Terms Used In Rhode Island General Laws > Chapter 11-9 - Children

  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Court: means any appropriate district court of the state of Rhode Island. See Rhode Island General Laws 11-9-13.4
  • Dealer: is synonymous with the term "retail tobacco products dealer. See Rhode Island General Laws 11-9-13.4
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Department of taxation: means the state of Rhode Island taxation division, its employees, agents, or assigns. See Rhode Island General Laws 11-9-13.4
  • e-liquid products: means any liquid or substance placed in or sold for use in an electronic nicotine-delivery system that generally utilizes a heating element that aerosolizes, vaporizes, or combusts a liquid or other substance containing nicotine or nicotine derivative:

    (i)  Whether the liquid or substance contains nicotine or a nicotine derivative; or

    (ii)  Whether sold separately or sold in combination with a personal vaporizer, electronic nicotine-delivery system, or an electronic inhaler. See Rhode Island General Laws 11-9-13.4

  • Electronic nicotine-delivery system: means an electronic device that may be used to simulate smoking in the delivery of nicotine or other substance to a person inhaling from the device, and includes, but is not limited to, an electronic cigarette, electronic cigar, electronic cigarillo, electronic little cigars, electronic pipe, or electronic hookah, "heat not burn products" e-liquids, e-liquid products, or any related device and any cartridge or other component of such device. See Rhode Island General Laws 11-9-13.4
  • Electronic nicotine-delivery system product: means any combination of electronic nicotine-delivery system and/or e-liquid and/or any derivative thereof, and/or any e-liquid container. See Rhode Island General Laws 11-9-13.4
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fiduciary: A trustee, executor, or administrator.
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • License: is synonymous with the term "retail tobacco products dealer license" or "electronic nicotine-delivery system license" or any license issued under chapter 20 of Title 44 or chapter 1 of Title 23. See Rhode Island General Laws 11-9-13.4
  • License holder: is synonymous with the term "retail tobacco products dealer" or "electronic nicotine-delivery system license" or any licenses issued under chapter 20 of Title 44 or chapter 1 of Title 23. See Rhode Island General Laws 11-9-13.4
  • Little cigars: means and includes any roll, made wholly or in part of tobacco, irrespective of size or shape, and irrespective of whether the tobacco is flavored, adulterated, or mixed with any other ingredient, where such roll has a wrapper or cover made of tobacco wrapped in leaf tobacco or any substance containing tobacco paper or any other material and where such roll has an integrated filter, except where such wrapper is wholly or in greater part made of tobacco and where such roll has an integrated filter and weighs over four (4) pounds per thousand (1,000).   • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means any individual person, firm, fiduciary, partnership, trust, association, or corporation licensed as a retail dealer to sell tobacco products within the state. See Rhode Island General Laws 11-9-13.4
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Statute: A law passed by a legislature.
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • town: may be construed to include city; the words "town council" include city council; the words "town clerk" include city clerk; the words "ward clerk" include clerk of election district; the words "town treasurer" include city treasurer; and the words "town sergeant" include city sergeant.   • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • underage individuals: means any individual under the age of twenty-one (21). See Rhode Island General Laws 11-9-13.4
  • United States: include the several states and the territories of the United States. See Rhode Island General Laws 43-3-8
