Terms Used In Vermont Statutes Title 18 Sec. 4211

  • Board of Pharmacy: means the State Board of Pharmacy so designated under 26 Vt. See
  • Department: means the Department of Health. See
  • Federal drug laws: means the laws of the United States relating to one or more of those drugs which are defined in this chapter as regulated drugs. See
  • Person: includes an individual, partnership, corporation, association, trust, or other institution or entity. See
  • Prescription: means an order for a regulated drug made by a physician, physician assistant, advanced practice registered nurse, dentist, or veterinarian licensed under this chapter to prescribe such a drug which shall be in writing except as otherwise specified in this subdivision. See
  • Registration: means the annual registration of licenses and certificates under this chapter. See
  • State: when applied to the different parts of the United States may apply to the District of Columbia and any territory and the Commonwealth of Puerto Rico. See

§ 4211. Records confidential

Prescriptions, orders, and records required by this chapter, and stocks of regulated drugs, shall be open for inspection only to federal or State officers or their specifically authorized agent whose duty it is to enforce the federal drug laws or this chapter; authorized agents of professional licensing board, as that term is defined under 3 Vt. Stat. Ann. chapter 5, or the Department of Health; or authorized agents of the Board of Medical Practice. No person having knowledge by virtue of the person’s office of any such prescription, order, or record shall divulge such knowledge, except in connection with a prosecution, or proceeding before the Department of Health, Board of Pharmacy, Board of Medical Practice, or another licensing or registration board, to which prosecution or proceeding the person to whom such prescriptions, orders, or records relate is a party.
