  • Abbreviated standard survey: means a survey other than a standard survey that gathers information primarily through resident-centered techniques on facility compliance with the requirements for participation. See 42 CFR 488.301
  • Abbreviated standard survey: means a focused survey other than a standard survey that gathers information on an HHA's compliance with fewer specific standards or conditions of participation. See 42 CFR 488.705
  • Abuse: Abuse is the willful infliction of injury, unreasonable confinement, intimidation, or punishment with resulting physical harm, pain or mental anguish. See 42 CFR 483.5
  • Academic year: means the traditional approximately 9 month September to June annual session, except for students who attend summer session in addition to the traditional academic year during a 12 month period, for whom the academic year will be considered to be of approximately 12 months duration.   • Access: means making a record available to a subject individual. See 32 CFR 1701.2
  • Account: means a TreasuryDirect31 CFR 363.6
  • Accountant: means any individual who is duly qualified to practice as a certified public accountant or a public accountant in any state, possession, territory, commonwealth, or the District of Columbia. See 31 CFR 375.11
  • Accounting firm: means a corporation, proprietorship, partnership, or other business firm providing audit services. See 32 CFR 21.215
  • Act: means the National Housing Act, as amended. See 24 CFR 203.251

  • Active treatment plan: means an individualized client plan that focuses on the provision of care and treatment services that address the client's physical, psychological, psychosocial, emotional, and therapeutic needs and goals as identified in the comprehensive assessment. See 42 CFR 485.902
  • Activity: means a discrete undertaking within a project to be carried out by a recipient, directly or through a subrecipient, that is specified in an agreement and is intended to fulfill a specific objective of the agreement. See 31 CFR 380.1
  • Actual cost: means the negotiated price for a covered Part D drug when the drug is purchased at a network pharmacy, and the usual and customary price when a beneficiary purchases the drug at an out-of-network pharmacy consistent with §423. See 42 CFR 423.100
  • Actual costs: means the subset of prescription drug costs (not including administrative costs or return on investment, but including costs directly related to the dispensing of covered Part D drugs during the year) that are attributable to standard benefits only and that are incurred and actually paid by the sponsor or organization under the plan. See 42 CFR 423.855
  • Acute care hospital: means a health care facility--

    (1) Where the average length of patient stay is 25 days or fewer. See 42 CFR 495.302

  • Administrative Governor: means the Board member serving as the Administrative Governor and includes persons designated by the Administrative Governor to exercise the authority granted under this part in the governor's absence. See 42 CFR 456.122
  • Administrative offset: An action whereby money payable by the United States Government to, or held by the Government for, a recipient is withheld to satisfy a delinquent debt the recipient owes the Government. See 32 CFR 22.105
  • Administrator: The Administrator of the Environmental Protection Agency. See 40 CFR 85.1502
  • Administrator: means the Administrator of the United States Environmental Protection Agency or his authorized representative. See 40 CFR 82.3

  • Affiliate: means a company that controls, is controlled by, or is under common control with another company. See 42 CFR 486.306
  • Affiliated corporation: means a corporation of which all the common stock is owned directly or indirectly by the firm or general partners and employees of the firm, or by the corporation or holders of the controlling stock and employees of the corporation, and the affiliation has been approved by the creditor's examining authority. See 42 CFR 435.229
  • Affirmation: A person filing an affidavit under this part must affirm that "all information contained in the application is complete and correct and that the information does not contain a false claim, statement, or representation. See 25 CFR 39.118
  • Aftermarket part: means any part offered for sale for installation in or on a motor vehicle after such vehicle has left the vehicle manufacturer's production line. See 40 CFR 85.2113
  • Agency: means the Environmental Protection Agency. See 40 CFR 85.2113
  • Agency: means the ODNI or any of its components. See 32 CFR 1701.2
  • Agency-provider model: means a method of providing Community First Choice services and supports under which entities contract for or provide through their own employees, the provision of such services and supports, or act as the employer of record for attendant care providers selected by the individual enrolled in Community First Choice. See 42 CFR 441.505
  • Agent: means any person who has been delegated the authority to obligate or act on behalf of a provider. See 42 CFR 420.201
  • Aggregate net credit exposure: means the sum of all net credit exposures of a covered company and all of its subsidiaries to a single counterparty as calculated under this subpart. See 31 CFR 360.20
  • Aggregate net credit exposure: means the sum of all net credit exposures of a covered foreign entity and all of its subsidiaries to a single counterparty as calculated under this subpart. See 31 CFR 360.92
  • Agreement: means a collective bargaining agreement. See 42 CFR 417.150
  • Agreement: means a legally binding grant or cooperative agreement entered into between CCC and a recipient to implement a project under the FFPr Program. See 31 CFR 380.1
  • Agreement cycle: refers to the time period of at least 4 years when an agreement is in effect between CMS and an OPO. See 42 CFR 486.302
  • Agriculture Pima Trust: means the Pima Agriculture Cotton Trust Fund. See 25 CFR 39.113
  • Agriculture Wool Trust: means the Agriculture Wool Apparel Manufacturers Trust Fund. See 25 CFR 39.118
  • Allotment: Amount available to a State from funds appropriated by Congress to carry out section 1452 of the Act. See 40 CFR 35.3505
  • Allowable costs: means costs that are incurred by a RHC or FQHC that is authorized to bill based on reasonable costs and are reasonable in amount and proper and necessary for the efficient delivery of RHC and FQHC services. See 42 CFR 405.2401
  • Allowance: An amount based on a percentage of the project's allowable building cost, computed in accordance with appendix B. See 40 CFR 35.2005
  • Alternative prescription drug coverage: means coverage of Part D drugs, other than standard prescription drug coverage that meets the requirements of §423. See 42 CFR 423.100
  • Alternative technology: Proven wastewater treatment processes and techniques which provide for the reclaiming and reuse of water, productively recycle wastewater constitutuents or otherwise eliminate the discharge of pollutants, or recover energy. See 40 CFR 35.2005
  • Alternative to conventional treatment works for a small community: For purposes of §§35. See 40 CFR 35.2005
  • Appeal: means any of the procedures that deal with the review of adverse coverage determinations made by the Part D plan sponsor on the benefits under a Part D plan the enrollee believes he or she is entitled to receive, including delay in providing or approving the drug coverage (when a delay would adversely affect the health of the enrollee), or on any amounts the enrollee must pay for the drug coverage, as defined in §423. See 42 CFR 423.560
  • Appeal: means a review by an MCO, PIHP, or PAHP of an adverse benefit determination. See 42 CFR 438.400
  • Appeal: means any of the procedures that deal with the review of adverse organization determinations on the health care services the enrollee believes he or she is entitled to receive, including delay in providing, arranging for, or approving the health care services (such that a delay would adversely affect the health of the enrollee), or on any amounts the enrollee must pay for a service, as defined under §422. See 42 CFR 422.561
  • Appliance: means any device which contains and uses a class I or class II substance or substitute as a refrigerant and which is used for household or commercial purposes, including any air conditioner, motor vehicle air conditioner, refrigerator, chiller, or freezer. See 40 CFR 82.152

  • Applicable percent: means a maximum upward or downward adjustment for a given performance year, not to exceed the following:

    (1) For CY 2018, 3-percent. See 42 CFR 484.305

  • Applicant: Any person, partnership, limited partnership, trust, consumer cooperative, corporation, public body, or association that has filed a preapplication, or in the case of RHS programs that do not require a preapplication, an official application, with RHS in anticipation of receiving or utilizing RHS financial assistance. See 25 CFR 162.361
  • Applicator: means the person who applies methyl bromide. See 40 CFR 82.3
  • Appointed representative: means an individual either appointed by an enrollee or authorized under State or other applicable law to act on behalf of the enrollee in filing a grievance, obtaining a coverage determination, or in dealing with any of the levels of the appeals process. See 42 CFR 423.560
  • Apprentice: means any person who is currently registered as an apprentice in maintenance, service, repair, or disposal of appliances with the U. See 40 CFR 82.152
  • Appropriate Regional Director: means the director of the NCUA Regional Office having jurisdiction over federally insured credit unions in the state where the affected credit union is principally located or, for credit unions with $10 billion or more in assets, the Director of the Office of National Examinations and Supervision.   • Appropriate State official: means the commission, board or other supervisory authority having jurisdiction over credit unions chartered by the State which chartered the affected credit union. See 43 CFR 2201.3-1
  • Approved CAP vendor: means an entity that has been awarded a contract by CMS to participate in the competitive acquisition program under 1847B of the Act. See 42 CFR 414.902
  • Approved equipment testing organization: means any organization which has applied for and received approval from the Administrator pursuant to §82. See 40 CFR 82.152
  • Approved independent standards testing organization: means any organization which has applied for and received approval from the Administrator pursuant to §82. See 40 CFR 82.32
  • Approved refrigerant recycling equipment: means equipment certified by the Administrator or an organization approved under §82. See 40 CFR 82.32
  • Assessment: means a sum certain that CMS may assess against an HHA in lieu of damages under Titles XI, XVIII, or XXI of the Social Security Act or under regulations in this chapter. See 42 CFR 489.60
  • Assessment period: means January 1 through December 31 of each calendar year. See 42 CFR 436.1003
  • Assessment reference date: means the specific calendar day in the patient assessment process that sets the designated endpoint of the common patient observation period, with most patient assessment items usually referring back in time from this endpoint. See 42 CFR 412.602
  • Assets: includes but is not limited to any listing that identifies Medicare beneficiaries to whom home health services were furnished by a participating or formerly participating HHA. See 42 CFR 489.60
  • At-risk determination: means a decision made under a plan sponsor's drug management program in accordance with §423. See 42 CFR 423.560
  • Attorney: means any individual who is a member in good standing of the bar of the highest court of any state, possession, territory, commonwealth, or the District of Columbia. See 31 CFR 375.11
  • Audit services: means any service required to be performed by an independent public accountant by section 36 of the FDIA and 12 CFR part 363, including attestation services. See 32 CFR 21.215
  • Authentication: means confirming that the person accessing a TreasuryDirect account is the same person whose identity was initially verified at account establishment. See 31 CFR 363.6
  • Authorized official: means an appointed official (for example, chief executive officer, chief financial officer, general partner, chairman of the board, or direct owner) to whom the organization has granted the legal authority to enroll it in the Medicare program, to make changes or updates to the organization's status in the Medicare program, and to commit the organization to fully abide by the statutes, regulations, and program instructions of the Medicare program. See 42 CFR 424.502
  • Auto-IRA: means an individual retirement account for or opened on behalf of a participant in a state retirement savings program (whether or not the program provides for automatic enrollment). See 31 CFR 347.3
  • Auto-IRA custodian: means an entity designated by a state (including, for the purpose of these regulations, political subdivisions of states) to act as the trustee or custodian for Auto-IRAs, in the form of Roth IRAs or traditional IRAs, for or opened on behalf of participants in a state Auto-IRA program. See 31 CFR 347.3
  • Award: Financial assistance that provides support or stimulation to accomplish a public purpose. See 32 CFR 32.2
  • Award: A grant or a cooperative agreement other than a technology investment agreement (TIA). See 32 CFR 34.2
  • Bank: means an insured depository institution, as defined in section 3 of the Federal Deposit Insurance Act (12 U. See 42 CFR 431.242
  • Bank: Has the meaning given to it in section 3(a)(6) of the Act (15 U. See 42 CFR 435.831

  • Bargaining representative: means an individual or entity designated or selected, under any applicable Federal, State, or local law, or public entity collective bargaining agreement, to represent employees in collective bargaining, or any other employee representative designated or selected under any law. See 42 CFR 417.150
  • Baseline consumption allowances: means the consumption allowances apportioned under §§82. See 40 CFR 82.3
  • Baseline production allowances: means the production allowances apportioned under §§82. See 40 CFR 82.3
  • Basic prescription drug coverage: means coverage of Part D drugs that is either standard prescription drug coverage or basic alternative coverage. See 42 CFR 423.100
  • Batch: means a single bulk cylinder of refrigerant after all reclamation has been completed prior to packaging or shipping to the market. See 40 CFR 82.152
  • Beneficiary: refers to the second individual named in the registration of a definitive savings bond, a converted definitive savings bond, or a book-entry security purchased through the TreasuryDirect system, registered, e. See 31 CFR 363.6
  • Beneficiary: means an individual enrolled in the Supplementary Medical Insurance program for the Aged and Disabled (part of title XVIII of the Act). See 42 CFR 405.2401
  • Beneficiary: refers to the second individual named in the registration of a security held in definitive form registered "John Doe SSN 123-45-6789 POD (payable on death to) Joseph Doe. See 31 CFR 351.3
  • Bid: means an offer to furnish a CAP drug within a category of CAP drugs in a competitive acquisition area for a particular price and time period. See 42 CFR 414.902
  • Binding commitment: A legal obligation by the State to an assistance recipient that defines the terms for assistance from the Fund. See 40 CFR 35.3505
  • Bioequivalent: has the meaning given such term in section 505(j)(8) of the Food, Drug, and Cosmetic Act. See 42 CFR 423.100
  • Board: means the Provider Reimbursement Review Board established in accordance with section 1878 of the Act (42 U. See 42 CFR 405.1801
  • Board hearing: means that hearing provided for in section 1878(a) of the Act (42 U. See 42 CFR 405.1801
  • Book-entry bond: means a Series EE savings bond maintained by Treasury solely as a computer record. See 31 CFR 351.3

  • Building completion: The date when all but minor components of a project have been built, all equipment is operational and the project is capable of functioning as designed. See 40 CFR 35.2005
  • Business: means any person engaged in a business, trade, employment, calling or profession, whether or not all or any part of the net earnings derived from such engagement by such person inure (or may lawfully inure) to the benefit of any private shareholder or individual. See 40 CFR 2.201
  • Business day: means any day that funds may be settled through ACH. See 31 CFR 363.6
  • CAP drug: means a physician-administered drug or biological furnished on or after January 1, 2006 described in section 1842(o)(1)(C) of the Act and supplied by an approved CAP vendor under the CAP as provided in this subpart. See 42 CFR 414.902
  • Capitalization grant: An award by EPA of funds to a State for purposes of capitalizing that State's Fund and for other purposes authorized in section 1452 of the Act. See 40 CFR 35.3505
  • Capitation payment: means a fixed per enrollee per month amount paid for contracted services without regard to the type, cost, or frequency of services furnished. See 42 CFR 422.350
  • Carrier: means a voluntary association, corporation, partnership, or other organization that is engaged in providing, paying for, or reimbursing all or part of the cost of health benefits under group insurance policies or contracts, medical or hospital service agreements, enrollment or subscription contracts, or similar group arrangements, in consideration of premiums or other periodic charges payable to the carrier. See 42 CFR 417.150
  • Case-mix index: means a scale that measures the relative difference in resource intensity among different groups in the clinical model. See 42 CFR 484.202
  • Cash contributions: The recipient's cash outlay, including the outlay of money contributed to the recipient by third parties. See 32 CFR 34.2
  • Cash draw: The transfer of cash from the Treasury through the ACH to the DWSRF program. See 40 CFR 35.3505
  • CCC: means the Commodity Credit Corporation. See 25 CFR 39.113
  • CCC: means the Commodity Credit Corporation. See 25 CFR 39.118
  • CCC: means the Commodity Credit Corporation, an agency and instrumentality of the United States within USDA, and includes any official of the United States delegated the responsibility to act on behalf of CCC. See 31 CFR 380.1
  • CCC-provided funds: means U. See 31 CFR 380.1
  • Centralized building: means all or part of a building, including, for purposes of this subpart only, a mobile vehicle, van, or trailer that is owned or leased on a full-time basis (that is, 24 hours per day, 7 days per week, for a term of not less than 6 months) by a group practice and that is used exclusively by the group practice. See 42 CFR 411.351
  • Certificate holder: The entity in whose name the certificate of conformity for a class of motor vehicles or motor vehicle engines has been issued. See 40 CFR 85.1502
  • Certificate of conformity: The document issued by the Administrator under section 206(a) of the Act. See 40 CFR 85.1502
  • Certification: means a CMS determination that an OPO meets the requirements for certification at §486. See 42 CFR 486.302
  • Certified aftermarket part: means any aftermarket part which has been certified pursuant to this subpart. See 40 CFR 85.2113
  • Civil money penalty: means a sum certain that CMS has the authority to impose on an HHA as a penalty under Titles XI, XVIII, or XXI of the Social Security Act or under regulations in this chapter. See 42 CFR 489.60
  • Claim: A written demand or written assertion by one of the parties to a grant or cooperative agreement seeking as a matter of right, the payment of money in a sum certain, the adjustment or interpretation of award terms, or other relief arising under or relating to a grant or cooperative agreement. See 32 CFR 22.105
  • Class I: refers to the controlled substances listed in appendix A to this subpart. See 40 CFR 82.3

