78B-7-703. Violation.
(1) |
A violation of an ex parte civil stalking injunction or of a civil stalking injunction issued under this part constitutes the criminal offense of stalking under Section 76-5-106.5 and is also a violation of the civil stalking injunction. |

Terms Used In Utah Code 78B-7-703
- Civil stalking injunction: means a stalking injunction issued under 7. See Utah Code 78B-7-102
- Ex parte civil stalking injunction: means a stalking injunction issued without notice to the respondent under 7. See Utah Code 78B-7-102
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Stalking: means the same as that term is defined in Section 76-5-106. See Utah Code 78B-7-102

A violation of an ex parte civil stalking injunction or of a civil stalking injunction issued under this part may be enforced by a civil action initiated by the petitioner, a criminal action initiated by a prosecuting attorney, or both. |
