Terms Used In Texas Code of Criminal Procedure 55A.204

  • Justice: when applied to a magistrate, means justice of the peace. See Texas Government Code 312.011
  • Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
  • Signature: includes the mark of a person unable to write, and "subscribe" includes the making of such a mark. See Texas Government Code 312.011

The attorney representing the state shall prepare an expunction order under Article 55A.202 or 55A.203 for the court’s signature and notify the Texas Department of Criminal Justice if the person who is the subject of the order is in the custody of the department.
