  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Architect: means a person who is licensed to practice architecture under this chapter. See
  • Athlete: means any individual participating in fitness training and conditioning, sports, or other athletic competition, practices, or events requiring physical strength, agility, flexibility, range of motion, speed, or stamina. See
  • Athletic training: means the application of principles and methods of conditioning, the prevention, immediate care, recognition, evaluation, assessment, and treatment of athletic and orthopedic injuries within the scope of education and training, the organization and administration of an athletic training program, and the education and counseling of athletes, coaches, family members, medical personnel, communities, and groups in the area of care and prevention of athletic and orthopedic injuries.   • Board: means the "Vermont Board of Architecture. See
  • Candidate: means an individual who has taken any affirmative action to become a candidate for public office. See
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Conditioning: means programs designed to enhance the following physiological areas: flexibility, muscle strength, muscle endurance, neuromuscular coordination, and cardio-respiratory endurance that will assist in improved athletic performance specific to the sport in which the athlete participates.   • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Director: means the Director of the Office of Professional Regulation. See

  • Disciplinary action: includes issuance of warnings and all sanctions including denial, suspension, revocation, limitation, or restriction of licenses, and other similar limitations. See
  • Election: means the procedure whereby the voters of this State, or any of its political subdivisions, select persons to fill public offices or act on public questions. See
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fees: shall mean earnings due for official services, aside from salaries or per diem compensation. See
  • following: when used by way of reference to a section of the law shall mean the next preceding or following section. See
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Licensed athletic trainer: means a person licensed in accordance with the provisions of this chapter. See
  • Oath: shall include affirmation where by law an affirmation may be substituted. See
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means any individual, business entity, labor organization, public interest group, or other organization, incorporated or unincorporated. See
  • Person: shall include any natural person, corporation, municipality, the State of Vermont or any department, agency, or subdivision of the State, and any partnership, unincorporated association, or other legal entity. See
  • Physically active individual: means an individual who is well conditioned, healthy, and free from underlying pathology, who participates in athletic or recreational activities that require physical skills and utilize strength, power, endurance, speed, flexibility, range of motion, or agility. See
  • Quorum: The number of legislators that must be present to do business.
  • Referral: means sending a determination, recorded in writing, by an allopathic or osteopathic physician, podiatrist, advanced practice registered nurse, physician assistant, physical therapist, naturopath, dentist, or chiropractor, that an athlete or physically active individual should be treated by an athletic trainer, and that such person is free of an underlying pathology that would affect treatment. See
  • Responsible control: means that amount of control over and detailed knowledge of the content of technical submissions during their preparation as is ordinarily exercised by licensed architects applying the required professional standard of care. See
  • seal: shall include an impression of the official seal made upon paper alone or by means of a wafer or wax affixed thereto. See
  • Secretary: means the Secretary of State. See
  • Service of process: The service of writs or summonses to the appropriate party.
  • State: when applied to the different parts of the United States may apply to the District of Columbia and any territory and the Commonwealth of Puerto Rico. See
  • Supervision: means work prepared under the regular, personal review of a licensed architect's control and as to which the architect has detailed professional knowledge. See
  • Technical submissions: means designs, drawings, specifications, studies, and other technical reports prepared in the course of executing a portion of a construction project. See
  • Town: includes "city. See
  • Town clerk: means a town officer elected pursuant to section 2646 of this title or otherwise elected or appointed by law and performing those duties prescribed by 24 V. See
  • Underlying pathology: means any disease process, including neuromuscular disease, diabetes, spinal cord injuries, and systemic diseases. See
  • Vote tabulator: means a machine that registers and counts paper ballots and includes optical scan tabulators. See