  • Clinical laboratory services: means the biological, microbiological, serological, chemical, immunohematological, hematological, biophysical, cytological, pathological, or other examination of materials derived from the human body for the purpose of providing information for the diagnosis, prevention, or treatment of any disease or impairment of, or the assessment of the health of, human beings, including procedures to determine, measure, or otherwise describe the presence or absence of various substances or organisms in the body, as specifically identified by the List of CPT/HCPCS Codes. See 42 CFR 411.351
  • Closed book period: means a period of four business days prior to the date a scheduled marketable security interest and/or maturity payment is made, during which time certain transactions will be delayed until after the closed book period is completed. See 31 CFR 363.6
  • Closeout: The process by which the grants officer administering an award made by a DoD Component determines that all applicable administrative actions and all required work of the award have been completed by the recipient and DoD Component. See 32 CFR 32.2

  • Combined sewer: A sewer that is designed as a sanitary sewer and a storm sewer. See 40 CFR 35.2005
  • Comfort cooling: means the air-conditioning appliances used to provide cooling in order to control heat and/or humidity in occupied facilities including but not limited to residential, office, and commercial buildings. See 40 CFR 82.152
  • Commercial book-entry system: refers to the book-entry system in which you hold your Treasury securities in a tiered system through securities intermediaries such as financial institutions or brokerage firms. See 31 CFR 363.6
  • Commercial refrigeration: means the refrigeration appliances used in the retail food and cold storage warehouse sectors. See 40 CFR 82.152
  • Commissioner: means the Federal Housing Commissioner or his authorized representative. See 24 CFR 203.251

  • Community: A community includes cities, towns, boroughs, villages, and unincorporated places which have the characteristics of incorporated areas with support services such as shopping, post office, schools, central sewer and water facilities, police and fire protection, hospitals, medical and pharmaceutical facilities, etc. See 25 CFR 162.361
  • Comorbidity: means a specific patient condition that is secondary to the patient's principal diagnosis that is the primary reason for the inpatient rehabilitation stay. See 42 CFR 412.602
  • Company: means any corporation, partnership, business trust, association or similar organization, or any other trust (unless by its terms the trust must terminate within twenty-five years or not later than twenty-one years and ten months after the death of individuals living on the effective date of the trust). See 42 CFR 486.306
  • Company: means a corporation, partnership, limited liability company, depository institution, business trust, special purpose entity, association, or similar organization. See 42 CFR 436.1003
  • Compensatory preprofessional education: means any preprofessional education necessary to compensate for deficiencies in an individual's prior education in order to enable that individual to qualify for enrollment in a health professions school. See 42 CFR 136.302
  • Competitive acquisition area: means a geographic area established by the Secretary for purposes of implementing the CAP required by section 1847B of the Act. See 42 CFR 414.902
  • Complete waste treatment system: A complete waste treatment system consists of all the treatment works necessary to meet the requirements of title III of the Act, involving: (i) The transport of wastewater from individual homes or buildings to a plant or facility where treatment of the wastewater is accomplished. See 40 CFR 35.2005
  • Component: means a part of the refrigerant circuit within an appliance including, but not limited to, compressors, condensers, evaporators, receivers, and all of its connections and subassemblies. See 40 CFR 82.152
  • Component: means any directorate, mission manager, or other sub-organization in the ODNI or reporting to the Director, that has been designated or established in the ODNI pursuant to Section 103 of the National Security Act of 1947, as amended, including the National Counterterrorism Center (NCTC), the National Counterproliferation Center (NCPC) and the Office of the National Counterintelligence Executive (ONCIX), or such other offices and officials as may be established by law or as the Director may establish or designate in the ODNI, for example, the Program Manager, Information Sharing Environment (ISE) and the Inspector General (IG). See 32 CFR 1701.2
  • Comprehensive assessment: means a thorough evaluation of the client's physical, psychological, psychosocial, emotional, and therapeutic needs related to the diagnosis under which care is being furnished by the CMHC. See 42 CFR 485.902
  • Condition: means the relative degree of soundness of a product which may affect its merchantability and includes those factors which are subject to change and may result from, but not necessarily limited to, age, improper handling, storage or lack of refrigeration. See 7 CFR 51.2
  • Condition-level deficiency: means noncompliance as described in §488. See 42 CFR 488.705
  • Confer: means to shift the essential-use allowances obtained under §82. See 40 CFR 82.3
  • Construction: Any one or more of the following: Preliminary planning to determine the feasibility of treatment works, engineering, architectural, legal, fiscal, or economic investigations or studies, surveys, designs, plans, working drawings, specifications, procedures, field testing of innovative or alternative wastewater treatment processes and techniques (excluding operation and maintenance) meeting guidelines promulgated under section 304(d)(3) of the Act, or other necessary actions, erection, building, acquisition, alteration, remodeling, improvement, or extension of treatment works, or the inspection or supervision of any of the foregoing items. See 40 CFR 35.2005
  • Consultation: means a professional service furnished to a patient by a physician if the following conditions are satisfied:

    (1) The physician's opinion or advice regarding evaluation or management or both of a specific medical problem is requested by another physician. See 42 CFR 411.351

  • Consumer: means an individual who purchases, applies to purchase, or is solicited to purchase from you insurance products or annuities primarily for personal, family, or household purposes. See 42 CFR 486.306
  • Consumption: means the production plus imports minus exports of a controlled substance (other than transhipments, or used controlled substances). See 40 CFR 82.3
  • Consumption allowances: means the privileges granted by this subpart to produce and import controlled substances. See 40 CFR 82.3
  • Continuing credit union: means the credit union that will continue in operation after the merger. See 43 CFR 2361.0-2
  • Contract: A procurement contract under an award or subaward, and a procurement subcontract under a recipient's or subrecipient's contract. See 32 CFR 32.2
  • Contract: means (except as used in the definitions for "grant" and "subgrant" in this section and except where qualified by "Federal") a procurement contract under a grant or subgrant, and means a procurement subcontract under a contract. See 32 CFR 33.3
  • Contract: Either:

    (1) A procurement contract made by a recipient under a DoD Component's award or by a subrecipient under a subaward. See 32 CFR 34.2

  • Contract: means an employer-employee or public entity-employee contract, or a contract for health benefits. See 42 CFR 417.150
  • Contract of Insurance: means the agreement evidenced by the issuance of a Mortgage Insurance Certificate or by the endorsement of the Commissioner upon the credit instrument given in connection with an insured mortgage, incorporating by reference the regulations in this subpart and the applicable provisions of the Act. See 24 CFR 203.251
  • contract of insurance: means the agreement evidenced by such endorsement and includes the terms, conditions and provisions of this part and of the National Housing Act. See 24 CFR 207.251
  • Contracted pharmacy network: means licensed pharmacies, including retail, mail-order, and institutional pharmacies under contract with a Part D sponsor to provide covered Part D drugs at negotiated prices to Part D enrollees. See 42 CFR 423.100
  • Contractor determination: means the following:

    (1) With respect to a provider of services that has filed a cost report under §§413. See 42 CFR 405.1801

  • Contractor hearing: means that hearing provided for in §405. See 42 CFR 405.1801
  • Control: means that an individual, group of individuals, or entity has the power, directly or indirectly, to direct or influence significantly the actions or policies of an organization or institution. See 42 CFR 422.350
  • Control period: means the period from January 1, 1992 through December 31, 1992, and each twelve-month period from January 1 through December 31, thereafter. See 40 CFR 82.3
  • Controlled product: means a product that contains a controlled substance listed as a Class I, Group I or II substance in appendix A to this subpart. See 40 CFR 82.3
  • Controlled substance: means any substance listed in appendix A or appendix B to this subpart, whether existing alone or in a mixture, but excluding any such substance or mixture that is in a manufactured product other than a container used for the transportation or storage of the substance or mixture. See 40 CFR 82.3
  • conversion: as used in this subpart , does not necessarily mean the physical removal of the public housing development from the site. See 24 CFR 972.203
  • Converted savings bond: means a savings bond originally issued as a definitive bond that has been surrendered to us and converted to a book-entry savings bond to be maintained by Treasury solely as a computer record. See 31 CFR 363.6
  • Cooperative: means a private sector organization whose members own and control the organization and share in its services and its profits and that provides business services and outreach in cooperative development for its membership. See 31 CFR 380.1
  • Coowner: means either the first or the second individual named in the registration of a definitive Series EE savings bond registered "John Doe SSN 123-45-6789 or Joseph Doe. See 31 CFR 351.3
  • Coowner: means either of the persons named in the registration of a definitive or a converted definitive savings bond, registered, e. See 31 CFR 363.6
  • Corrective action: means action(s) to be taken by the State to reduce major error causes, trends in errors or other vulnerabilities for the purpose of reducing improper payments in Medicaid and CHIP. See 42 CFR 431.804
  • Correspondent: means a U. See 42 CFR 431.242
  • Cost contract: means a Medicare contract under which CMS pays the HMO or CMP on a reasonable cost basis. See 42 CFR 417.401
  • Cost sharing or matching: That portion of project or program costs not borne by the Federal Government. See 32 CFR 32.2
  • Cost sharing or matching: means the value of the third party in-kind contributions and the portion of the costs of a federally assisted project or program not borne by the Federal Government. See 32 CFR 33.3
  • Cost sharing or matching: That portion of project or program costs not borne by the Federal Government. See 32 CFR 34.2
  • Cost sharing or matching: means the portion of project expenses, or necessary goods and services provided to carry out a project, not paid or acquired with Federal funds. See 31 CFR 380.1
  • Counterparty: means with respect to a credit transaction:

    (1) With respect to a natural person, the natural person, and, if the credit exposure of the covered foreign entity to such natural person exceeds 5 percent of its capital stock and surplus in the case of a U. See 31 CFR 360.92

  • Court: means a court of law with jurisdiction over the parties and the subject matter. See 31 CFR 363.6
  • Court of competent jurisdiction: means a court that has jurisdiction over the subject matter and the parties before it. See 42 CFR 424.71
  • Coverage gap: means the period in prescription drug coverage that occurs between the initial coverage limit and the out-of-pocket threshold. See 42 CFR 423.100
  • Covered option transaction: means any transaction involving options or warrants in which the customer's risk is limited and all elements of the transaction are subject to contemporaneous exercise if:

    (1) The amount at risk is held in the account in cash, cash equivalents, or via an escrow receipt. See 42 CFR 435.229

  • Covered Part B services: means physicians' services, diagnostic X-ray tests, laboratory, other diagnostic tests, and any additional medical and other health services, that the HCPP furnishes to its Medicare enrollees. See 42 CFR 417.800
  • Covered services: means items or services for which the beneficiary is entitled to have payment made on his or her behalf under this subpart. See 42 CFR 405.2401
  • Credit union: means a federally insured, natural person credit union, whether federally- or State-chartered, as defined by 12 U. See 43 CFR 2201.3-1
  • Creditor: means any broker or dealer (as defined in sections 3(a)(4) and 3(a)(5) of the Act), any member of a national securities exchange, or any person associated with a broker or dealer (as defined in section 3(a)(18) of the Act), except for business entities controlling or under common control with the creditor. See 42 CFR 435.229
  • criteria: means predetermined elements against which aspects of the quality of a medical service may be compared. See 42 CFR 456.51

  • Critical use: means a circumstance in which the following two conditions are satisfied:

    (1) There are no technically and economically feasible alternatives or substitutes for methyl bromide available that are acceptable from the standpoint of environment and health and are suitable to the crops and circumstances involved, and

    (2) The lack of availability of methyl bromide for a particular use would result in significant market disruption. See 40 CFR 82.3

  • Critical use methyl bromide: means the class I, Group VI controlled substance produced or imported through expending a critical use allowance or that portion of inventory produced or imported prior to the January 1, 2005 phaseout date that is sold only for approved critical uses. See 40 CFR 82.3
  • CSRS: means subchapter III of chapter 83 of title 5, United States Code. See 7 CFR 58.37
  • Current ratio: means total current assets divided by total current liabilities. See 42 CFR 422.350
  • Current spouse: means a living person who is married to the employee, Member, or retiree at the time of the employee's, Member's, or retiree's death. See 7 CFR 58.37
  • Current spouse annuity: means a recurring benefit under CSRS that is payable (after the employee's, Member's, or retiree's death) to a current spouse who meets the requirements of §831. See 7 CFR 58.37
  • Current Treasury borrowing rate: means the prevailing market rate, as determined by Treasury, for a Treasury security with the specified period to maturity. See 31 CFR 344.1
  • CUSO: means a credit union service organization as described in 12 CFR 712 et seq. See 43 CFR 2201.3-1
  • Custodian: means a trustee or custodian of a Roth IRA or traditional IRA. See 31 CFR 347.3
  • Custom-built: means that the industrial process equipment or any of its components cannot be purchased and/or installed without being uniquely designed, fabricated and/or assembled to satisfy a specific set of industrial process conditions. See 40 CFR 82.152
  • CWSRF program: Each State's clean water state revolving fund program authorized under Title VI of the Clean Water Act, as amended, 33 U. See 40 CFR 35.3505
  • Date of completion: The date on which all work under an award is completed or the date on the award document, or any supplement or amendment thereto, on which Federal sponsorship ends. See 32 CFR 32.2
  • Date of dispensing: means the date of service. See 42 CFR 423.2305
  • Date of receipt: means the date a document or other material is received by either of the following:

    (1) A party or an affected nonparty. See 42 CFR 405.1801

  • Days: means calendar days. See 42 CFR 411.101
  • De-link: means the online process by which all securities contained within the minor linked account are moved to the minor's primary TreasuryDirect account and the linked account is deactivated. See 31 CFR 363.6
  • Deactivate: means that the provider or supplier's billing privileges were stopped, but can be restored upon the submission of updated information. See 42 CFR 424.502
  • Death record review: means an assessment of the medical chart of a deceased patient to evaluate potential for organ donation. See 42 CFR 486.302
  • Debentures: means registered, transferable securities in certificated or book entry form which are valid and binding obligations, issued in the name of the Mutual Mortgage Insurance Fund in accordance with the provisions of this part. See 24 CFR 203.251
  • Debt: Any amount of money or any property owed to a Federal Agency by any person, organization, or entity except another United States Federal Agency. See 32 CFR 22.105
  • Decoration: means an order, device, medal, badge, insignia, emblem, or award tendered by, or received from, a foreign government. See 42 CFR 456.122
  • Dedicated emergency department: means any department or facility of the hospital, regardless of whether it is located on or off the main hospital campus, that meets at least one of the following requirements:

    (1) It is licensed by the State in which it is located under applicable State law as an emergency room or emergency department. See 42 CFR 489.24

  • Deductible: means the amount incurred by the beneficiary during a calendar year as specified in §410. See 42 CFR 405.2401
  • Default: means any failure to comply with the terms of an obligation to such an extent that:

    (1) A judgment has been rendered in favor of the FDIC or a failed institution. See 42 CFR 482.76

