Terms Used In West Virginia Code > Chapter 18B > Article 9A - Classification and Compensation System

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • approval: when used in reference to action by the commission or the council, means action in which the governance rationale of a governing board under its jurisdiction is given due consideration, and the action of the commission is to additionally establish whether the proposed institutional action is consistent with law and established policy and is an appropriate advancement of the public interest. See West Virginia Code 18B-1-2
  • boards: means the institutional boards of governors created by §. See West Virginia Code 18B-1-2
  • Chancellor: means the Chancellor for Higher Education where the context refers to a function of the Higher Education Policy Commission. See West Virginia Code 18B-1-2
  • Classification system: means the process by which jobs, job titles, career ladders and assignment to pay grades are determined. See West Virginia Code 18B-9A-2
  • commission: means the commission created by §. See West Virginia Code 18B-1-2
  • Council: means the West Virginia Council for Community and Technical College Education created by §. See West Virginia Code 18B-1-2
  • employee: means a regular full-time or regular part-time employee of an organization who: (i) does not meet the duties test for exempt status under the provisions of the Fair Labor Standards Act. See West Virginia Code 18B-9A-2
  • in writing: includes any representation of words, letters, or figures, whether by printing, engraving, writing, or otherwise. See West Virginia Code 2-2-10
  • Job: means the total collection of tasks, duties and responsibilities assigned to one or more individuals whose work is of the same nature and level. See West Virginia Code 18B-9A-2
  • Job evaluation: means a systematic way of determining the value/worth of a job in relation to other jobs in an organization by analyzing weighted compensable factors resulting in the assignment of a job title and pay grade to a position described by a position information questionnaire. See West Virginia Code 18B-9A-2
  • Job family: means a group of jobs having the same nature of work, but requiring different levels of skill, effort, responsibility or working conditions. See West Virginia Code 18B-9A-2
  • Job specification: means the generic description of a group of jobs assigned a common job title in the classification system. See West Virginia Code 18B-9A-2
  • Job title: means the descriptive name for the total collection of tasks, duties and responsibilities assigned to one or more individuals whose positions have the same nature of work performed at the same level. See West Virginia Code 18B-9A-2
  • Job worth hierarchy: means the perceived internal value of jobs in relation to each other within an organization. See West Virginia Code 18B-9A-2
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Midpoint differential: means the difference in wage rates paid in the midpoints of two adjacent pay grades. See West Virginia Code 18B-9A-2
  • Nonclassified employee: means , an employee of an organization who meets one or more of the following criteria:

    (A) Holds a direct policy-making position at the department or organization level. See West Virginia Code 18B-9A-2

  • Organization: means the commission, the council, an agency or entity under the respective jurisdiction of the commission or the council or a state institution of higher education as defined in section two, article one of this chapter. See West Virginia Code 18B-9A-2
  • Pay grade: means the level to which a job is assigned within a job worth hierarchy as a result of job evaluation. See West Virginia Code 18B-9A-2
  • PIQ: means a tool used to gather specific job information for a specific position held by an individual, and used for the purposes of evaluating the position for determination of job title and pay grade. See West Virginia Code 18B-9A-2
  • Point factor methodology: means a quantitative job evaluation process in which elements of a job are given a factor value and each factor is weighted according to its importance. See West Virginia Code 18B-9A-2
  • position description: means a summary of the most important features of a job, including the general nature and level of the work performed. See West Virginia Code 18B-9A-2
  • Quorum: The number of legislators that must be present to do business.
  • rules: means a regulation, standard, policy, or interpretation of general application and future effect. See West Virginia Code 18B-1-2
  • State: when applied to a part of the United States and not restricted by the context, includes the District of Columbia and the several territories, and the words "United States" also include the said district and territories. See West Virginia Code 2-2-10
  • State institution of higher education: means any university, college, or community and technical college under the jurisdiction of a governing board as that term is defined in this section. See West Virginia Code 18B-1-2
  • Statute: A law passed by a legislature.
