Terms Used In Texas Occupations Code 2102.004
- Contract: A legal written agreement that becomes binding when signed.
- in writing: includes any representation of words, letters, or figures, whether by writing, printing, or other means. See Texas Government Code 312.011
- Signed: includes any symbol executed or adopted by a person with present intention to authenticate a writing. See Texas Government Code 311.005
A contract between a performing rights society and a proprietor for the payment of royalties executed in this state must:
(1) be in writing;
(2) be signed by the parties; and
(3) include the following information:
(A) the proprietor’s name and business address;
(B) the name and location of each place of business to which the contract applies;
(C) the name and address of the performing rights society;
(D) the duration of the contract; and
(E) the rates and terms of royalties to be collected under the contract, including any sliding scale or schedule for any increase or decrease of those rates for the duration of the contract.