  • Deficiency: means a SNF's or NF's failure to meet a participation requirement specified in the Act or in part 483, subpart B of this chapter. See 42 CFR 488.301
  • Deficiency: is a violation of the Act and regulations contained in part 484, subparts A through C of this chapter, is determined as part of a survey, and can be either standard or condition-level. See 42 CFR 488.705
  • Deficiency: means a finding in processing identified through active case review or negative case review that does not meet the definition of an eligibility error. See 42 CFR 431.804
  • Definition: A composite distinct part is a distinct part consisting of two or more noncontiguous components that are not located within the same campus, as defined in §413. See 42 CFR 483.5
  • Definitions: As used in this subpart:

    Agriculture Wool Trust means the Agriculture Wool Apparel Manufacturers Trust Fund. See 25 CFR 39.118

  • Definitions: For the purposes of this section:

    (1) Total risk-based capital ratio means the ratio of qualifying total capital to weighted risk assets. See 42 CFR 431.245

  • Definitive bond: means a Series EE savings bond issued in paper form. See 31 CFR 351.3
  • Delegated official: means an individual who is delegated by the "Authorized Official" the authority to report changes and updates to the enrollment record. See 42 CFR 424.502
  • Delinquent debt: A debt:

    (1) That the debtor fails to pay by the date specified in the initial written notice from the agency owed the debt, normally within 30 calendar days, unless the debtor makes satisfactory payment arrangements with the agency by that date. See 32 CFR 22.105

  • Delivery: means moving a minimum amount of $25 (consisting of principal and proportionate interest) of a security held as a gift from the account of the purchaser to the account of the recipient. See 31 CFR 363.6
  • Deposit: means a deposit required by the Civil Service Retirement Spouse Equity Act of 1984, Pub. See 7 CFR 58.37
  • Derivative transaction: means any transaction that is a contract, agreement, swap, warrant, note, or option that is based, in whole or in part, on the value of, any interest in, or any quantitative measure or the occurrence of any event relating to, one or more commodities, securities, currencies, interest or other rates, indices, or other assets. See 31 CFR 360.20
  • Derivative transaction: means any transaction that is a contract, agreement, swap, warrant, note, or option that is based, in whole or in part, on the value of, any interest in, or any quantitative measure or the occurrence of any event relating to, one or more commodities, securities, currencies, interest or other rates, indices, or other assets. See 31 CFR 360.92
  • Designated carrier: means an entity assigned by CMS to process and pay claims for drugs and biologicals under the CAP. See 42 CFR 414.902
  • Designated loan: means a loan secured by a building or mobile home that is located or to be located in a special flood hazard area in which flood insurance is available under the Act. See 42 CFR 480.138
  • Designation: means CMS assignment of a geographic service area to an OPO. See 42 CFR 486.302
  • Designee: means any person or entity authorized to act on behalf of an employing entity or a group of employing entities to offer the option of enrollment in a qualified health maintenance organization to their eligible employees. See 42 CFR 417.150
  • Destruction: means the expiration of a controlled substance to the destruction efficiency actually achieved, unless considered completely destroyed as defined in this section. See 40 CFR 82.3
  • Developer: Any person, partnership, public body, or corporation who is involved with the development of a site which will be financed by RHS. See 25 CFR 162.361
  • Development: The systematic use of scientific and technical knowledge in the design, development, testing, or evaluation of potential new products, processes, or services to meet specific performance requirements or objectives. See 32 CFR 22.105
  • Development: The act of building structures and installing site improvements on an individual dwelling site, a subdivision, or a multiple family tract. See 25 CFR 162.361
  • Development cost: means the cost of purchasing and developing the sites including engineering and legal fees, streets, roads, utilities, minimum essential administrative costs, necessary equipment and estimated interest which the borrower cannot pay from other sources. See 25 CFR 162.209
  • Direct medical and surgical services: means services to individual beneficiaries that are either personally furnished by a physician or furnished by a resident under the supervision of a physician in a teaching hospital making the cost election described in §§415. See 42 CFR 415.152
  • Direct services: means services provided by the clinic's staff. See 42 CFR 491.2
  • Directed plan of correction: means CMS or the temporary manager (with CMS/SA approval) may direct the HHA to take specific corrective action to achieve specific outcomes within specific timeframes. See 42 CFR 488.805
  • Director: means the Director of the Office of Government Ethics. See 20 CFR 10.508
  • Disadvantaged community: The entire service area of a public water system that meets affordability criteria established by the State after public review and comment. See 40 CFR 35.3505
  • Disallowed costs: Those charges to an award that the grants officer administering an award made by a DoD Component determines to be unallowable, in accordance with the applicable Federal cost principles or other terms and conditions contained in the award. See 32 CFR 32.2
  • Disallowed costs: Those charges to an award that the grants officer administering an award made by a DoD Component determines to be unallowable, in accordance with the applicable Federal cost principles or other terms and conditions contained in the award. See 32 CFR 34.2
  • Disburse: means to make a payment to liquidate an obligation. See 31 CFR 380.1
  • Disbursement: The transfer of cash from the DWSRF program account established in the State's bank to an assistance recipient. See 40 CFR 35.3505
  • Discharge: A Medicare patient in a long-term care hospital is considered discharged when--

    (1) For purposes of the long-term care hospital qualification calculation, as described in §412. See 42 CFR 412.503

  • Discharge: A Medicare patient in an inpatient rehabilitation facility is considered discharged when--

    (1) The patient is formally released from the inpatient rehabilitation facility. See 42 CFR 412.602

  • Discipline: means one of the six home health disciplines covered under the Medicare home health benefit (skilled nursing services, home health aide services, physical therapy services, occupational therapy services, speech- language pathology services, and medical social services). See 42 CFR 484.202
  • Disclosure: means making a record about an individual available to or releasing it to another party. See 32 CFR 1701.2
  • Disposal: means the process leading to and including:

    (1) The discharge, deposit, dumping or placing of any discarded appliance into or on any land or water. See 40 CFR 82.152

  • Distributor of methyl bromide: means the person directly selling a class I, Group VI controlled substance to an applicator. See 40 CFR 82.3
  • DoD Component: A Military Department, Defense Agency, DoD field activity, or organization within the Office of the Secretary of Defense that provides or administers an award to a recipient. See 32 CFR 32.2
  • DoD Component: A Military Department, Defense Agency, DoD Field Activity, or organization within the Office of the Secretary of Defense that provides or administers an award to a recipient. See 32 CFR 34.2
  • Domestic violence: means the occurrence of one or more of the following acts by a current or former family member, household member, intimate partner, or caretaker:

    (1) Attempting to cause or causing or threatening another person physical harm, severe emotional distress, psychological trauma, rape, or sexual assault. See 42 CFR 486.306

  • Donated commodities: means the commodities donated by CCC to a recipient under an agreement. See 31 CFR 380.1
  • Donor: means a deceased individual from whom at least one vascularized organ (heart, liver, lung, kidney, pancreas, or intestine) is recovered for the purpose of transplantation. See 42 CFR 486.302
  • Donor document: means any documented indication of an individual's choice regarding his or her wishes concerning organ and/or tissue donation that was made by that individual or another authorized individual in accordance with any applicable State law. See 42 CFR 486.302
  • Downstream contractor: means a "first tier contractor" as defined at §1001. See 42 CFR 411.351
  • Drug: refers to both drugs and biologicals. See 42 CFR 414.704
  • Drug: means both drugs and biologicals. See 42 CFR 414.802
  • Drug: means both drugs and biologicals. See 42 CFR 414.902
  • Dually participating facility: means a facility that has a provider agreement in both the Medicare and Medicaid programs. See 42 CFR 488.301
  • DWSRF program: Each State's drinking water state revolving fund program authorized under section 1452 of the Act, as amended, 42 U. See 40 CFR 35.3505
  • Effective date of coverage: (1) If the individual enrolls in a month during any part of which he or she is covered under a GHP or LGHP on the basis of current employment status, or in the first full month when no longer so covered, coverage begins on the first day of the month of enrollment or, at the individual's option, on the first day of any of the three following months. See 42 CFR 406.24
  • Electronic commerce: The conduct of business through the use of automation and electronic media, in lieu of paper transactions, direct personal contact, telephone, or other means. See 32 CFR 22.105
  • Electronic funds transfer: A system that provides the authority to debit or credit accounts in financial institutions by electronic means rather than source documents (e. See 32 CFR 22.105
  • Electronic health record: means a repository of consumer health status information in computer processable form used for clinical diagnosis and treatment for a broad array of clinical conditions. See 42 CFR 411.351
  • Electronic media: includes any means for transmitting messages electronically between you and a consumer in a format that allows visual text to be displayed on equipment, for example, a personal computer monitor. See 42 CFR 486.306
  • Eligibility: means meeting the State's categorical and financial criteria for receipt of benefits under the Medicaid or CHIP programs. See 42 CFR 431.804
  • Eligibility determination: means an approval or denial of eligibility in accordance with §457. See 42 CFR 457.301
  • Eligible collateral: means collateral in which, notwithstanding the prior security interest of any custodial agent, the covered company has a perfected, first priority security interest (or the legal equivalent thereof, if outside of the United States), with the exception of cash on deposit, and is in the form of:

    (1) Cash on deposit with the covered company or a subsidiary of the covered company (including cash in foreign currency or U. See 31 CFR 360.20

  • Eligible collateral: means collateral in which, notwithstanding the prior security interest of any custodial agent, the covered foreign entity has a perfected, first priority security interest (or the legal equivalent thereof, if outside of the United States), with the exception of cash on deposit, and is in the form of:

    (1) Cash on deposit with the covered foreign entity or an affiliate of the covered foreign entity (including cash in foreign currency or U. See 31 CFR 360.92

  • Eligible credit derivative: means a single-name credit derivative or a standard, non-tranched index credit derivative, provided that:

    (1) The contract meets the requirements of an eligible guarantee and has been confirmed by the protection purchaser and the protection provider. See 31 CFR 360.20

  • Emergency delivery: means delivery of a CAP drug within one business day in appropriate shipping and packaging, in all areas of the United States and its territories, with the exception of the Pacific Territories. See 42 CFR 414.902
  • Emergency services: means inpatient or outpatient hospital services that are necessary to prevent death or serious impairment of health and, because of the danger to life or health, require use of the most accessible hospital available and equipped to furnish those services. See 42 CFR 424.101
  • Emergency services: means covered inpatient or outpatient services that are furnished by an appropriate source other than the HMO or CMP and that meet the following conditions:

    (1) Are needed immediately because of an injury or sudden illness. See 42 CFR 417.401

  • Emission warranty: means those warranties given by vehicle manufacturers pursuant to section 207 of the Act. See 40 CFR 85.2113
  • Emission-critical parameters: means those critical parameters and tolerances which, if equivalent from one part to another, will not cause the vehicle to exceed applicable emission standards with such parts installed. See 40 CFR 85.2113
  • Employee: means any individual who, under the common law rules that apply in determining the employer-employee relationship (as applied for purposes of section 3121(d)(2) of the Internal Revenue Code of 1986), is considered to be employed by, or an employee of, an entity. See 42 CFR 405.2401
  • Employee: means any individual who, under the common law rules that apply in determining the employer-employee relationship (as applied for purposes of section 3121(d)(2) of the Internal Revenue Code of 1986), is considered to be employed by, or an employee of, an entity. See 42 CFR 411.351

  • Encode: means entering data items into the fields of the computerized patient assessment software program. See 42 CFR 412.602
  • Enforceable requirements of the Act: Those conditions or limitations of section 402 or 404 permits which, if violated, could result in the issuance of a compliance order or initiation of a civil or criminal action under section 309 of the Act or applicable State laws. See 40 CFR 35.2005
  • Engine family: means the basic classification unit of a vehicle's product line for a single model year used for the purpose of emission-data vehicle or engine selection and as determined in accordance with 40 CFR 86. See 40 CFR 85.2113
  • Enrollee: means a Part D eligible individual who has elected or has been enrolled in a Part D plan. See 42 CFR 423.560
  • Enrollee: means an MA eligible individual who has elected an MA plan offered by an MA organization. See 42 CFR 422.561
  • Enrollment application: means a CMS-approved paper enrollment application or an electronic Medicare enrollment process approved by OMB. See 42 CFR 424.502
  • Entire metropolitan statistical area: means a metropolitan statistical area (MSA), a consolidated metropolitan statistical area (CMSA), or a primary metropolitan statistical area (PMSA) listed in the State and Metropolitan Area Data Book published by the U. See 42 CFR 486.302
  • Entitled to Medicare on the basis of disability: means entitled or deemed entitled on the basis of entitlement to social security disability benefits or railroad retirement disability benefits. See 42 CFR 411.201
  • Entity: means a person, group, or facility that is enrolled in the Medicare program. See 42 CFR 424.71
  • Entity: means any owner of a TreasuryDirect account that is not an individual. See 31 CFR 363.6
  • environment: means the natural and physical environment and excludes social, economic and other environments. See 40 CFR 6.402
  • EPA legal office: means the EPA General Counsel and any EPA office over which the General Counsel exercises supervisory authority, including the various Offices of Regional Counsel. See 40 CFR 2.201
  • EPA office: means any organizational element of EPA, at any level or location. See 40 CFR 2.201
  • Equipment: Tangible nonexpendable personal property including exempt property charged directly to the award having a useful life of more than one year and an acquisition cost of $5,000 or more per unit. See 32 CFR 32.2
  • Equipment: means tangible, nonexpendable, personal property having a useful life of more than one year and an acquisition cost of $5,000 or more per unit. See 32 CFR 33.3
  • Equipment: Tangible nonexpendable personal property charged directly to the award having a useful life of more than one year and an acquisition cost of $5,000 or more per unit. See 32 CFR 34.2
  • Equity: means the total current market value of security positions held in the margin account plus any credit balance less the debit balance in the margin account. See 42 CFR 435.229

  • ESRD Network: means all Medicare-approved ESRD facilities in a designated geographic area specified by CMS. See 42 CFR 482.70
  • Essential-Use Allowances: means the privileges granted by §82. See 40 CFR 82.3
  • Essential-Uses: means those uses of controlled substances designated by the Parties to the Protocol to be necessary for the health and safety of, or critical for the functioning of, society. See 40 CFR 82.3
  • et seq: (formerly 42 U. See 40 CFR 85.2113

    Administrator. See 40 CFR 35.3505

  • Ethics Counselor: includes any official designated by the Ethics Counselor to act on the Ethics Counselor's behalf. See 42 CFR 493.1453
  • Excess property: Property under the control of any DoD Component that, as determined by the head thereof, is no longer required for its needs or the discharge of its responsibilities. See 32 CFR 34.2
  • Exempt counterparty: means an entity that is identified as exempt from the requirements of this subpart under §252. See 31 CFR 360.20
  • Exempt counterparty: means an entity that is identified as exempt from the requirements of this subpart under §252. See 31 CFR 360.92
  • Exempt property: Tangible personal property acquired in whole or in part with Federal funds, where the DoD Component has statutory authority to vest title in the recipient without further obligation to the Federal Government. See 32 CFR 32.2
  • exempt substitutes: refers to certain substitutes when used in certain end-uses that are specified in §82. See 40 CFR 82.152
  • Exempted borrower: means a member of a national securities exchange or a registered broker or dealer, a substantial portion of whose business consists of transactions with persons other than brokers or dealers, and includes a borrower who:

    (1) Maintains at least 1000 active accounts on an annual basis for persons other than brokers, dealers, and persons associated with a broker or dealer. See 42 CFR 435.229

  • Exempted borrower: means a member of a national securities exchange or a registered broker or dealer, a substantial portion of whose business consists of transactions with persons other than brokers or dealers, and includes a borrower who:

    (1) Maintains at least 1000 active accounts on an annual basis for persons other than brokers, dealers, and persons associated with a broker or dealer. See 42 CFR 435.831

