  • Adjacent: means those lands and waters directly abutting a site on the register, including lands and waters separated from the site by highways or bodies of water where such separated lands and waters are an integral part of the site's ecosystem. See
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Agency: means the Agency of Natural Resources. See

  • Airport manager: means the owner of an airport in this State or an agent authorized to act on behalf of an airport owner. See
  • Annual meeting: when applied to towns shall mean the annual town meeting in March or an adjournment thereof. See
  • articles: include amended and restated articles of incorporation and articles of merger. See
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Authority: means the Vermont Low-Level Radioactive Waste Authority. See
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • biennially: shall mean the year in which a regular session of the General Assembly is held. See
  • Board: means the Transportation Board. See
  • board of directors: means the board of directors except that no person or group of persons are the board of directors because of powers delegated to that person or group pursuant to section 8. See
  • Bylaws: means the code or codes of rules (other than the articles) adopted pursuant to this title for the regulation or management of the affairs of the corporation, stored or depicted in any tangible or electronic medium, and irrespective of the name or names by which such rules are designated. See
  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • Class: refers to a group of memberships which have the same rights with respect to voting, dissolution, redemption, and transfer. See
  • Closure: includes post-closure observation and maintenance. See
  • Collection: means the aggregation of electronic waste from covered entities and includes all the activities up to the time the electronic waste is delivered to a recycler. See
  • Collector: means a public or private entity that receives electronic waste from covered entities or from another collector and that performs any of the following:

  • Commission: means the Texas Low-Level Radioactive Waste Disposal Compact Commission. See
  • Commissioner: means the Commissioner of Housing and Community Development. See
  • Compact agreement: means the Texas Low-Level Radioactive Waste Disposal Compact. See
  • Computer: means a laptop computer, desktop computer, tablet computer, or central processing unit that conveys electronic, magnetic, optical, electrochemical, or other high-speed data processing device performing logical, arithmetic, or storage functions. See
  • Computer monitor: means a display device without a tuner that can display pictures and sound and is used with a computer. See
  • Computer peripheral: means a keyboard or any other device sold exclusively for external use with a computer that provides input or output into or from a computer. See
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: means public benefit and mutual benefit corporation. See
  • Corporation: includes any domestic or foreign predecessor entity of a corporation in a merger or other transaction in which the predecessor's existence ceased upon the consummation of the transaction. See
  • Covered electronic device: means a computer, computer monitor, device containing a cathode ray tube, printer, or television from a covered entity. See
  • Covered entity: means any person who presents to a collection facility that is included in an approved plan:

  • Covered entity: means any household, charity, or school district in the State or a business in the State that employs 10 or fewer individuals. See
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Delegates: means those persons elected or appointed to vote in a representative assembly for the election of a director or directors or on other matters. See
  • Department: means the Department of Housing and Community Development. See
  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Director: includes , unless the context requires otherwise, the estate or personal representative of a director. See
  • Directors: means individuals, designated in the articles or bylaws or elected by the incorporators, and their successors and individuals elected or appointed by any other name or title to act as members of the board. See
  • Distribution: means the payment of a dividend or any part of the income or profit of a corporation to its members, directors, or officers. See
  • Donor: The person who makes a gift.
  • Electronic waste: means a computer, computer monitor, computer peripheral, device containing a cathode ray tube, printer, or television from a covered entity. See
  • Elemental mercury: means the chemical symbol Hg. See
  • Employee: includes an officer but not a director. See
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Entity: includes corporation and foreign corporation; business corporation and foreign business corporation; profit and nonprofit unincorporated association; business trust, estate, partnership, trust, and two or more persons having a joint or common economic interest; and state, United States; and foreign government. See
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Expected low-level radioactive waste: means the low-level radioactive waste from the normal operation of the Vermont Yankee facility, during its licensed operating life, including decommissioning waste, and from the normal operations of the currently licensed low-level radioactive waste generators in Vermont through the expected date for completing the decommissioning of Vermont Yankee, plus a small emergency contingency reserve. See
  • Fabricated mercury-added product: means a product that consists of a combination of individual components that combine to make a single unit, including mercury-added measuring devices, lamps, and switches. See
  • filing: means filed in the Office of the Secretary of State. See
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Formulated mercury-added product: means a product that is sold as a consistent mixture of chemicals to which mercury or a mercury compound has been intentionally added in order to provide a specific characteristic, appearance, or quality, or to perform a specific function, or for any other reason. See
  • Four-foot linear fluorescent lamp: means a general purpose, low-pressure, mercury-containing, electric-discharge light source in which a fluorescing coating transforms some of the ultraviolet energy generated by the mercury discharge into visible light, and includes all of the following characteristics:

