  • Act: means the National Housing Act, as amended. See 24 CFR 203.251

  • Applicant: means an operator who has applied for a Certificate or for the renewal of a Certificate under this subpart. See 33 CFR 138.20
  • Applicant: Any person who has applied for service under the regulations. See 7 CFR 54.1
  • Application: means an Application for Vessel Certificate of Financial Responsibility (Water Pollution) (Form CG-5585), which can be obtained from the U. See 33 CFR 138.20
  • Approved program: A program determined as necessary or appropriate for priorities and allocations support to promote the national defense by the Secretary of Defense, the Secretary of Energy, or the Secretary of Homeland Security, under the authority of the Defense Production Act and Executive Order 13603, or the Selective Service Act and Executive Order 12742.   • Beginning of amortization: means the date one month prior to the date of the first monthly payment to principal and interest. See 24 CFR 203.251
  • Branch: The Meat Grading Branch of the Division. See 7 CFR 54.1
  • Carcass: The commercially prepared or dressed body of any animal intended for human food. See 7 CFR 54.1
  • Carcass Data Service: The service established and conducted under the regulations to provide producers and other interested persons with data on carcass characteristics. See 7 CFR 54.1
  • Cargo: means goods or materials on board a vessel for purposes of transportation, whether proprietary or nonproprietary. See 33 CFR 138.20
  • CERCLA: means title I of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended (42 U. See 33 CFR 138.20
  • Certificant: means an operator who has a current Certificate issued by the U. See 33 CFR 138.20
  • Certificate: means a Vessel Certificate of Financial Responsibility (Water Pollution) (Form CG-5585) issued by the NPFC under this subpart, as provided in §138. See 33 CFR 138.20
  • Certificate: A document issued or authorized to be issued under this subpart by an inspector to allow the interstate movement of regulated articles to any destination. See 24 CFR 203.22

  • Commissioner: means the Federal Housing Commissioner or his authorized representative. See 24 CFR 203.251

  • Compliance: Conformity of a product to the specifications under which the product was purchased or sold, with particular reference to the quality, cleanliness, state of refrigeration, method of processing, and trim of products. See 7 CFR 54.1
  • Compliance agreement: A written agreement between a person engaged in growing, handling, or moving regulated articles, and the Plant Protection and Quarantine Programs, wherein the former agrees to comply with the requirements of this subpart identified in the agreement by the inspector who executes the agreement on behalf of the Plant Protection and Quarantine Programs as applicable to the operations of such person.   • Compliance agreement: A written agreement between a person engaged in growing, handling, or moving regulated articles, and the Plant Protection and Quarantine Programs, wherein the former agrees to comply with the requirements of this subpart identified in the agreement by the inspector who executes the agreement on behalf of the Plant Protection and Quarantine Programs as applicable to the operations of such person.   • Compliance agreement: A written agreement between Plant Protection and Quarantine and a person engaged in the business of growing, handling, or moving regulated articles, in which the person agrees to comply with the provisions of this subpart and any conditions imposed pursuant to such provisions.   • Compliance agreement: A written agreement between Plant Protection and Quarantine and a person engaged in the business of growing, handling, or moving regulated articles, wherein the person agrees to comply with the provisions of this subpart and any conditions imposed pursuant thereto.   • Contract of Insurance: means the agreement evidenced by the issuance of a Mortgage Insurance Certificate or by the endorsement of the Commissioner upon the credit instrument given in connection with an insured mortgage, incorporating by reference the regulations in this subpart and the applicable provisions of the Act.   • contract of insurance: means the agreement evidenced by such endorsement and includes the terms, conditions and provisions of this part and of the National Housing Act. See 24 CFR 207.251
  • cooperative: means any association, incorporated or otherwise, which is in good faith owned or controlled by producers, or organizations thereof, of milk or its products, and which is bona fide engaged in the collective processing or preparing for market or handling or marketing, in the current of interstate or foreign commerce, of milk or its products. See 27 CFR 28.21
  • Critical infrastructure: Any systems and assets, whether physical or cyber-based, so vital to the United States that the degradation or destruction of such systems and assets would have a debilitating impact on national security, including, but not limited to, national economic security and national public health or safety. See 15 CFR 700.8
  • Cuban territorial waters: means the territorial sea and internal waters of Cuba determined in accordance with international law. See 33 CFR 107.200
  • Current period: means the year in which the Annual CPI-U was most recently published by the U. See 33 CFR 138.220
  • days: means calendar days. See 33 CFR 138.20
  • Debentures: means registered, transferable securities in certificated or book entry form which are valid and binding obligations, issued in the name of the Mutual Mortgage Insurance Fund in accordance with the provisions of this part. See 24 CFR 203.251