  • Exempted securities mutual fund: means any security issued by an investment company registered under section 8 of the Investment Company Act of 1940 (15 U. See 42 CFR 435.229
  • Expected donation rate: means the donation rate expected for an OPO based on the national experience for OPOs serving similar hospitals and donation service areas. See 42 CFR 486.302
  • Expenditures: See the definition for outlays in this section. See 32 CFR 34.2
  • Exploitation: Exploitation means taking advantage of a resident for personal gain through the use of manipulation, intimidation, threats, or coercion. See 42 CFR 483.5
  • Export: means the transport of virgin or used controlled substances from inside the United States or its territories to persons outside the United States or its territories, excluding United States military bases and ships for on-board use. See 40 CFR 82.3
  • Export production allowances: means the privileges granted by §82. See 40 CFR 82.3
  • Exporter: means the person who contracts to sell controlled substances for export or transfers controlled substances to his affiliate in another country. See 40 CFR 82.3
  • Exposure: includes credit and liquidity risks, including operational risks, related to intraday and interday transactions. See 42 CFR 431.242
  • extended maturity: refer to periods after the original maturity dates of the bonds during which owners may retain them and continue to earn interest. See 31 CFR 351.3
  • Extended survey: means a survey that evaluates additional participation requirements subsequent to finding substandard quality of care during a standard survey. See 42 CFR 488.301
  • Extended survey: means a survey that reviews additional conditions of participation not examined during a standard survey. See 42 CFR 488.705
  • External quality review: means the analysis and evaluation by an EQRO, of aggregated information on quality, timeliness, and access to the health care services that an MCO, PIHP, PAHP, or PCCM entity (described in §438. See 42 CFR 438.320
  • Face amount: refers to the nominal amount of a Series EE savings bond. See 31 CFR 351.3
  • Facility: means any process equipment (e. See 40 CFR 82.3
  • Facility: means a hospital or other institution that furnishes health care services to inpatients. See 42 CFR 424.71
  • facility: is a lways the entity that participates in the program, whether that entity is comprised of all of, or a distinct part of, a larger institution. See 42 CFR 483.5
  • Facility: means a SNF or NF, or a distinct part SNF or NF, in accordance with §483. See 42 CFR 488.301
  • Failed institution: means any insured depository institution (as defined in 12 U. See 42 CFR 482.76
  • fair market value: means the value of rental property for general commercial purposes (not taking into account its intended use). See 42 CFR 411.351
  • fallback entity: means an entity that, for a particular contract period-

    (1) Is a PDP sponsor that does not have to be a risk-bearing entity (or, if applying to become a fallback entity, an entity that meets all the requirements to become a Part D plan sponsor except that it does not have to be a risk-bearing entity). See 42 CFR 423.855

  • Fallback prescription drug plan: means a prescription drug plan (PDP) offered by a fallback entity that--

    (1) Offers only defined standard or actuarially equivalent standard prescription drug coverage as defined in §423. See 42 CFR 423.855

  • Family member: means a person who is enrolled in an LGHP based on another person's enrollment. See 42 CFR 411.201
  • FAS: means the Foreign Agricultural Service. See 25 CFR 39.118
  • FAS: means the Foreign Agricultural Service of the United States Department of Agriculture. See 31 CFR 380.1
  • FDIC: means the Federal Deposit Insurance Corporation. See 42 CFR 482.76
  • FDIC-supervised institution: means any insured depository institution for which the Federal Deposit Insurance Corporation is the appropriate Federal banking agency pursuant to section 3(q) of the Federal Deposit Insurance Act, 12 U. See 42 CFR 480.138
  • Federal per diem base rate: means the payment based on the average routine operating, ancillary, and capital-related cost of 1 day of hospital inpatient services in an inpatient psychiatric facility. See 42 CFR 412.402
  • Federal per diem payment amount: means the Federal per diem base rate with all applicable adjustments. See 42 CFR 412.402
  • Federally insured: means insured by the National Credit Union Administration (NCUA) through the National Credit Union Share Insurance Fund (NCUSIF). See 43 CFR 2361.0-2
  • Federally owned property: Property in the possession of, or directly acquired by, the Government and subsequently made available to the recipient. See 32 CFR 34.2
  • FFPr Program: means the Food for Progress Program. See 31 CFR 380.1
  • Field testing: Practical and generally small-scale testing of innovative or alternative technologies directed to verifying performance and/or refining design parameters not sufficiently tested to resolve technical uncertainties which prevent the funding of a promising improvement in innovative or alternative treatment technology. See 40 CFR 35.2005
  • Final adverse action: means one or more of the following actions:

    (1) A Medicare-imposed revocation of any Medicare billing privileges. See 42 CFR 424.502

  • Final maturity: refers to the date that a bond ceases to earn interest. See 31 CFR 351.3
  • Final written notice: means that written communication, immediately preceding the first level of formal administrative or judicial proceedings, from a Medicaid agency official or other State official that notifies the provider of the State's overpayment determination and allows the provider to contest that determination, or that notifies the State Medicaid agency of the filing of a civil or criminal action. See 42 CFR 433.304
  • Financial institution: means any institution the business of which is engaging in activities that are financial in nature or incidental to such financial activities as described in section 4(k) of the Bank Holding Company Act of 1956 (12 U. See 42 CFR 476.110
  • Financial intermediary: means any broker, dealer, bank, underwriter, exchange, clearing agency registered with the Securities and Exchange Commission (SEC) under section 17A of the Securities Exchange Act of 1934, transfer agent (as defined in section 3(a)(25) of the Securities Exchange Act of 1934), central counterparty or any other entity whose role is to facilitate a transaction by, as a riskless intermediary, purchasing a security or qualified financial contract from one counterparty and then selling it to another. See 42 CFR 482.76
  • Financial market: means a market for a financial contract. See 42 CFR 435.906
  • Fixed dollar loss threshold amount: means a dollar amount which, when added to the Federal payment amount for a case, the estimated costs of a case must exceed in order for the case to qualify for an outlier payment. See 42 CFR 412.402
  • FOIA: means the Freedom of Information Act. See 32 CFR 1701.2
  • Follow-up verification test: means those tests that involve checking the repairs to an appliance after a successful initial verification test and after the appliance has returned to normal operating characteristics and conditions to verify that the repairs were successful. See 40 CFR 82.152
  • Foreign bank: means an institution that: (1) Is organized under the laws of a country other than the United States. See 42 CFR 431.242
  • Foreign bank holding company: means a foreign bank that is a bank holding company and any foreign company that owns such foreign bank. See 42 CFR 436.1003
  • Foreign banks: A correspondent that is a foreign bank may be considered adequately capitalized under this section without regard to the minimum leverage ratio required under paragraph (a)(3) of this section. See 42 CFR 431.245
  • Foreign person: means a person other than a United States person as defined in section 7(f) of the Act. See 42 CFR 435.229
  • Foreign savings and loan holding company: means a foreign bank or foreign company that is a savings and loan holding company. See 42 CFR 436.1003
  • Foreign security: means a security issued in a jurisdiction other than the United States. See 42 CFR 435.229
  • Foreign state: means an entity which is recognized as a sovereign nation or country other than the United States of America. See 40 CFR 82.3
  • former spouse: includes only persons who were married to an employee or Member on or after May 7, 1985, or who were the spouse of a retiree who retired on or after May 7, 1985, regardless of the date of termination of the marriage. See 7 CFR 58.37
  • Former spouse annuity: means a recurring benefit under CSRS that is payable to a former spouse after the employee's, Member's, or retiree's death. See 7 CFR 58.37
  • FQHC: means an entity as defined in §405. See 42 CFR 491.2
  • FTP: The Federal Test Procedure at part 86. See 40 CFR 85.1502
  • Full charge: means the amount of refrigerant required for normal operating characteristics and conditions of the appliance as determined by using one or a combination of the following four methods:

    (1) Use of the equipment manufacturer's determination of the full charge. See 40 CFR 82.152

  • Fully reduced annuity: means the recurring payments under CSRS received by a retiree who has elected the maximum allowable reduction in annuity to provide a current spouse annuity and/or a former spouse annuity or annuities. See 7 CFR 58.37
  • Fully sprinklered: A fully sprinklered long term care facility is one that has all areas sprinklered in accordance with National Fire Protection Association 13 "Standard for the Installation of Sprinkler Systems" without the use of waivers or the Fire Safety Evaluation System. See 42 CFR 483.5
  • Functional-related groups: refers to the distinct groups under which inpatients are classified using proxy measurements of inpatient rehabilitation relative resource usage. See 42 CFR 412.602
  • Fund: A revolving account into which a State deposits DWSRF program funds (e. See 40 CFR 35.3505
  • Funding period: The period of time when Federal funding is available for obligation by the recipient. See 32 CFR 32.2
  • Funding period: The period of time when Federal funding is available for obligation by the recipient. See 32 CFR 34.2
  • GAAP: means generally accepted accounting principles, as used in the United States. See 42 CFR 436.1003
  • General rule: To be eligible for an award under this subpart, an applicant must have been named as a party to the adjudicatory proceeding and show that it meets all other conditions of eligibility set forth in paragraphs (b) and (c) of this section. See 31 CFR 380.0
  • General rules: Services furnished in hospitals by residents in approved GME programs are specifically excluded from being paid as "physician services" defined in §414. See 42 CFR 415.200
  • Geographic area: means the area found by CMS to be the area within which the HMO or CMP furnishes, or arranges for furnishing, the full range of services that it offers to its Medicare enrollees. See 42 CFR 417.401
  • Gift: means a tangible or intangible present (other than a decoration) tendered by, or received from, a foreign government. See 42 CFR 456.122
  • Gift: means a Treasury security purchased for or transferred to an intended recipient, without consideration. See 31 CFR 363.6
  • Government: means a State or local government or a federally recognized Indian tribal government. See 32 CFR 33.3
  • Grandfathered unitary savings and loan holding company: means a savings and loan holding company described in section 10(c)(9)(C) of the Home Owners' Loan Act ("HOLA") (12 U. See 42 CFR 436.1003
  • Grant: means an award of financial assistance, including cooperative agreements, in the form of money, or property in lieu of money, by the Federal Government to an eligible grantee. See 32 CFR 33.3
  • Grantee: means the government to which a grant is awarded and which is accountable for the use of the funds provided. See 32 CFR 33.3
  • Grievance: means any complaint or dispute, other than one that involves a coverage determination or at-risk determination, expressing dissatisfaction with any aspect of the operations, activities, or behavior of a Part D plan sponsor, regardless of whether remedial action is requested. See 42 CFR 423.560
  • Grievance: means an expression of dissatisfaction about any matter other than an adverse benefit determination. See 42 CFR 438.400
  • Grievance: means any complaint or dispute, other than one that constitutes an organization determination, expressing dissatisfaction with any aspect of an MA organization's or provider's operations, activities, or behavior, regardless of whether remedial action is requested. See 42 CFR 422.561
  • Grievance and appeal system: means the processes the MCO, PIHP, or PAHP implements to handle appeals of an adverse benefit determination and grievances, as well as the processes to collect and track information about them. See 42 CFR 438.400
  • Group enrollment period: means the period of at least 10 working days each calendar year during which each eligible employee is given the opportunity to select among the alternatives included in a health benefits plan. See 42 CFR 417.150
  • Guarantor: means an entity that--

    (1) Has been approved by CMS as meeting the requirements to be a guarantor. See 42 CFR 422.350

  • Health benefits contract: means a contract or other agreement between an employing entity or a designee and a carrier for the provision of, or payment for, health benefits to eligible employees or to eligible employees and their eligible dependents. See 42 CFR 417.150
  • Health benefits plan: means any arrangement, to provide or pay for health services, that is offered to eligible employees, or to eligible employees and their eligible dependents, by or on behalf of an employing entity. See 42 CFR 417.150
  • Health care provider: means the individual or entity that receives any payment or payments for health care items or services provided. See 42 CFR 433.52
  • Health care services: means all Medicaid services provided by an MCO, PIHP, or PAHP under contract with the State Medicaid agency in any setting, including but not limited to medical care, behavioral health care, and long-term services and supports. See 42 CFR 438.320
  • Health or educational entity: means an organization, agency, or combination thereof, which has the provision of health or educational programs as one of its major functions. See 42 CFR 136.302
  • Health professions school: means any of the schools defined in paragraphs (m), (n), or (o) of this section. See 42 CFR 136.302
  • Health-related tasks: means specific tasks related to the needs of an individual, which can be delegated or assigned by licensed health-care professionals under State law to be performed by an attendant. See 42 CFR 441.505
  • Heart-Lung transplant center: means a transplant center that is located in a hospital with an existing Medicare-approved heart transplant center and an existing Medicare-approved lung center that performs combined heart-lung transplants. See 42 CFR 482.70
  • Heel: means the amount of a controlled substance that remains in a container after it is discharged or off-loaded (that is no more than ten percent of the volume of the container). See 40 CFR 82.3
  • High-pressure appliance: means an appliance that uses a refrigerant with a liquid phase saturation pressure between 170 psia and 355 psia at 104 °F. See 40 CFR 82.152
  • Home health market basket index: means an index that reflects changes over time in the prices of an appropriate mix of goods and services included in home health services. See 42 CFR 484.202
  • Home health services: means the services described in section 1861(m) of the Act and part 409, subpart E of this chapter. See 42 CFR 411.351
  • Hospital: means a facility that--

    (1) Is primarily engaged in providing, by or under the supervision of doctors of medicine or osteopathy, inpatient services for the diagnosis, treatment, and care or rehabilitation of persons who are sick, injured, or disabled. See 42 CFR 424.101

  • Hospital: means any entity that qualifies as a "hospital" under section 1861(e) of the Act, as a "psychiatric hospital" under section 1861(f) of the Act, or as a "critical access hospital" under section 1861(mm)(1) of the Act, and refers to any separate legally organized operating entity plus any subsidiary, related entity, or other entities that perform services for the hospital's patients and for which the hospital bills. See 42 CFR 411.351
  • Hospital: includes a critical access hospital as defined in section 1861(mm)(1) of the Act. See 42 CFR 489.24
  • HRSA: means the Health Resources and Services Administration. See 42 CFR 405.2401
  • HTS: means the Harmonized Tariff Schedule of the United States. See 25 CFR 39.118
  • HTS subheadings: All references to subheadings of the HTS in this part are to the subheadings as described in the HTS in 2014. See 25 CFR 39.118
  • Hydrostatic testing: means checking a gas pressure vessel for leaks or flaws. See 40 CFR 82.3
  • Hysterectomy: means a medical procedure or operation for the purpose of removing the uterus. See 42 CFR 441.251
  • Immediate family: means husband or wife. See 42 CFR 488.301
  • Immediate jeopardy: means a situation in which the provider's noncompliance with one or more requirements of participation has caused, or is likely to cause, serious injury, harm, impairment, or death to a resident. See 42 CFR 488.301
  • Immediate jeopardy: means a situation in which the provider's noncompliance with one or more requirements of participation has caused, or is likely to cause serious injury, harm, impairment, or death to a patient(s). See 42 CFR 488.805
  • Immediate jeopardy: means a situation in which the provider's or supplier's non-compliance with one or more Medicare accreditation requirements has caused, or is likely to cause, serious injury, harm, impairment, or death to a patient. See 42 CFR 488.1005
  • Import: means to land on, bring into, or introduce into, or attempt to land on, bring into, or introduce into any place subject to the jurisdiction of the United States whether or not such landing, bringing, or introduction constitutes an importation within the meaning of the customs laws of the United States, with the following exemptions:

    (1) Off-loading used or excess controlled substances or controlled products from a ship during servicing,

