Terms Used In West Virginia Code > Chapter 18B > Article 20 - Free Expression On Campus

  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Campus community: includes students, administrators, faculty, and staff at the institution of higher education, and their invited guests. See West Virginia Code 18B-20-1
  • commission: means the commission created by §. See West Virginia Code 18B-1-2
  • Council: means the West Virginia Council for Community and Technical College Education created by §. See West Virginia Code 18B-1-2
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Harassment: means an expression that is unwelcome, so severe, pervasive, and subjectively and objectively offensive that a student is effectively denied equal access to educational opportunities or benefits provided by the state institution of higher education or sexual harassment as defined by federal law and federal regulations applicable to state institutions of higher education. See West Virginia Code 18B-20-1
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Outdoor areas of campus: means the generally accessible outside areas of campus where members of the campus community are commonly allowed, such as grassy areas, walkways, or other similar common areas and does not include outdoor areas where access is restricted from a majority of the campus community. See West Virginia Code 18B-20-1
  • Oversight: Committee review of the activities of a Federal agency or program.
  • State: when applied to a part of the United States and not restricted by the context, includes the District of Columbia and the several territories, and the words "United States" also include the said district and territories. See West Virginia Code 2-2-10
  • State institution of higher education: means any university, college, or community and technical college under the jurisdiction of a governing board as defined in §. See West Virginia Code 18B-20-1
  • Student: means any person who is enrolled on a full-time or part-time basis in a state institution of higher education. See West Virginia Code 18B-20-1
  • Student organization: means an officially recognized group at a state institution of higher education, or a group seeking official recognition, comprised of admitted students that receive, or are seeking to receive, benefits through the institution of higher education as defined in this section. See West Virginia Code 18B-20-1
