Terms Used In Missouri Laws 508.012

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • State: when applied to any of the United States, includes the District of Columbia and the territories, and the words "United States" includes such district and territories. See Missouri Laws 1.020
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Venue: The geographical location in which a case is tried.

At any time prior to the commencement of a trial, if a plaintiff or defendant, including a third-party plaintiff or defendant, is either added to, removed, or severed from a petition filed in any court in the state of Missouri which would have, if originally added to, removed, or severed from the initial petition, altered the determination of venue under section 508.010, then the judge shall upon application of any party transfer the case to a proper forum.
