  • Board: means the board of education of any school district or the board of trustees of any community college. See Kansas Statutes 74-32,253
  • Board of regents: means the state board of regents provided for in the constitution of this state and described in article 32 of chapter 74 of Kansas Statutes Annotated. See Kansas Statutes 74-3278
  • Executive officer: means the chief executive officer of the state board of regents appointed under Kan. See Kansas Statutes 74-3292
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Kansas Statutes 77-201
  • State board: means the state board of regents. See Kansas Statutes 74-3275

(a) On and after July 1, 1999, the state board of regents established by Kan. Stat. Ann. § 74-3202a, and amendments thereto, shall have the legal custody of all records, memoranda, writings, entries, prints, representations or combinations thereof of any act, transaction, occurrence or event of the abolished state board of regents and the executive officer thereof.

(b) No suit, action or other proceeding, judicial or administrative, lawfully commenced, or which could have been commenced, by or against the abolished state board of regents or the executive officer thereof in the official capacity of such board or officer or in relation to the discharge of official duties of such board or officer, shall abate by reason of the governmental reorganization effected under the provisions of this act. The court may allow any such suit, action or other proceeding to be maintained by or against the state board of regents established by Kan. Stat. Ann. § 74-3202a, and amendments thereto.

(c) No criminal action commenced or which could have been commenced by the state shall abate by reason of the governmental reorganization effected under the provisions of this act.