  • Emergency preparedness: All activities and measures designed or undertaken to prepare for or minimize the effects of a hazard upon the civilian population, to deal with the immediate emergency conditions which would be created by the hazard, and to effectuate emergency repairs to, or the emergency restoration of, vital utilities and facilities destroyed or damaged by the hazard.   • Employee: includes a person who has applied for retirement under FERS but had not been separated from the service prior to his or her death, even if the person's retirement would have been retroactively effective upon separation. See 15 CFR 295.8
  • European larch canker: The plant disease known as European larch canker, Lachnellula willkommi (Dasycypha), in any stage of development. See 24 CFR 203.43c

  • Fuel: means any oil or hazardous substance used or capable of being used to produce heat or power by burning, including power to operate equipment. See 33 CFR 138.20
  • Generally infested area: Any part of a regulated area not designated as a suppressive area in accordance with §301. See 24 CFR 203.22
  • Golden nematode: The nematode known as the golden nematode (Globodera rostochiensis), in any stage of development. See 24 CFR 203.22
  • Grade: (1) As a noun, this term means an important commercial subdivision of a product based on certain definite and preference determining factors, such as, but not limited to, conformation, finish, and quality in meats. See 7 CFR 54.1
  • Guarantor: means any person, other than a responsible party, who provides evidence of financial responsibility under the Acts on behalf of a vessel's responsible parties. See 33 CFR 138.20
  • Gummosis disease: A dangerous plant disease of sugarcane which is caused by the highly infectious bacterium, Xanthomonas vasculorum (Cobb) Dowson, and which is not widely prevalent or distributed within and throughout the United States. See 24 CFR 203.35
  • handler: means any person who, by the terms of a marketing order, is subject thereto, or to whom a marketing order is sought to be made applicable. See 27 CFR 27.43

  • Industrial resources: All materials, services, and facilities, including construction materials, the authority for which has not been delegated to other agencies under Executive Order 13603. See 15 CFR 700.8
  • Infestation: The presence of witchweed or the existence of circumstances that make it reasonable to believe that witchweed is present. See 24 CFR 200.193

  • mortgage: means such a first lien upon real estate and other property as is commonly given to secure advances on, or the unpaid purchase price of, real estate under the laws of the State, district or territory in which the real estate is located, together with the credit instrument or instruments, if any, secured thereby.   • Mortgagee: means the original lender under a mortgage and its successors and such of its assigns as are approved by the Commissioner. See 24 CFR 203.251

  • Open-end advance: means an insured advance made by an approved mortgagee in connection with a previously insured mortgage, pursuant to an open-end provision in the mortgage. See 24 CFR 203.251

  • Rated order: A prime contract, a subcontract, or a purchase order in support of an approved program issued in accordance with the provisions of this part. See 15 CFR 700.8
  • Regulated area: Any quarantined State, or any portion thereof, designated as a regulated area in §301. See 24 CFR 200.193

  • Restricted destination permit: A document issued or authorized to be issued by an inspector to allow the interstate movement of regulated articles not certifiable under all applicable Federal domestic plant quarantines to a specified destination for other than scientific purposes.