    (2) Bringing controlled substances into the U. See 40 CFR 82.3

  • Importer: includes the person primarily liable for the payment of any duties on the merchandise or an authorized agent acting on his or her behalf. See 40 CFR 82.3
  • In the ordinary course of business: means occurring or reasonably expected to occur in carrying out or furthering any business purpose, or in the case of an individual, in the course of any activity for profit or the management or preservation of property. See 42 CFR 435.831
  • incident to: means those services and supplies that meet the requirements of section 1861(s)(2)(A) of the Act, §410. See 42 CFR 411.351
  • Incompetent: means an individual who is incapable of handling his or her business affairs because of a legal, mental or medical disability, except that a minor is not an incompetent solely because of age. See 31 CFR 353.2
  • Incompetent: means an individual who is incapable of handling his or her business affairs because of a legal, mental or medical disability, except that a minor is not an incompetent solely because of age. See 31 CFR 360.2
  • incorrect collections: means any amounts collected from a beneficiary (or someone on his or her behalf) that are not authorized under subpart C of this part. See 42 CFR 489.40
  • Incurred costs: means costs incurred by a Part D enrollee for--

    (1)(i) Covered Part D drugs that are not paid for under the Part D plan as a result of application of any annual deductible or other cost-sharing rules for covered Part D drugs prior to the Part D enrollee satisfying the out-of-pocket threshold under §423. See 42 CFR 423.100

  • Independent entity: means a company with experience in conducting corporate elections. See 43 CFR 2361.0-2
  • Independent trustee: means a trustee who meets the requirements of §2634. See 20 CFR 10.508
  • Indian health organization: means a nonprofit corporate body composed of Indians which provides for the maximum participation of all interested Indian groups and individuals and which has the provision of health programs as its principal function. See 42 CFR 136.302
  • Indian tribe: means any Indian tribe, band, nation, or other organized group or community, including any Alaska native village or group or regional or village corporation as defined in or established pursuant to the Alaska Native Claims Settlement Act (43 U. See 42 CFR 136.302
  • Indirect ownership interest: means any ownership interest in an entity that has an ownership interest in the disclosing entity. See 42 CFR 420.201
  • Indirectly secured: (1) Includes any arrangement with the customer under which:

    (i) The customer's right or ability to sell, pledge, or otherwise dispose of margin stock owned by the customer is in any way restricted while the credit remains outstanding. See 42 CFR 435.831

  • Individual: means the eligible individual and, if applicable, the individual's representative. See 42 CFR 441.505
  • Individual: means a person eligible to have an IRA in Treasury's retirement savings program or in a state Auto-IRA program. See 31 CFR 347.3
  • Individual: means a natural person. See 31 CFR 363.6
  • Individual shipment: means the kilograms of a used controlled substance for which a person may make one (1) U. See 40 CFR 82.3
  • Individual systems: Privately owned alternative wastewater treatment works (including dual waterless/gray water systems) serving one or more principal residences, or small commercial establishments. See 40 CFR 35.2005
  • Industrial process refrigeration: means complex customized appliances that are directly linked to the processes used in, for example, the chemical, pharmaceutical, petrochemical, and manufacturing industries. See 40 CFR 82.152
  • Industrial process shutdown: means when an industrial process or facility temporarily ceases to operate or manufacture whatever is being produced at that facility. See 40 CFR 82.152
  • Industrial user: Any nongovernmental, nonresidential user of a publicly owned treatment works which is identified in the Standard Industrial Classification Manual, 1972, Office of Management and Budget, as amended and supplemented, under one of the following divisions:

    Division A. See 40 CFR 35.2005

  • Infiltration: Water other than wastewater that enters a sewer system (including sewer service connections and foundation drains) from the ground through such means as defective pipes, pipe joints, connections, or manholes. See 40 CFR 35.2005
  • Inflow: Water other than wastewater that enters a sewer system (including sewer service connections) from sources such as, but not limited to, roof leaders, cellar drains, yard drains, area drains, drains from springs and swampy areas, manhole covers, cross connections between storm sewers and sanitary sewers, catch basins, cooling towers, storm waters, surface runoff, street wash waters, or drainage. See 40 CFR 35.2005
  • Information: means information about an individual and includes, but is not limited to, vital statistics. See 32 CFR 1701.2
  • Initial costs of operation: means any cost incurred in the first 60 months of an operation or expansion that met any of the following requirements:

    (1) Under generally accepted accounting principles or under accounting practices prescribed or permitted by State regulatory authority, was not a capital cost. See 42 CFR 417.911

  • Initial evaluation: means an immediate care and support assessment of the client's physical, psychosocial (including a screen for harm to self or others), and therapeutic needs related to the psychiatric illness and related conditions for which care is being furnished by the CMHC. See 42 CFR 485.902
  • Initial verification test: means those leak tests that are conducted after the repair is finished to verify that a leak or leaks have been repaired before refrigerant is added back to the appliance. See 40 CFR 82.152
  • Initiation of operation: The date specified by the grantee on which use of the project begins for the purpose for which it was planned, designed, and built. See 40 CFR 35.2005
  • Inpatient: means an individual who is admitted to a hospital for bed occupancy for purposes of receiving inpatient hospital services as described in §409. See 42 CFR 489.24
  • Inpatient hospital services: include services that are furnished either by the hospital directly or under arrangements made by the hospital with others. See 42 CFR 411.351
  • Inpatient psychiatric facilities: means hospitals that meet the requirements as specified in §§412. See 42 CFR 412.402
  • Insolvency: means a condition in which the liabilities of the debtor exceed the fair valuation of its assets. See 42 CFR 422.350
  • Institution of higher education: An educational institution that meets the criteria in section 1201(a) of the Higher Education Act of 1965 (20 U. See 32 CFR 22.105
  • Institutional provider: means any provider or supplier that submits a paper Medicare enrollment application using the CMS-855A, CMS-855B (not including physician and nonphysician practitioner organizations), CMS-855S, CMS-20134, or an associated Internet-based PECOS enrollment application. See 42 CFR 424.502
  • Institutionalized individual: means an individual who is (a) involuntarily confined or detained, under a civil or criminal statute, in a correctional or rehabilitative facility, including a mental hospital or other facility for the care and treatment of mental illness. See 42 CFR 441.251
  • Insurable interest annuity: means the recurring payments under CSRS to a retiree who has elected a reduction in annuity to provide a survivor annuity to a person with an insurable interest in the retiree. See 7 CFR 58.37
  • Insurance: means a health plan that provides, or pays the cost of Part D drugs, including, but not limited to, any of the following:

    (1) Health insurance coverage (as defined in 42 U. See 42 CFR 423.100

  • insured: refer to primary share or deposit insurance. See 43 CFR 2361.0-2
  • insured credit union: means a credit union whose accounts are insured by the National Credit Union Share Insurance Fund (NCUSIF). See 43 CFR 2545.2
  • insured depository institution: refers to any bank or savings association whose deposits are insured by the FDIC. See 42 CFR 493.1365
  • Intangible property and debt instruments: Property that includes, but is not limited to, trademarks, copyrights, patents and patent applications and such property as loans, notes and other debt instruments, lease agreements, stock and other instruments of property ownership, whether considered tangible or intangible. See 32 CFR 32.2
  • Interested party: means the President, the Vice President, an employee, a nominee or candidate as described in §2634. See 20 CFR 10.508
  • Interoperable: means able to communicate and exchange data accurately, effectively, securely, and consistently with different information technology systems, software applications, and networks, in various settings. See 42 CFR 411.351
  • Interrupted stay: means a stay at an inpatient rehabilitation facility during which a Medicare inpatient is discharged from the inpatient rehabilitation facility and returns to the same inpatient rehabilitation facility within 3 consecutive calendar days. See 42 CFR 412.602
  • Interstate commerce: means the distribution or transportation of any controlled substance between one state, territory, possession or the District of Columbia, and another state, territory, possession or the District of Columbia, or the sale, use or manufacture of any controlled substance in more than one state, territory, possession or District of Columbia. See 40 CFR 82.3
  • Intestine transplant center: means a Medicare-approved liver transplant center that performs intestine transplants, combined liver-intestine transplants, or multivisceral transplants. See 42 CFR 482.70
  • Intraday credit exposure: means credit exposure of a covered company to a counterparty that by its terms is to be repaid, sold, or terminated by the end of its business day in the United States. See 31 CFR 360.20
  • Intraday credit exposure: means credit exposure of a covered foreign entity to a counterparty that by its terms is to be repaid, sold, or terminated by the end of its business day in the United States. See 31 CFR 360.92
  • IRA: means an individual retirement account. See 31 CFR 347.3
  • IRA custodian: means an entity designated by Fiscal Service to act as a custodian for Roth IRAs opened by or on behalf of participants in Treasury's retirement savings program. See 31 CFR 347.3
  • Issuer: refers to the Government body or other entity that issues state or local government bonds described in section 103 of the Internal Revenue Code. See 31 CFR 344.1
  • Issuing agent: means an organization that has been qualified under 31 CFR part 317, and any other entity that is otherwise authorized to issue bonds. See 31 CFR 351.3
  • Issuing agent: means an organization that has been qualified under the provisions of Department of the Treasury Circular, Fiscal Service Series No. See 31 CFR 353.2
  • Issuing agent: means an organization that has been qualified under part 317. See 31 CFR 359.3
  • Issuing agent: means an organization that has been qualified under the provisions of Department of the Treasury Circular, Fiscal Service Series No. See 31 CFR 360.2
  • Labeler code: means the first segment of the Food and Drug Administration national drug code (NDC) that identifies a particular manufacturer. See 42 CFR 423.2305
  • Labor: means the process of childbirth beginning with the latent or early phase of labor and continuing through the delivery of the placenta. See 42 CFR 489.24
  • labor organization: means any lawful organization of any kind, or any employee representation group, which exists for the purpose, in whole or in part, of dealing with any Federal Reserve Bank concerning grievances, personnel policies and practices, or other matters affecting the working conditions of its employees, but the term shall not include any organization:

    (a) Which asserts the right to strike against the government of the United States, the Board of Governors of the Federal Reserve System, or any Federal Reserve Bank, or to assist or participate in any such strike, or which imposes a duty or obligation to conduct, assist or participate in any such strike. See 42 CFR 456.201

  • Laboratory: means an entity furnishing biological, microbiological, serological, chemical, immunohematological, hematological, biophysical, cytological, pathological, or other examination of materials derived from the human body for the purpose of providing information for the diagnosis, prevention, or treatment of any disease or impairment of, or the assessment of the health of, human beings. See 42 CFR 411.351
  • Leak inspection: means the examination of an appliance to determine the location of refrigerant leaks. See 40 CFR 82.152
  • Leak rate: means the rate at which an appliance is losing refrigerant, measured between refrigerant charges. See 40 CFR 82.152
  • Level of impairment: The disorder results in functional limitations in major life activities within the past 3 to 6 months that would be appropriate for the individual's developmental stage. See 42 CFR 483.102
  • Linked account: means an account that is a separate account from your primary account, but connected to your primary account. See 31 CFR 363.6
  • Loaded mileage: means the number of miles the Medicare beneficiary is transported in the ambulance vehicle. See 42 CFR 414.605
  • Local carrier: means an entity assigned by CMS to process and pay claims for administration of drugs and biologicals under the CAP. See 42 CFR 414.902
  • Location of use: means the geographic area (such as a state, region, or the entire United States) covered by an application for a critical use exemption in which the limiting critical condition may occur. See 40 CFR 82.3
  • Long-term care hospital prospective payment system payment year: means the general term that encompasses both the definition of "long-term care hospital prospective payment system rate year" and "long-term care hospital prospective payment system fiscal year" specified in this section. See 42 CFR 412.503
  • Long-term care network pharmacy: means a long-term care pharmacy that is a network pharmacy. See 42 CFR 423.100
  • Low-pressure appliance: means an appliance that uses a refrigerant with a liquid phase saturation pressure below 45 psia at 104 °F. See 40 CFR 82.152
  • MA organization: has the meaning given the term in 422. See 42 CFR 422.1002
  • Major counterparty: means any counterparty that is or includes:

    (1) A major covered company. See 31 CFR 360.20

  • Major counterparty: means any counterparty that is or includes:

    (1) A U. See 31 CFR 360.92

  • Major modification: means the modification of more than 50 percent, or more than 4,500 square feet, of the smoke compartment. See 42 CFR 483.5
  • Managing employee: means a general manager, business manager, administrator, director, or other individual that exercises operational or managerial control over, or who directly or indirectly conducts, the day-to-day operation of the provider or supplier, either under contract or through some other arrangement, whether or not the individual is a W-2 employee of the provider or supplier. See 42 CFR 424.502
  • Managing employee: means a general manager, business manager, administrator, director, or other individual that exercises operational or managerial control over, or who directly or indirectly conducts, the day-to-day operation of the institution, organization, or agency, either under contract or through some other arrangement, whether or not the individual is a W-2 employee. See 42 CFR 420.201
  • manufactured: means the date that the original equipment manufacturer has physically completed assembly of the component, the component is charged with refrigerant, and the component is ready for initial sale or distribution. See 40 CFR 82.302
  • Manufacturer: means any entity which is engaged in the production, preparation, propagation, compounding, conversion or processing of prescription drug products, either directly or indirectly, by extraction from substances of natural origin, or independently by means of chemical synthesis, or by a combination of extraction and chemical synthesis. See 42 CFR 423.2305
  • Manufacturer: means any entity that is engaged in the following (This term does not include a wholesale distributor of drugs or a retail pharmacy licensed under State law):

    (1) Production, preparation, propagation, compounding, conversion or processing of prescription drug products, either directly or indirectly by extraction from substances of natural origin, or independently by means of chemical synthesis, or by a combination of extraction and chemical synthesis. See 42 CFR 414.802

  • Margin call: means a demand by a creditor to a customer for a deposit of additional cash or securities to eliminate or reduce a margin deficiency as required under this part. See 42 CFR 435.229
  • Margin deficiency: means the amount by which the required margin exceeds the equity in the margin account. See 42 CFR 435.229
  • Margin equity security: means a margin security that is an equity security (as defined in section 3(a)(11) of the Act). See 42 CFR 435.229
  • Margin excess: means the amount by which the equity in the margin account exceeds the required margin. See 42 CFR 435.229
  • Marine bays and estuaries: Semi-enclosed coastal waters which have a free connection to the territorial sea. See 40 CFR 35.2005
  • Market basket index: means an index that reflects changes over time in the prices of an appropriate mix of goods and services included in covered skilled nursing services. See 42 CFR 413.333
  • Market Participant: means an entity that qualifies as a Market Participant under §35. See 42 CFR 412.163
  • Marketable Treasury security: refers to a Treasury bill, note, or bond that is negotiable and transferable, that is, may be bought and sold in the secondary market. See 31 CFR 363.6
  • Marriage: means a marriage recognized in law or equity under the whole law of the jurisdiction with the most significant interest in the marital status of the employee, Member, or retiree unless the law of that jurisdiction is contrary to the public policy of the United States. See 7 CFR 58.37
  • Maturity: means the date on which the mortgage indebtedness would be extinguished if paid in accordance with periodic payments provided for in the mortgage. See 24 CFR 203.251
  • Medicaid RAC program: means a recovery audit contractor program administered by a State to identify overpayments and underpayments and recoup overpayments. See 42 CFR 455.504
  • Medicare enrollee: means a Medicare beneficiary who has been identified on CMS records as an enrollee of an HMO or CMP that has a contract with CMS under section 1876 of the Act and subpart L of this part. See 42 CFR 417.401
  • Medicare enrollee: means a beneficiary under Part B of Medicare who has been identified on CMS records as an enrollee of the HCPP. See 42 CFR 417.800
  • Medicare Part D discount information: means the information sent from CMS or the TPA to the manufacturer along with each quarterly invoice that is derived from applicable data elements available on prescription drug events as determined by CMS. See 42 CFR 423.2305
  • Medium-pressure appliance: means an appliance that uses a refrigerant with a liquid phase saturation pressure between 45 psia and 170 psia at 104 °F. See 40 CFR 82.152
  • Member: means a Member of Congress. See 7 CFR 58.37
  • Mentally incompetent individual: means an individual who has been declared mentally incompetent by a Federal, State, or local court of competent jurisdiction for any purpose, unless the individual has been declared competent for purposes which include the ability to consent to sterilization. See 42 CFR 441.251
  • MEQC pilot: refers to the process used to implement the MEQC Program. See 42 CFR 431.804
  • Merger-related financial arrangement: means a material increase in compensation or benefits because of, or in anticipation of, a merger that any covered person of a merging credit union has received during the 24 months before the date the boards of directors of both credit unions approve the merger plan. See 43 CFR 2361.0-2
  • Merging credit union: means the credit union that will cease to exist as an operating credit union at the time of the merger. See 43 CFR 2361.0-2
  • Military Departments: as used in this part , refers to the Departments of the Army, the Navy, and the Air Force. See 32 CFR 67.2
  • Minimal value: means retail value in the United States at the time of acceptance of $285 or less as of January 1, 2002, and at 3-year intervals thereafter, as redefined in regulations prescribed by the Administrator of General Services, in consultation with the Secretary of State, to reflect changes in the consumer price index for the immediately preceding 3-year period. See 42 CFR 456.122
  • Minor: means an individual under the age of 18 years. See 31 CFR 363.6
  • Minor account: means an account that a custodian controls on behalf of a minor, that is linked to the custodian's primary account. See 31 CFR 363.6
  • Misappropriation of resident property: means the deliberate misplacement, exploitation, or wrongful, temporary, or permanent use of a resident's belongings or money without the resident's consent. See 42 CFR 483.5