  • Fragile area: means an area of land or water that has unusual or significant flora, fauna, geological, or similar features of scientific, ecological, or educational interest. See
  • Generator: means a person who produces or processes low-level radioactive waste in the course of its activities. See
  • Good faith: means honesty in fact and the observance of reasonable standards and fair dealing, such that each party shall respond promptly and fairly to offers from the other party. See
  • Grantor: The person who establishes a trust and places property into it.
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • inhabitants: shall mean the population of the political division referred to, as ascertained by the national census last completed before the time when such population is a material fact. See
  • Lamp: means an electric lamp, including mercury-containing lamps, incandescent lamps, halogen lamps, and light-emitting diode lamps. See
  • Large appliance: includes the following items: refrigerators, washing machines, clothes dryers, ranges, water heaters, dishwashers, freezers, microwave ovens, air conditioners, portable heaters, and other similar domestic and commercial appliances as may be identified by the Agency by rule. See
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Leaseholder: means a resident lawfully occupying a mobile home owned by the park owner or the owner of a mobile home sited on a mobile home lot in a mobile home park regardless of whether the leaseholder has actual possession of a written lease. See
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Liability: means the obligation to pay a judgment, settlement, penalty, fine (including an excise tax assessed with respect to an employee benefit plan), or reasonable expenses actually incurred with respect to a proceeding. See
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Lot rent: means a charge assessed on a mobile home park resident for the occupancy of a mobile home lot, but does not include charges permitted under section 6238 of this title. See
  • Low-level radioactive waste: means radioactive material that is not high-level radioactive waste, spent nuclear fuel, transuranic waste, or byproduct material, as defined in 42 U. See
  • Low-level radioactive waste: means radioactive waste material that is not high-level radioactive waste, spent nuclear fuel, transuranic waste, or byproduct material, as defined in 42 U. See

  • Market share: means a "manufacturer's market share" that shall be the manufacturer's percentage share of the total weight of covered electronic devices sold in the State as determined by an estimate of the aggregate total weight of the manufacturer's covered electronic devices sold in the State during the previous program year based on national sales data unless the Secretary approves a manufacturer to use actual sales data.   • Meeting: means any structured communications conducted by participants in person or through the use of an electronic or telecommunications medium permitting simultaneous or sequentially structured communications. See
  • Member: means (without regard to what a person is called in the articles or bylaws) any person or persons who on more than one occasion, pursuant to a provision of a corporation's articles or bylaws, have the right to vote for the election of a director or directors. See
  • Membership: refers to the rights and obligations a member or members have pursuant to a corporation's articles, bylaws, and this title. See
  • Mercury fever thermometer: means a mercury-added product that is used for measuring body temperature. See
  • Mercury-added component: means a mercury-added product that is incorporated into another product to form a fabricated mercury-added product, including electrical switches, relays, and lamps. See
  • Mercury-added novelty: means a mercury-added product intended mainly for personal or household enjoyment or adornment. See
  • Mercury-added product: means a product, a commodity, a chemical, a product with one or more components, or a product that cannot function without the use of that component, that contains mercury or a mercury compound intentionally added to the product, commodity, chemical, or component in order to provide a specific characteristic, appearance, or quality, or to perform a specific function, or for any other reason.   • Mercury-containing lamp: means a general purpose lamp to which mercury is intentionally added during the manufacturing process. See
  • Mercury-containing thermostat: includes thermostats used to sense and control room temperature in residential, commercial, industrial, and other buildings but does not include a thermostat used to sense and control temperature as part of a manufacturing process. See
  • Mobile home: means :

  • Mobile home park: means any parcel of land under single or common ownership or control that contains, or is designed, laid out, or adapted to accommodate, more than two mobile homes. See
  • Motor vehicle: means a vehicle propelled by an internal combustion engine or an electric motor, such as an automobile, van, truck, motorized construction equipment, motorized recreational vehicle, motorcycle, or forklift. See
  • Motor vehicle recycler: means an individual or entity engaged in the business of acquiring, dismantling, parts recycling, or destroying six or more end-of-life motor vehicles in a year. See
  • Municipality: means a county, city, village, town, or any other political subdivision of this State, and any public corporation, authority, or district of this State which is or may be authorized by law to acquire, establish, construct, maintain, improve, or operate transportation facilities or services. See
  • Municipality: shall include a city, town, town school district, incorporated school or fire district or incorporated village, and all other governmental incorporated units. See
  • Mutual benefit corporation: means a domestic corporation which is required to be a mutual benefit corporation pursuant to section 17. See
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • NRC: means the Nuclear Regulatory Commission or any successor agency. See
  • Official capacity: means :

