acquires, possesses, and transports cannabis or a cannabis product with the intent to conduct a chemical or other analysis of the cannabis or cannabis product. See Utah Code 4-41a-102
  • Individual: means :
    (a) a natural person;
    (b) the estate of an incompetent individual; or
    (c) the estate of a deceased individual. See Utah Code 16-6a-102
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Inventory control system: means a system described in Section 4-41a-103. See Utah Code 4-41a-102
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Label: means any written, printed, or graphic matter upon or accompanying a commercial feed. See Utah Code 4-25-102
  • Land: includes :Utah Code 48-2e-1156
  • Livestock: means cattle, sheep, goats, swine, horses, mules, poultry, domesticated elk as defined in Section 4-39-102, or any other domestic animal or domestic furbearer raised or kept for profit. See Utah Code 4-7-110
  • Manufacture: means to grind, mix, blend, or otherwise process a commercial feed for distribution. See Utah Code 4-25-102
  • Medical cannabis: means the same as that term is defined in Section 26-61a-102. See Utah Code 4-41a-102
  • Medicinal dosage form: means the same as that term is defined in Section 26-61a-102. See Utah Code 4-41a-102
  • Member: includes :
    (i) "voting member"; and
    (ii) a shareholder in a water company. See Utah Code 16-6a-102
  • Misbranded: includes commercial feed that is distributed under the name of another commercial feed. See Utah Code 4-25-102
  • Misdemeanor: Usually a petty offense, a less serious crime than a felony, punishable by less than a year of confinement.
  • Notice: means the same as that term is defined in Section 16-6a-103. See Utah Code 16-6a-102
  • Official sample: means a sample of commercial feed taken by the department in accordance with this chapter and designated as "official. See Utah Code 4-25-102
  • Organization: means a corporation, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, two or more persons having a joint or common interest, or any other legal entity. See Utah Code 4-7-110
  • Person: means a natural person or individual, corporation, organization, or other legal entity. See Utah Code 4-7-110
  • Personal property: includes :Utah Code 48-2e-1156
  • Principal office: means :
    (a) the office, in or out of this state, designated by a domestic or foreign nonprofit corporation as its principal office in the most recent document on file with the division providing that information, including:
    (i) an annual report;
    (ii) an application for a certificate of authority; or
    (iii) a notice of change of principal office; or
    (b) if no principal office can be determined, a domestic or foreign nonprofit corporation's registered office. See Utah Code 16-6a-102
  • Proceeding: includes :
    (a) a civil suit;
    (b) arbitration;
    (c) mediation;
    (d) a criminal action;
    (e) an administrative action; or
    (f) an investigatory action. See Utah Code 16-6a-102
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 48-2e-1156
  • Product name: means the name of the commercial feed that:
    (a) identifies the kind, class, or specific use of the commercial feed; and
    (b) distinguishes the commercial feed from all other products bearing the same brand name. See Utah Code 4-25-102
  • Property: includes both real and personal property. See Utah Code 48-2e-1156
  • Quantity statement: means the net weight in mass, liquid measurement, or count. See Utah Code 4-25-102
  • Receive: when used in reference to receipt of a writing or other document by a domestic or foreign nonprofit corporation, means the writing or other document is actually received:
    (a) by the domestic or foreign nonprofit corporation at:
    (i) its registered office in this state; or
    (ii) its principal office;
    (b) by the secretary of the domestic or foreign nonprofit corporation, wherever the secretary is found; or
    (c) by another person authorized by the bylaws or the board of directors to receive the writing or other document, wherever that person is found. See Utah Code 16-6a-102
  • Registered agent: means the registered agent of:
    (a) a domestic nonprofit corporation; or
    (b) a foreign nonprofit corporation. See Utah Code 16-6a-102
  • Registered office: means the office within this state designated by a domestic or foreign nonprofit corporation as its registered office in the most recent document on file with the division providing that information, including:
    (a) articles of incorporation;
    (b) an application for a certificate of authority; or
    (c) a notice of change of registered office. See Utah Code 16-6a-102
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 48-2e-1156
  • State electronic verification system: means the system described in Section 26-61a-103. See Utah Code 4-41a-102
  • Street address: means :
    (a) 
    (i) street name and number;
    (ii) city or town; and
    (iii) United States post office zip code designation; or
    (b) if, by reason of rural location or otherwise, a street name, number, city, or town does not exist, an appropriate description other than that described in Subsection (49)(a) fixing as nearly as possible the actual physical location, but only if the information includes:
    (i) the rural free delivery route;
    (ii) the county; and
    (iii) the United States post office zip code designation. See Utah Code 16-6a-102
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Ton: means a net weight of 2,000 pounds avoirdupois. See Utah Code 4-25-102
  • Tribal nonprofit corporation: means a nonprofit corporation:
    (a) incorporated under the law of a tribe; and
    (b) that is at least 51% owned or controlled by the tribe. See Utah Code 16-6a-102
  • United States: includes each state, district, and territory of the United States of America. See Utah Code 48-2e-1156