  • Money market mutual fund: means any security issued by an investment company registered under section 8 of the Investment Company Act of 1940 (15 U. See 42 CFR 435.229
  • Montreal Protocol: means the Montreal Protocol on Substances that Deplete the Ozone Layer, a protocol to the Vienna Convention for the Protection of the Ozone Layer, including adjustments adopted by the Parties thereto and amendments that have entered into force. See 40 CFR 82.3
  • mortgage: means such a first lien upon real estate and other property as is commonly given to secure advances on, or the unpaid purchase price of, real estate under the laws of the State, district or territory in which the real estate is located, together with the credit instrument or instruments, if any, secured thereby. See 24 CFR 207.251
  • Mortgagee: means the original lender under a mortgage and its successors and such of its assigns as are approved by the Commissioner. See 24 CFR 203.251
  • mortgagee: means the original lender under a mortgage its successors and such of its assigns as are approved by the Commissioner, and includes the holders of the credit instruments issued under a trust indenture, mortgage or deed of trust pursuant to which such holders act by and through a trustee therein named.   • Motor vehicle air conditioners: means mechanical vapor compression refrigeration equipment used to cool the driver's or passenger's compartment of any motor vehicle. See 40 CFR 82.32
  • Motor vehicle disposal facility: means any commercial facility that engages in the disposal (which includes dismantling, crushing or recycling) of MVACs or MVAC-like appliances, including but not limited to automotive recycling facilities, scrap yards, landfills and salvage yards engaged in such operations. See 40 CFR 82.32
  • MSA: means a Metropolitan Statistical Area, as defined by the Executive Office of Management and Budget. See 42 CFR 412.503
  • MSA-dominant hospital: means a hospital that has discharged more than 25 percent of the total subsection (d) hospital Medicare discharges in the MSA (not including discharges paid by a Medicare Advantage plan) in which the hospital is located. See 42 CFR 412.503
  • Multiple Family Housing: RHS RRH loans, RCH loans, LH loans and grants, and RHS loans. See 25 CFR 162.361
  • Multiple source drug: means a drug described by section 1847A(c)(6)(C) of the Act. See 42 CFR 414.902
  • Municipality: A city, town, borough, county, parish, district, association, or other public body (including an intermunicipal agency of two or more of the foregoing entities) created under State law, or an Indian tribe or an authorized Indian tribal organization, having jurisdiction over disposal of sewage, industrial wastes, or other waste, or a designated and approved management agency under section 208 of the Act. See 40 CFR 35.2005
  • MVAC-like appliance: means a mechanical vapor compression, open-drive compressor appliance with a full charge of 20 pounds or less of refrigerant used to cool the driver's or passenger's compartment of off-road vehicles or equipment. See 40 CFR 82.152
  • National accrediting organization: means an organization that accredits provider or supplier entities under a specific program and whose accredited provider or supplier entities under each program are widely dispersed geographically across the United States. See 42 CFR 488.1005
  • National security exemption: means an exemption which may be granted under section 203(b)(1) of the Act for the purpose of national security. See 40 CFR 85.1702
  • NCUSIF: means the National Credit Union Share Insurance Fund as defined by 12 U. See 43 CFR 2201.3-1
  • Negative case: means an individual denied or terminated eligibility for Medicaid or CHIP by the State. See 42 CFR 431.804
  • Negotiated prices: means prices for covered Part D drugs that meet all of the following:

    (1) The Part D sponsor (or other intermediary contracting organization) and the network dispensing pharmacy or other network dispensing provider have negotiated as the amount such network entity will receive, in total, for a particular drug. See 42 CFR 423.100

  • Net annuity: means the net annuity as defined in §838. See 7 CFR 58.37
  • Net bond proceeds: The funds raised from the sale of the bonds minus issuance costs (e. See 40 CFR 35.3505
  • Net Worth: means (1) The retained earnings balance of the credit union at quarter-end as determined under generally accepted accounting principles, subject to paragraph (f)(3) of this section. See 43 CFR 2201.3-1
  • Net worth: means the excess of total assets over total liabilities, excluding fully subordinated debt or subordinated liabilities. See 42 CFR 422.350
  • Net worth ratio: means the ratio of the net worth of the credit union (as defined in paragraph (f) of this section) to the total assets of the credit union (as defined by a measure chosen under paragraph (j) of this section). See 43 CFR 2201.3-1
  • Network organization: The administrative governing body to the network and liaison to the Federal government. See 42 CFR 405.2102
  • Network pharmacy: means a licensed pharmacy that is under contract with a Part D sponsor to provide covered Part D drugs at negotiated prices to its Part D plan enrollees. See 42 CFR 423.100
  • New credit union: means a federally insured credit union which both has been in operation for less than ten (10) years and has $10,000,000 or less in total assets. See 43 CFR 2201.3-1
  • New measures: means those measures to be reported by competing HHAs under the HHVBP Model that are not otherwise reported by Medicare-certified HHAs to CMS and were identified to fill gaps to cover National Quality Strategy Domains not completely covered by existing measures in the home health setting. See 42 CFR 484.305
  • Newly constructed dwelling: One which:

    (1) Is financed with a section 502 insured loan. See 25 CFR 162.372

  • Newly insured institutions: A depository institution shall display the official sign no later than its twenty-first day of operation as an insured depository institution, unless the institution promptly requested the official sign from the Corporation, but did not receive it before that date. See 42 CFR 476.70
  • NFIP: means the National Flood Insurance Program authorized under the Act. See 42 CFR 480.138
  • Non-applicant: means an individual who is not seeking an eligibility determination for him or herself and is included in an applicant's or enrollee's household to determine eligibility for such applicant or enrollee. See 42 CFR 457.301
  • Non-equity security: means a security that is not an equity security (as defined in section 3(a)(11) of the Act). See 42 CFR 435.229
  • non-exempt substitutes: refers to all other substitutes and end-uses not so specified in §82. See 40 CFR 82.152
  • Non-Objection notice: means the privilege granted by the Administrator to import a specific individual shipment of used controlled substance in accordance with §§82. See 40 CFR 82.3
  • Non-preferred pharmacy: means a network pharmacy that offers covered Part D drugs at negotiated prices to Part D enrollees at higher cost-sharing levels than apply at a preferred pharmacy. See 42 CFR 423.100
  • Non-structural defect: A construction defect which does not affect the overall useful life, habitability, or structural integrity of the dwelling or unit. See 25 CFR 162.372
  • Nonbank financial company supervised by the Board: means a company that the Council has determined pursuant to section 113 of the Dodd-Frank Act shall be supervised by the Board and for which such determination is in effect. See 42 CFR 436.1003
  • Nonbank lender: means any person subject to the registration requirements of this part. See 42 CFR 435.831
  • Noncompliance: means any deficiency that causes a facility to not be in substantial compliance. See 42 CFR 488.301
  • Noncompliance: means any deficiency found at the condition-level or standard-level. See 42 CFR 488.705
  • Nonconforming vehicle or engine: A motor vehicle or motor vehicle engine which is not covered by a certificate of conformity prior to final or conditional importation and which has not been finally admitted into the United States under the provisions of §85. See 40 CFR 85.1502
  • Nonexempted security: means any security other than an exempted security (as defined in section 3(a)(12) of the Act). See 42 CFR 435.229
  • Nongovernmental organization: means an organization that works at the local level to solve development problems in a foreign country in which the organization is located, except that the term does not include an organization that is primarily an agency or instrumentality of the government of the foreign country. See 31 CFR 380.1
  • Normal operating characteristics and conditions: means appliance operating temperatures, pressures, fluid flows, speeds, and other characteristics, including full charge of the appliance, that would be expected for a given process load and ambient condition during normal operation. See 40 CFR 82.152
  • norms: means numerical or statistical measures of usually observed performance. See 42 CFR 456.51
  • norms: means numerical or statistical measures of usually observed performance. See 42 CFR 456.151
  • Notice of assessment: means the notice in which the Board informs a company that it is an assessed company and states the assessed company's total assessable assets and the amount of its assessment. See 42 CFR 436.1003
  • Notification: means communication to an individual whether he is a subject individual. See 32 CFR 1701.2
  • Nurse aide: A nurse aide is any individual providing nursing or nursing-related services to residents in a facility. See 42 CFR 483.5
  • Nurse aide: means an individual, as defined in §483. See 42 CFR 488.301
  • Nurse practitioner: means a registered professional nurse who is currently licensed to practice in the State, who meets the State's requirements governing the qualifications of nurse practitioners, and who meets one of the following conditions:

    (1) Is currently certified as a primary care nurse practitioner by the American Nurses' Association or by the National Board of Pediatric Nurse Practitioners and Associates. See 42 CFR 491.2

  • Obligation: means any debt or duty to pay money owed to the FDIC or a failed institution, including any guarantee of any such debt or duty. See 42 CFR 482.76
  • Obligations: The amounts of orders placed, contracts and grants awarded, services received and similar transactions during a given period that require payment by the recipient during the same or a future period. See 32 CFR 32.2
  • Obligations: means the amounts of orders placed, contracts and subgrants awarded, goods and services received, and similar transactions during a given period that will require payment by the grantee during the same or a future period. See 32 CFR 33.3

  • One-time expansion device: means an appliance that relies on the release of its refrigerant charge to the environment in order to provide a cooling effect. See 40 CFR 82.152
  • Online: means use of the Internet. See 31 CFR 363.6
  • Operation and Maintenance: Activities required to assure the dependable and economical function of treatment works. See 40 CFR 35.2005
  • Operational: means the provider or supplier has a qualified physical practice location, is open to the public for the purpose of providing health care related services, is prepared to submit valid Medicare claims, and is properly staffed, equipped, and stocked (as applicable, based on the type of facility or organization, provider or supplier specialty, or the services or items being rendered), to furnish these items or services. See 42 CFR 424.502
  • Or otherwise: means through a government-funded health program. See 42 CFR 423.100
  • Organ: means a human kidney, liver, heart, lung, pancreas, or intestine (or multivisceral organs when transplanted at the same time as an intestine). See 42 CFR 486.302
  • Organized Wholesale Electric Market: includes an independent system operator and a regional transmission organization. See 42 CFR 412.163
  • original maturity: refers to the initial maturity period of a bond prior to any extensions of maturity. See 31 CFR 351.3
  • OTC margin stock: means any equity security traded over the counter that the Board has determined has the degree of national investor interest, the depth and breadth of market, the availability of information respecting the security and its issuer, and the character and permanence of the issuer to warrant being treated like an equity security treaded on a national securities exchange. See 42 CFR 435.229
  • Other disclosing entity: means any other Medicare disclosing entity and any entity that does not participate in Medicare, but is required to disclose certain ownership and control information because of participation in any of the programs established under title V, XIX, or XX of the Act. See 42 CFR 420.201
  • Other health or prescription drug coverage: means any coverage or financial assistance under other health benefit plans or programs that provide coverage or financial assistance for the purchase or provision of prescription drug coverage on behalf of applicable beneficiaries, including, in the case of employer group health or waiver plans, other than basic prescription drug coverage as defined in §423. See 42 CFR 423.2305
  • Other models: means methods, other than an agency-provider model or the self-directed model with service budget, for the provision of self-directed services and supports, as approved by CMS. See 42 CFR 441.505
  • Other prescriber: means a health care professional other than a physician who is authorized under State law or other applicable law to write prescriptions. See 42 CFR 423.560
  • our: refers to the Bureau of the Fiscal Service. See 31 CFR 363.6
  • our: refers to the agency, the Bureau of the Fiscal Service. See 31 CFR 351.3
  • our: refers to the agency, the Bureau of the Fiscal Service. See 31 CFR 359.3
  • Out-of-network pharmacy: means a licensed pharmacy that is not under contract with a Part D sponsor to provide negotiated prices to Part D plan enrollees. See 42 CFR 423.100
  • Outcomes: means changes in patient health, functional status, satisfaction or goal achievement that result from health care or supportive services. See 42 CFR 438.320
  • Outlier payment: means an additional payment beyond the Federal per diem payment amount for cases with unusually high costs. See 42 CFR 412.402
  • Outlier payment: means an additional payment beyond the long-term care hospital standard Federal payment rate or the site neutral payment rate (including, when applicable, the blended payment rate), as applicable, for cases with unusually high costs. See 42 CFR 412.503
  • Outpatient prescription drugs: means all drugs covered by Medicare Part B or D, except for those drugs that are "covered ancillary services" as defined at §416. See 42 CFR 411.351
  • Overpayment: means the amount paid by a Medicaid agency to a provider which is in excess of the amount that is allowable for services furnished under section 1902 of the Act and which is required to be refunded under section 1903 of the Act. See 42 CFR 433.304
  • Owner: means any individual or entity that has any partnership interest in, or that has 5 percent or more direct or indirect ownership of the provider or supplier as defined in sections 1124 and 1124A(A) of the Act. See 42 CFR 424.502
  • Ownership interest: means the possession of equity in the capital, the stock, or the profits of the disclosing entity. See 42 CFR 420.201
  • Pancreas transplant center: means a Medicare-approved kidney transplant center that performs pancreas transplants alone or subsequent to a kidney transplant as well as kidney-pancreas transplants. See 42 CFR 482.70
  • Par: means the principal amount of a Series I savings bond. See 31 CFR 359.3
  • Parent company: means an individual, corporation, partnership, association, joint-stock company, or an unincorporated organization that can direct or cause the direction of management and policies of another entity, through the ownership of shares or otherwise. See 40 CFR 82.152
  • Part D sponsor: has the meaning given the term in 423. See 42 CFR 423.1002
  • Partial extended survey: means a survey conducted to determine if deficiencies and/or deficient practice(s) exist that were not fully examined during the standard survey. See 42 CFR 488.705
  • Partially reduced annuity: means the recurring payments under CSRS to a retiree who has elected less than the maximum allowable reduction in annuity to provide a current spouse annuity or a former spouse annuity. See 7 CFR 58.37
  • Participant: means an individual who has an IRA in Treasury's retirement savings program or in a state Auto-IRA program. See 31 CFR 347.3
  • Participating CAP physician: means a physician electing to participate in the CAP, as described in this subpart. See 42 CFR 414.902
  • party: means the affected party or CMS, as appropriate. See 42 CFR 423.1002
  • Party: means a foreign state that has deposited instruments of ratification, acceptance, or other form of approval with the Directorate of the United Nations Secretariat, evidencing the foreign state's ratification of the provisions of the 1987 Montreal Protocol, the London Amendment, the Copenhagen Amendment, or the Beijing Amendment, as specified. See 40 CFR 82.3
  • Patient assessment instrument: refers to a document that contains clinical, demographic, and other information on a patient. See 42 CFR 412.602
  • Patient care services: means any task(s) performed by a physician in the group practice that address the medical needs of specific patients or patients in general, regardless of whether they involve direct patient encounters or generally benefit a particular practice. See 42 CFR 411.351
  • Patient volume: means the minimum participation threshold (as described at §495. See 42 CFR 495.302
  • Paying agent: means a financial institution that has been qualified under 31 CFR part 321. See 31 CFR 351.3
  • Paying agent: means a financial institution that has been qualified under the provisions of Department of the Treasury Circular No. See 31 CFR 353.2
  • Paying agent: means a financial institution that has been qualified under the provisions of Department of the Treasury Circular No. See 31 CFR 360.2
  • Payment: means redemption, unless otherwise indicated by context. See 31 CFR 353.2