  • park owner: means the owners, operators, officers, or managing agents of a mobile home park as well as any person acting through any corporate or other device who has the practical authority to establish rules, policies, or other requirements for the operation of the mobile home park. See
  • Party: includes an individual who was, is, or is threatened to be made a named defendant or respondent in a proceeding. See
  • Person: means an individual, corporation, partnership, firm, association, trust, estate, public or private institution, group, or other legal entity, or any legal successor to or representative, or agent. See
  • Person: includes any individual or entity. See
  • Person: means an individual, firm, partnership, corporation, company, association, joint stock association, or body politic, including a trustee, receiver, assignee, or other similar representative. See

  • Principal office: means the office (in or outside this State) so designated in the biennial report filed pursuant to section 16. See
  • Printer: means desktop printers, multifunction printer copiers, and printer fax combinations taken out of service that are designed to reside on a work surface and include various print technologies, including without limitation laser and LED (electrographic), ink jet, dot matrix, thermal, and digital sublimation, and "multi-function" or "all-in-one" devices that perform different tasks, including copying, scanning, faxing, and printing.   • Proceeding: includes civil suit and criminal, administrative, and investigatory action. See
  • Proceeding: means any threatened, pending, or completed action, suit, or proceeding, whether civil, criminal, administrative, or investigative and whether formal or informal. See
  • Program year: means the period from July 1 through June 30. See

  • Recycler: means a person who accepts electronic waste from covered entities and collectors for the purpose of recycling. See
  • Recycling: means the process of collecting and preparing electronic wastes for use in manufacturing processes or for recovery of useable materials followed by delivery of such materials for use. See
  • Register: means the fragile areas register that lists those fragile areas designated by the Secretary. See
  • Register of fragile areas: means the listing of fragile areas that are being managed by the owner of the fragile area according to guidelines adopted by the Secretary. See
  • Registry: means the act of voluntary agreement between the owner of a fragile area and the Secretary for designation of the fragile area and its placement on the register of fragile areas. See
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • resident: means an individual, individuals, or family who occupies a mobile home on a permanent or temporary basis in a mobile home park as that term is defined in subdivision (2) of this section. See
  • Restricted landing area: means an area of land or water, or both, that is used or is made available for the landing and take-off of aircraft, the use of which, except in case of emergency, shall be only as provided from time to time by the Board. See
  • Retailer: means a person who sells a mercury-containing lamp to a person in the State through any means, including a sales outlet, a catalogue, the telephone, the Internet, or any electronic means. See

  • Special legal counsel: means counsel that has never been an employee of the corporation and who has not, and whose firm has not, performed legal services for the corporation pertaining to the matter for which indemnification is sought for a period of at least two years before retention as special counsel.   • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • Stewardship organization: means an organization, association, or entity that has developed a system, method, or other mechanism which assumes the responsibilities, obligations, and liabilities under this chapter of multiple manufacturers of mercury-containing lamps. See
  • Storage operator: means a person who stores an aircraft or aircraft component at the request of an airport manager. See
  • Television: means any telecommunications system or device containing a cathode ray tube or other type of display system with a viewable area of greater than four inches when measured diagonally that can broadcast or receive moving pictures and sound over a distance and includes a television tuner or a display device peripheral to a computer that contains a television tuner. See
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Thermostat retailer: means a person who sells thermostats of any kind directly to homeowners or other nonprofessionals through any selling or distribution mechanism, including sales using the Internet or catalogues. See
  • Thermostat wholesaler: means a person that is engaged in the distribution and wholesale sale of heating, ventilation, and air-conditioning components to contractors who install heating, ventilation, and air-conditioning components. See
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Transporter: means a person that moves electronic waste from a collector to either another collector or to a recycler. See
  • Vote: includes authorization by written ballot and written consent. See
  • Voting power: means the total number of votes entitled to be cast for the election of directors at the time the determination of voting power is made, excluding a vote which is contingent upon the happening of a condition or event that has not occurred at the time. See
  • Yankee site: means a site for a low-level radioactive waste disposal facility on land presently owned by and contiguous to the Vermont Yankee nuclear generating facility. See
