1.    An impasse exists if:

  • Contract: A legal written agreement that becomes binding when signed.

  • Organization: includes a foreign or domestic association, business trust, corporation, enterprise, estate, joint venture, limited liability company, limited liability partnership, limited partnership, partnership, trust, or any legal or commercial entity. See North Dakota Code 1-01-49
  • written: include "typewriting" and "typewritten" and "printing" and "printed" except in the case of signatures and when the words are used by way of contrast to typewriting and printing. See North Dakota Code 1-01-37

a.    After a reasonable period of negotiation, an agreement has not been formulated and a dispute exists; b.    No later than July first following the recognition of the representative organization under section 15.1-16-11:

(1) An agreement has not been reached between the board of a school district and the representative organization; and

    (2) The board of the school district and the representative organization have not agreed to extend the negotiation period; or

c.    The board of a school district and the representative organization both agree that an impasse exists.

2.    An impasse may exist if:

a.    A written contract entered into between the board of a school district and the representative organization under section 15.1-16-13 does not contain a procedure for resolving a dispute.

b.    A written agreement entered into between the board of a school district and the representative organization under section 15.1-16-13 contains an inadequate procedure for resolving a dispute.