  • Payment: An action taken by EPA to increase the amount of funds available for cash draw through the ACH. See 40 CFR 35.3505
  • Payment adjustment: means the amount by which a competing HHA's final claim payment amount under the HH PPS is changed in accordance with the methodology described in §484. See 42 CFR 484.305
  • Payment period: means the number of business days in the standard securities settlement cycle in the United States, as defined in paragraph (a) of SEC Rule 15c6-1 (17 CFR 240. See 42 CFR 435.229
  • Payments: The mortgage shall:

    (1) Come due on the first of the month. See 24 CFR 203.17

  • Payroll savings plan: is a method for the purchase of savings bonds using periodic ACH credits from your employer or financial institution to purchase a payroll zero-percent certificate of indebtedness until a sufficient amount of payroll zero-percent certificate of indebtedness is accumulated to enable the purchase of a savings bond in an amount, series, and registration that you previously selected using functionality in your TreasuryDirect account. See 31 CFR 363.6
  • Payroll zero-percent certificate of indebtedness: is a restricted form of the zero-percent certificate of indebtedness that is held separately from the zero-percent certificate of indebtedness and used only for purchases made through the payroll savings plan. See 31 CFR 363.6
  • Per instance: means a single event of noncompliance identified and corrected through a survey, for which the statute authorizes CMS to impose a sanction. See 42 CFR 488.805
  • Percentage of completion method: refers to a system under which payments are made for construction work according to the percentage of completion of the work, rather than to the grantee's cost incurred. See 32 CFR 33.3
  • Performance period: means the calendar year that will be used to assess the quality of care furnished compared to cost. See 42 CFR 414.1205
  • Person: means any individual or legal entity, including an individual, corporation, partnership, association, state, municipality, political subdivision of a state, Indian tribe. See 40 CFR 82.3
  • Person: means any individual or legal entity, including an individual, corporation, partnership, association, state, municipality, political subdivision of a state, Indian tribe, and any agency, department, or instrumentality of the United States, and any officer, agent, or employee thereof. See 40 CFR 82.152
  • Person: means an individual, or an entity with a legally independent existence, including: A trustee. See 42 CFR 482.76

  • Person: means an entity including an individual, trust, estate, corporation, government entity, association, partnership, and any other similar organization. See 31 CFR 359.3
  • Person: means a legal entity including an individual or fiduciary estate. See 31 CFR 360.2
  • Person: means an individual or an entity. See 31 CFR 363.6
  • Person: means any legal entity, foreign or domestic, including a corporation, unincorporated company, partnership, government unit or instrumentality, trust, natural person, or any other entity or organization. See 42 CFR 435.906
  • Person with an ownership or control interest: means a person or corporation that--

    (1) Has an ownership interest totaling 5 percent or more in a disclosing entity. See 42 CFR 420.201

  • Person-centered care: For purposes of this subpart, person-centered care means to focus on the resident as the locus of control and support the resident in making their own choices and having control over their daily lives. See 42 CFR 483.5
  • Personal property: Property of any kind except real property. See 32 CFR 32.2
  • Personal property: Property of any kind except real property. See 32 CFR 34.2
  • Physician: has the meaning given the term in section 1861(r) of the Act. See 42 CFR 423.560
  • Physician: means a doctor of medicine or osteopathy, a doctor of dental surgery or dental medicine, a doctor of podiatric medicine, a doctor of optometry, or a chiropractor, as defined in section 1861(r) of the Act. See 42 CFR 411.351
  • physician: means a doctor of medicine or osteopathy who is licensed to practice in the State. See 42 CFR 441.201
  • Physician: has the meaning given the term in section 1861(r) of the Act. See 42 CFR 422.561
  • Physician: means the following:

    (1) As it pertains to the supervision, collaboration, and oversight requirements in sections 1861(aa)(2)(B) and (aa)(3) of the Act, a doctor of medicine or osteopathy legally authorized to practice medicine or surgery in the State in which the function is performed. See 42 CFR 491.2

  • Physician assistant: means a person who meets the applicable State requirements governing the qualifications for assistants to primary care physicians, and who meets at least one of the following conditions:

    (1) Is currently certified by the National Commission on Certification of Physician Assistants to assist primary care physicians. See 42 CFR 491.2

  • Physician in the group practice: means a member of the group practice, as well as an independent contractor physician during the time the independent contractor is furnishing patient care services (as defined in this section) for the group practice under a contractual arrangement directly with the group practice to provide services to the group practice's patients in the group practice's facilities. See 42 CFR 411.351
  • Physician incentive plan: means any compensation arrangement between an entity (or downstream contractor) and a physician or physician group that may directly or indirectly have the effect of reducing or limiting services furnished with respect to individuals enrolled with the entity. See 42 CFR 411.351
  • Physician or nonphysician practitioner organization: means any physician or nonphysician practitioner entity that enrolls in the Medicare program as a sole proprietorship or organizational entity. See 42 CFR 424.502
  • Physician organization: means a physician, a physician practice, or a group practice that complies with the requirements of §411. See 42 CFR 411.351
  • Physician Quality Reporting System: means the system established under section 1848(k) of the Act. See 42 CFR 414.1205
  • Plan allowance: means the amount Part D plans that offer coverage other than defined standard coverage may use to determine their payment and Part D enrollees' cost-sharing for covered Part D drugs purchased at an out-of-network pharmacy or in a physician's office in accordance with the requirements of §423. See 42 CFR 423.100
  • Plan of care: means the establishment by a physician of a course of diagnosis or treatment (or both) for a particular patient, including the ordering of services. See 42 CFR 411.351
  • Plan of correction: means a plan developed by the facility and approved by CMS or the survey agency that describes the actions the facility will take to correct deficiencies and specifies the date by which those deficiencies will be corrected. See 42 CFR 488.401
  • Plan of correction: means a plan developed by the HHA and approved by CMS that is the HHA's written response to survey findings detailing corrective actions to cited deficiencies and specifies the date by which those deficiencies will be corrected. See 42 CFR 488.805
  • Plant: means one or more facilities at the same location owned by or under common control of the same person. See 40 CFR 82.3
  • Point of pick-up: means the location of the beneficiary at the time he or she is placed on board the ambulance. See 42 CFR 414.605
  • Power of attorney: means any written documents by which a principal authorizes an agent to--

    (1) Receive, in the agent's name, any payments due the principal. See 42 CFR 424.71

  • Practice before the Board: includes any matters connected with presentations to the Board or to any of its officers or employees relating to a client's rights, privileges or liabilities under laws or regulations administered by the Board. See 31 CFR 375.11
  • Practices predominantly: means an EP for whom the clinical location for over 50 percent of his or her total patient encounters over a period of 6 months (within the most recent calendar year or, as an optional State alternative beginning for payment year 2013, within the 12-month period preceding attestation)occurs at a federally qualified health center or rural health clinic. See 42 CFR 495.302
  • Pre-certification vehicle: means an uncertified vehicle which a manufacturer employs in fleets from year to year in the ordinary course of business for product development, production method assessment, and market promotion purposes, but in a manner not involving lease or sale. See 40 CFR 85.1702
  • Pre-certification vehicle engine: means an uncertified heavy-duty engine owned by a manufacturer and used in a manner not involving lease or sale in a vehicle employed from year to year in the ordinary course of business for product development, production method assessment and market promotion purposes. See 40 CFR 85.1702
  • Pre-charged appliance: means any appliance charged with refrigerant prior to sale or distribution, or offer for sale or distribution in interstate commerce. See 40 CFR 82.302
  • Pre-charged appliance component: means any portion of an appliance including but not limited to condensers, compressors, line sets, and coils that is charged with refrigerant prior to sale or distribution or offer for sale or distribution in interstate commerce. See 40 CFR 82.302
  • Preclusion list: means a CMS compiled list of prescribers who--

    (1) Meet all of the following requirements:

    (i) The prescriber is currently revoked from the Medicare program under §424. See 42 CFR 423.100

  • Preferred drug: means a covered Part D drug on a Part D plan's formulary for which beneficiary cost-sharing is lower than for a non-preferred drug in the plan's formulary. See 42 CFR 423.100
  • Preferred pharmacy: means a network pharmacy that offers covered Part D drugs at negotiated prices to Part D enrollees at lower levels of cost-sharing than apply at a non-preferred pharmacy under its pharmacy network contract with a Part D plan. See 42 CFR 423.100
  • Prescription order: means a written order submitted by the participating CAP physician to the approved CAP vendor that meets the requirements of this subpart. See 42 CFR 414.902
  • Present value factor: means the amount of money (earning interest at an assumed rate) required at the time of annuity commencement to fund an annuity that starts at the rate of $1 a month and is payable in monthly installments for the annuitant's lifetime based on mortality rates for annuitants paid from the Civil Service Retirement and Disability Fund. See 7 CFR 58.37
  • Primary account: means the account that you establish when you first open your TreasuryDirect account. See 31 CFR 363.6
  • Primary owner: means the first person named in the registration of a security held in TreasuryDirect registered, e. See 31 CFR 363.6
  • Principal amount: means the amount of the original investment. See 31 CFR 351.3
  • Principal amount: means the amount of the original investment. See 31 CFR 359.3
  • Principal amount: means the amount of the original investment. See 31 CFR 363.6
  • Principal diagnosis: means the condition established after study to be chiefly responsible for occasioning the admission of the patient to the inpatient psychiatric facility. See 42 CFR 412.402
  • Principal residence: For the purposes of §35. See 40 CFR 35.2005
  • Prior approval: Written approval by an authorized official evidencing prior consent. See 32 CFR 32.2
  • Prior approval: means documentation evidencing consent prior to incurring specific cost. See 32 CFR 33.3
  • Prior approval: Written or electronic approval by an authorized official evidencing prior consent. See 32 CFR 34.2
  • Priority water quality areas: For the purposes of §35. See 40 CFR 35.2005
  • private nonprofit organization: is a corporation which: is owned and controlled by private persons. See 25 CFR 162.209
  • Private voluntary organization: means a not-for-profit, nongovernmental organization (in the case of a United States organization, an organization that is exempt from Federal income taxes under section 501(c)(3) of the Internal Revenue Code of 1986) that receives funds from private sources, voluntary contributions of money, staff time, or in-kind support from the public, and that is engaged in or is planning to engage in voluntary, charitable, or development assistance activities (other than religious activities). See 31 CFR 380.1
  • Process stub: means a length of tubing that provides access to the refrigerant inside a small appliance or room air conditioner and that can be resealed at the conclusion of repair or service. See 40 CFR 82.152
  • Product: means an item or category of items manufactured from raw or recycled materials which is used to perform a function or task. See 40 CFR 82.302
  • Production: means the manufacture of a controlled substance from any raw material or feedstock chemical, but does not include:

    (1) The manufacture of a controlled substance that is subsequently transformed. See 40 CFR 82.3

  • Production allowances: means the privileges granted by this subpart to produce controlled substances. See 40 CFR 82.3
  • Professional courtesy: means the provision of free or discounted health care items or services to a physician or his or her immediate family members or office staff. See 42 CFR 411.351
  • Program income: Gross income earned by the recipient that is directly generated by a supported activity or earned as a result of the award (see exclusions in §32. See 32 CFR 32.2
  • Program income: Gross income earned by the recipient that is directly generated by a supported activity or earned as a result of the award. See 32 CFR 34.2
  • Program income: means interest earned on proceeds from the sale of donated commodities, as well as funds received by a recipient or subrecipient as a direct result of carrying out an approved activity under an agreement. See 31 CFR 380.1
  • Project: The activities or tasks the Regional Administrator identifies in the grant agreement for which the grantee may expend, obligate or commit funds. See 40 CFR 35.2005
  • Project: means the totality of the activities to be carried out by a recipient, directly or through a subrecipient, to fulfill the objectives of an agreement. See 31 CFR 380.1
  • Project costs: All allowable costs, as set forth in the applicable Federal cost principles, incurred by a recipient and the value of the contributions made by third parties in accomplishing the objectives of the award during the project period. See 32 CFR 32.2
  • Project costs: All allowable costs, as set forth in the applicable Federal cost principles, incurred by a recipient and the value of the contributions made by third parties in accomplishing the objectives of the award during the project period. See 32 CFR 34.2
  • Project performance standards: The performance and operations requirements applicable to a project including the enforceable requirements of the Act and the specifications, including the quantity of excessive infiltration and inflow proposed to be eliminated, which the project is planned and designed to meet. See 40 CFR 35.2005
  • Project period: The period established in the award document during which Federal sponsorship begins and ends. See 32 CFR 32.2

  • Project schedule: A timetable specifying the dates of key project events including public notices of proposed procurement actions, subagreement awards, issuance of notice to proceed with building, key milestones in the building schedule, completion of building, initiation of operation and certification of the project.   • Properly using: (1) Properly using means using equipment in conformity with the regulations set forth in this subpart, including but not limited to the prohibitions and required practices set forth in §82. See 40 CFR 82.32
  • Property: Real property and personal property (equipment, supplies, intangible property and debt instruments), unless stated otherwise. See 32 CFR 32.2
  • Property: Real property and personal property (equipment, supplies, and intellectual property), unless stated otherwise. See 32 CFR 34.2
  • provider: includes a hospital (as described in part 482 of this chapter), hospice program (as described in §418. See 42 CFR 405.1801
  • Provider-related donation: means a donation or other voluntary payment (in cash or in kind) made directly or indirectly to a State or unit of local government by or on behalf of a health care provider, an entity related to such a health care provider, or an entity providing goods or services to the State for administration of the State's Medicaid plan. See 42 CFR 433.52
  • Providers: In order to be paid for covered services furnished to Medicare beneficiaries, a provider must file a cost report with its contractor as specified in §413. See 42 CFR 405.1801
  • Public agency: means a State, county, city or other type of municipal agency, including a public school district, transportation district, irrigation district, or any other type of public entity. See 42 CFR 457.301
  • Public entity: means the 50 states, Puerto Rico, Guam, the Virgin Islands, the Northern Mariana Islands and American Samoa and their political subdivisions, the District of Columbia, and any agency or instrumentality of the foregoing, and political subdivisions include counties, parishes, townships, cities, municipalities, towns, villages, and incorporated villages. See 42 CFR 417.150
  • public nonprofit organization: is a nonprofit corporation other than a private nonprofit corporation, including a municipal corporation or other corporate agency of a State or local government. See 25 CFR 162.209
  • Public water system: A system as defined in 40 CFR 141. See 40 CFR 35.3505
  • Purpose credit: means credit for the purpose of:

    (1) Buying, carrying, or trading in securities. See 42 CFR 435.229

  • Qualified actuary: means a member in good standing of the American Academy of Actuaries or a person recognized by the Academy as qualified for membership, or a person who has otherwise demonstrated competency in the field of actuarial determination and is satisfactory to CMS. See 42 CFR 422.350
  • Qualified blind trust: means a trust in which the interested party has a beneficial interest and which:

    (1) Is certified pursuant to §2634. See 20 CFR 10.508

  • Qualified diversified trust: means a trust in which the interested party has a beneficial interest and which:

    (1) Is certified pursuant to §2634. See 20 CFR 10.508

  • Qualified entity: means an entity that is determined by the State to be capable of making determinations of presumptive eligibility for children, and that--

