Terms Used In Utah Code > Title 57 > Chapter 16 - Mobile Home Park Residency Act

  • Amenities: means the following physical, recreational or social facilities located at a mobile home park:
    (a) a club house;
    (b) a park;
    (c) a playground;
    (d) a swimming pool;
    (e) a hot tub;
    (f) a tennis court; or
    (g) a basketball court. See Utah Code 57-16-3
  • Change of use: means a change of the use of a mobile home park, or any part of it, for a purpose other than the rental of mobile home spaces. See Utah Code 57-16-3
  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • City: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • County legislative body: means :Utah Code 68-3-12.5
  • Criminal risk factors: means a person's characteristics and behaviors that:
    (a) affect the person's risk of engaging in criminal behavior; and
    (b) are diminished when addressed by effective treatment, supervision, and other support resources, resulting in reduced risk of criminal behavior. See Utah Code 26B-5-101
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Director: means the director appointed under Section 26B-5-103. See Utah Code 26B-5-101
  • Division: means the Division of Integrated Healthcare created in Section 26B-1-202. See Utah Code 26B-5-101
  • Donor: The person who makes a gift.
  • Emergency: means :
    (a) a state of emergency declared by:
    (i) the president of the United States;
    (ii) the governor in accordance with 2; and
    (iii) the chief executive officer of a political subdivision in accordance with 2, for a local emergency; or
    (b) a public health emergency declared by:
    (i) the executive director through a public health order in accordance with this title; or
    (ii) a local health department for a location under the local health department's jurisdiction. See Utah Code 26B-4-801
  • Entity: means a person other than an individual. See Utah Code 26B-4-801
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Executive director: means the executive director of the department appointed under Section 26B-1-203. See Utah Code 26B-1-102
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Fees: means other charges incidental to a resident's tenancy including, but not limited to, late fees, charges for pets, charges for storage of recreational vehicles, charges for the use of park facilities, and security deposits. See Utah Code 57-16-3
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Health facility: means an entity licensed under the laws of this or another state to provide health or veterinary services. See Utah Code 26B-4-801
  • Health practitioner: means an individual licensed under Utah law or another state to provide health or veterinary services. See Utah Code 26B-4-801
  • Land: includes :Utah Code 68-3-12.5
  • Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • License: includes authorization under this title to an individual to provide health or veterinary services based upon a national or state certification issued by a public or private entity. See Utah Code 26B-4-801
  • Local mental health authority: means a county legislative body. See Utah Code 26B-5-101
  • Local substance abuse authority: means a county legislative body. See Utah Code 26B-5-101
  • Mental health crisis: means :
    (a) a mental health condition that manifests in an individual by symptoms of sufficient severity that a prudent layperson who possesses an average knowledge of mental health issues could reasonably expect the absence of immediate attention or intervention to result in:
    (i) serious danger to the individual's health or well-being; or
    (ii) a danger to the health or well-being of others; or
    (b) a mental health condition that, in the opinion of a mental health therapist or the therapist's designee, requires direct professional observation or intervention. See Utah Code 26B-5-101
  • Mental health crisis services: means an array of services provided to an individual who experiences a mental health crisis, which may include:
    (a) direct mental health services;
    (b) on-site intervention provided by a mobile crisis outreach team;
    (c) the provision of safety and care plans;
    (d) prolonged mental health services for up to 90 days after the day on which an individual experiences a mental health crisis;
    (e) referrals to other community resources;
    (f) local mental health crisis lines; and
    (g) the statewide mental health crisis line. See Utah Code 26B-5-101
  • Mental health therapist: means the same as that term is defined in Section 58-60-102. See Utah Code 26B-5-101
  • Mobile home: means a transportable structure in one or more sections with the plumbing, heating, and electrical systems contained within the unit, which when erected on a site, may be used with or without a permanent foundation as a family dwelling. See Utah Code 57-16-3
  • Mobile home park: means any tract of land on which two or more mobile home spaces are leased, or offered for lease or rent, to accommodate mobile homes for residential purposes. See Utah Code 57-16-3
  • Mobile home space: means a specific area of land within a mobile home park designed to accommodate one mobile home. See Utah Code 57-16-3
  • Month: means a calendar month, unless otherwise expressed. See Utah Code 68-3-12.5
  • Office: means the Office of Substance Use and Mental Health created in Section 26B-5-102. See Utah Code 26B-5-101
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Person: means :Utah Code 68-3-12.5
  • Personal property: includes :Utah Code 68-3-12.5
  • Personal property: All property that is not real property.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • Public funds: include federal and state money that has been transferred by a local substance abuse authority or a local mental health authority to a private provider under an annual or otherwise ongoing contract to provide comprehensive substance abuse or mental health programs or services for the local substance abuse authority or local mental health authority. See Utah Code 26B-5-101
  • Public utility: means an entity that provides electrical or gas service, including a:
    (a) public utility as defined in Title 54, Chapter 2, General Provisions; or
    (b) municipality as defined in Title 10, Utah Municipal Code. See Utah Code 57-16-3
  • Rent: means charges paid for the privilege of occupying a mobile home space, and may include service charges and fees. See Utah Code 57-16-3
  • Resident: means an individual who leases or rents space in a mobile home park. See Utah Code 57-16-3
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Scope of practice: means the extent of the authorization to provide health or veterinary services granted to a health practitioner by a license issued to the practitioner in the state in which the principal part of the practitioner's services are rendered, including any conditions imposed by the licensing authority. See Utah Code 26B-4-801
  • Service charges: means separate charges paid for the use of electrical and gas service improvements which exist at a mobile home space, or for trash removal, sewage and water, or any combination of the above. See Utah Code 57-16-3
  • Service of process: The service of writs or summonses to the appropriate party.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • State: means :
    (a) a state of the United States;
    (b) the District of Columbia;
    (c) Puerto Rico;
    (d) the United States Virgin Islands; or
    (e) any territory or insular possession subject to the jurisdiction of the United States. See Utah Code 26B-4-801
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • Statewide mental health crisis line: means the same as that term is defined in Section 26B-5-610. See Utah Code 26B-5-101
  • Summons: Another word for subpoena used by the criminal justice system.
  • Town: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
  • Volunteer health practitioner: means a health practitioner who provides health or veterinary services, whether or not the practitioner receives compensation for those services. See Utah Code 26B-4-801