    (1) Furnishes health care items and services covered under the approved plan and is eligible to receive payments under the approved plan. See 42 CFR 457.301

  • Qualified HMO: means an HMO that has in effect a determination, made under subpart D of this part, that the HMO is an operational, preoperational, or transitional qualified HMO. See 42 CFR 417.150
  • Qualified prescription drug coverage: means any standard prescription drug coverage or alternative prescription drug coverage

    Required prescription drug coverage means coverage of Part D drugs under an MA-PD plan that consists of either--

    (1) Basic prescription drug coverage. See 42 CFR 423.100

  • Qualified trust: means a trust described in the Ethics in Government Act of 1978 and this part and certified by the Director under this subpart. See 20 CFR 10.508
  • Qualifying court order: means a court order that awards a former spouse annuity and that satisfies the requirements of section 8341(h) of title 5, United States Code, for awarding a former spouse annuity. See 7 CFR 58.37
  • Qualifying emergency department: means an emergency department that is staffed and equipped to furnish a comprehensive array of emergency services and meeting the definitions of a dedicated emergency department as specified in §489. See 42 CFR 412.402
  • Qualifying MA EP: means all of the following:

    (1) A physician (as described in section 1861(r) of the Act), including a doctor of medicine or osteopathy who is either of the following:

    (i) Employed by a qualifying MA organization. See 42 CFR 495.200

  • Qualifying MA organization: means a MA organization that is organized as a health maintenance organization (HMO) as defined in section 2791(b)(3) of the Public Health Service (PHS) Act which includes a Federally qualified HMO, an organization recognized as an HMO under State law, or a similar organization regulated for solvency under State law in the same manner and to the same extent as an HMO. See 42 CFR 495.200
  • Qualifying plan: means a full-risk or limited-risk prescription drug plan, as defined in §423. See 42 CFR 423.855
  • Quality: means the combination of the inherent properties or attributes of a product which determines its relative degree of excellence. See 7 CFR 51.2
  • Quarter-end balance: The quarter-end balance of the calendar quarter as reported on the credit union's Call Report. See 43 CFR 2201.3-1
  • Radiology and certain other imaging services: means those particular services so identified on the List of CPT/HCPCS Codes. See 42 CFR 411.351
  • Re-certification cycle: means the 4-year cycle during which an OPO is certified. See 42 CFR 486.302
  • Real property: Land, including land improvements, structures and appurtenances thereto, but excluding movable machinery and equipment. See 32 CFR 32.2
  • Real property: means land, including land improvements, structures and appurtenances thereto, excluding movable machinery and equipment. See 32 CFR 33.3

  • Reasons of business confidentiality: include the concept of trade secrecy and other related legal concepts which give (or may give) a business the right to preserve the confidentiality of business information and to limit its use or disclosure by others in order that the business may obtain or retain business advantages it derives from its rights in the information. See 40 CFR 2.201
  • Recipient: An organization receiving financial assistance directly from DoD Components to carry out a project or program. See 32 CFR 32.2
  • Recipient: A for-profit organization receiving an award directly from a DoD Component to carry out a project or program. See 32 CFR 34.2
  • Recipient: means the person to whom a gift is given. See 31 CFR 363.6
  • Recipient: means an entity that enters into an agreement with CCC and receives donated commodities and CCC-provided funds to carry out activities under the agreement. See 31 CFR 380.1
  • Reclaim: means to reprocess recovered refrigerant to all of the specifications in appendix A of this subpart (based on AHRI Standard 700-2016, Specifications for Refrigerants) that are applicable to that refrigerant and to verify that the refrigerant meets these specifications using the analytical methodology prescribed in section 5 of appendix A of this subpart. See 40 CFR 82.152
  • Reconsideration: means a review of an adverse coverage determination or at-risk determination by an independent review entity (IRE), the evidence and findings upon which it was based, and any other evidence the enrollee submits or the IRE obtains. See 42 CFR 423.560
  • Record: means any item, collection, or grouping of information about an individual that is maintained by the ODNI including, but not limited to, information such as an individual's education, financial transactions, medical history, and criminal or employment history that contains the individual's name, or an identifying number, symbol, or any other identifier assigned to an individual. See 32 CFR 1701.2
  • Record date: means a date announced by the board of directors of a merging credit union as the date by which a person must have been a member of the merging credit union to be eligible to vote on a proposed merger. See 43 CFR 2361.0-2
  • Recoupment: means any formal action by the State or its fiscal agent to initiate recovery of an overpayment without advance official notice by reducing future payments to a provider. See 42 CFR 433.304
  • Recover: means to remove refrigerant in any condition from an appliance and to store it in an external container without necessarily testing or processing it in any way. See 40 CFR 82.152
  • Recovery efficiency: means the percentage of refrigerant in an appliance that is recovered by a piece of recovery and/or recycling equipment. See 40 CFR 82.152
  • Redemption of a savings bond: refers to the payment of principal and interest at final maturity, or prior to final maturity at the option of the owner. See 31 CFR 363.6
  • Redemption value: means principal plus accrued interest of a Series EE savings bond, as of the date of potential or actual redemption. See 31 CFR 351.3
  • Redemption value: means principal plus accrued interest of a bond, or a portion of the principal plus a proportionate amount of accrued interest on the bond, as of the date of redemption. See 31 CFR 363.6
  • Redetermination: means a review of an adverse coverage determination or at-risk determination by a Part D plan sponsor, the evidence and findings upon which it is based, and any other evidence the enrollee submits or the Part D plan sponsor obtains. See 42 CFR 423.560
  • Referring physician: means a physician who makes a referral as defined in this section or who directs another person or entity to make a referral or who controls referrals made by another person or entity. See 42 CFR 411.351
  • Refrigerant: means any class I or class II substance used in a motor vehicle air conditioner. See 40 CFR 82.32
  • Refrigerant circuit: means the parts of an appliance that are normally connected to each other (or are separated only by internal valves) and are designed to contain refrigerant. See 40 CFR 82.152
  • Regional Director: means either the director for the NCUA Regional Office for the region where a natural person credit union's main office is located or the director of the NCUA's Office of Credit Union Resources and Expansion. See 43 CFR 2361.0-2
  • Registered: means that the name and taxpayer identification number(s) (TIN) of the person(s) named on the security are maintained on our records. See 31 CFR 363.6
  • Registration: means that the names of all persons named on the bond and the taxpayer identification number (TIN) of the owner, first-named coowner, or purchaser of a gift bond are maintained on our records. See 31 CFR 351.3
  • Registration: means that the names of all persons named on the bond and the taxpayer identification number (TIN) of the owner, first-named coowner, or purchaser of a gift bond are maintained on our records. See 31 CFR 353.2
  • Registration: means that the names of all persons named on the bond and the taxpayer identification number (TIN) of the owner, first-named coowner, or purchaser of a gift bond are maintained on our records. See 31 CFR 359.3
  • Registration: means that the names of all persons named on the bond and the taxpayer identification number (TIN) of the owner, first-named coowner, or purchaser of a gift bond are maintained on our records. See 31 CFR 360.2
  • Reinvestment: means using the redemption proceeds of a maturing marketable security to purchase a new marketable security of the same type and term, using the automatic reinvestment option available in TreasuryDirect. See 31 CFR 363.6
  • Reissue: means the cancellation and retirement of a bond and the issuance of a new bond or bonds of the same series, same issue date, and same total face amount. See 31 CFR 353.2
  • Reissue: means the cancellation and retirement of a bond and the issuance of a new bond or bonds of the same series, same issue date, and same total face amount. See 31 CFR 360.2
  • Remote Service Facility: includes any automated teller machine, cash dispensing machine, point-of-sale terminal, or other remote electronic facility where deposits are received. See 42 CFR 476.70
  • Remuneration: means any payment or other benefit made directly or indirectly, overtly or covertly, in cash or in kind, except that the following are not considered remuneration for purposes of this section:

    (1) The forgiveness of amounts owed for inaccurate tests or procedures, mistakenly performed tests or procedures, or the correction of minor billing errors. See 42 CFR 411.351

  • Replacement: Obtaining and installing equipment, accessories, or appurtenances which are necessary during the design or useful life, whichever is longer, of the treatment works to maintain the capacity and performance for which such works were designed and constructed. See 40 CFR 35.2005
  • Reporting period: means the period specified by CMS for which an HCPP must report its costs and utilization. See 42 CFR 417.800
  • Representative: means an individual who has the authority under State law to authorize or terminate medical care on behalf of a client who is mentally or physically incapacitated. See 42 CFR 485.902
  • Representative: means an individual appointed by an enrollee or other party, or authorized under State or other applicable law, to act on behalf of an enrollee or other party involved in the grievance or appeal. See 42 CFR 422.561
  • Requirements: In addition to meeting the requirements of specified in the definition of "distinct part" of this section, a composite distinct part must meet all of the following requirements:

    (i) A SNF or NF that is a composite of more than one location will be treated as a single distinct part of the institution of which it is a distinct part. See 42 CFR 483.5

  • Research: Basic, applied, and advanced research, as defined in this section. See 32 CFR 22.105
  • Research: Basic, applied, and advanced research activities. See 32 CFR 34.2
  • Research and development: All research activities, both basic and applied, and all development activities that are supported at universities, colleges, and other non-profit institutions. See 32 CFR 32.2
  • resident: is synonymous with the terms intern and fellow. See 42 CFR 415.152
  • Resident classification system: means a system for classifying SNF residents into mutually exclusive groups based on clinical, functional, and resource-based criteria. See 42 CFR 413.333
  • Resident representative: For purposes of this subpart, the term resident representative means any of the following:

    (1) An individual chosen by the resident to act on behalf of the resident in order to support the resident in decision-making. See 42 CFR 483.5

  • Residential improved real estate: means real estate upon which a home or other residential building is located or to be located. See 42 CFR 480.138
  • Retail pharmacy: means any licensed pharmacy that is open to dispense prescription drugs to the walk-in general public from which Part D enrollees could purchase a covered Part D drug without being required to receive medical services from a provider or institution affiliated with that pharmacy. See 42 CFR 423.100
  • Retiree: as used in this subpart , does not include a current spouse, former spouse, child, or person with an insurable interest receiving a survivor annuity. See 7 CFR 58.37
  • Retrofit: means to convert an appliance from one refrigerant to another refrigerant. See 40 CFR 82.152
  • return to work: as used in this subpart is not limited to returning to work at the employee's normal worksite or usual position, but may include returning to work at other locations and in other positions. See 20 CFR 10.505
  • Reviewing entity: means the contractor hearing officer(s), a CMS reviewing official, the Board, or the Administrator. See 42 CFR 405.1801
  • Rider: means a notice issued by a Surety that a change in the bond has occurred or will occur. See 42 CFR 489.60
  • Risk contract: means a Medicare contract under which CMS pays the HMO or CMP on a risk basis for Medicare covered services. See 42 CFR 417.401
  • Risk score: means the beneficiary risk score derived from the CMS Hierarchical Condition Categories (HCC) model. See 42 CFR 414.1205
  • Roth IRA: means an individual retirement account defined under 26 U. See 31 CFR 347.3
  • Routine care items and services: refers to items and services that are otherwise generally available to Medicare beneficiaries (that is, a benefit category exists, it is not statutorily excluded, and there is no national noncoverage decision) that are furnished during a clinical study and that would be otherwise furnished even if the beneficiary were not enrolled in a clinical study. See 42 CFR 405.201
  • Running changes: Those changes in vehicle or engine configuration, equipment or calibration which are made by an OEM or ICI in the course of motor vehicle or motor vehicle engine production. See 40 CFR 85.1502
  • Rural: means a five-digit ZIP code in which the population density is less than 1,000 individuals per square mile. See 42 CFR 423.100
  • Rural area: means an area that is not an urban area as defined at §412. See 42 CFR 411.351
  • Rural area: means for cost reporting periods beginning January 1, 2005, with respect to discharges occurring during the period covered by such cost reports but before July 1, 2006, an area as defined in §412. See 42 CFR 412.402
  • Rural area: means an area located outside an urban area, or a rural census tract within a Metropolitan Statistical Area as determined under the most recent version of the Goldsmith modification as determined by the Office of Rural Health Policy of the Health Resources and Services Administration. See 42 CFR 414.605
  • Rural area: means an area that is not delineated as an urbanized area by the Bureau of the Census. See 42 CFR 491.2
  • Sale proceeds: means funds received by a recipient from the sale of donated commodities. See 31 CFR 380.1
  • Same building: means a structure with, or combination of structures that share, a single street address as assigned by the U. See 42 CFR 411.351
  • Scope: This subpart establishes the requirements for coverage and reimbursement of rural health clinic and Federally qualified health center services under Medicare. See 42 CFR 405.2401
  • Seasonal variance: means the removal of refrigerant from an appliance due to a change in ambient conditions caused by a change in season, followed by the subsequent addition of an amount that is less than or equal to the amount of refrigerant removed in the prior change in season, where both the removal and addition of refrigerant occurs within one consecutive 12-month period. See 40 CFR 82.152
  • Seclusion: means the involuntary confinement of a client alone in a room or an area from which the client is physically prevented from leaving. See 42 CFR 485.902
  • Secondary owner: means the second person named in the registration of a book-entry security held in TreasuryDirect registered, e. See 31 CFR 363.6
  • Secret ballot: means no credit union employee or official can determine how a particular member voted. See 43 CFR 2361.0-2
  • Secretary: means the Secretary of Health and Human Services or his or her delegate. See 42 CFR 405.2401
  • Secretary: means the Secretary of Agriculture. See 25 CFR 39.113
  • Secretary: means the Secretary of the Treasury. See 31 CFR 347.3
  • Secretary: means the Secretary of Health and Human Services and any other Officer or employee of the Department of Health and Human Services to whom the authority involved has been delegated. See 42 CFR 136.302
  • Secretary: means the Secretary of Agriculture of the United States, or any officer or employee of the Department to whom authority has heretofore been delegated or may hereafter be delegated to act in his stead. See 7 CFR 70.25
  • Secretary: means the Secretary of Health and Human Services, or any official to whom he has delegated the pertinent authority. See 42 CFR 491.2
  • Securities financing transaction: means any repurchase agreement, reverse repurchase agreement, securities borrowing transaction, or securities lending transaction. See 31 CFR 360.20
  • Securities financing transaction: means any repurchase agreement, reverse repurchase agreement, securities borrowing transaction, or securities lending transaction. See 31 CFR 360.92
  • Securities holding company: (1) A securities holding company means--

    (i) Any company that directly or indirectly owns or controls, is controlled by, or is under common control with, one or more brokers or dealers registered with the Securities and Exchange Commission. See 42 CFR 436.510

  • Self-directed: means a consumer controlled method of selecting and providing services and supports that allows the individual maximum control of the home and community-based attendant services and supports, with the individual acting as the employer of record with necessary supports to perform that function, or the individual having a significant and meaningful role in the management of a provider of service when the agency-provider model is utilized. See 42 CFR 441.505
  • Self-directed model with service budget: means methods of providing self-directed services and supports using an individualized service budget. See 42 CFR 441.505
  • Self-only annuity: means the recurring unreduced payments under CSRS to a retiree with no survivor annuity to anyone. See 7 CFR 58.37
  • Self-sealing valve: means a valve affixed to a container of refrigerant that automatically seals when not dispensing refrigerant and meets or exceeds established performance criteria as identified in §82. See 40 CFR 82.152
  • Senior executive officer: means a senior executive officer as defined by 12 CFR 701. See 43 CFR 2201.3-1
  • Series EE savings bond: is an accrual-type savings bond, offered at a discount, either in definitive (paper) form or in book-entry form, that pays interest on the principal based on rates determined by Treasury. See 31 CFR 351.3
  • Series I savings bond: means a savings bonds, whether definitive or book-entry, that is purchased at par and pays interest based on a formula that incorporates both an annual fixed rate and a semiannual inflation rate. See 31 CFR 359.3
  • Series I savings bond: is a savings bond, issued either in definitive (paper) form or in book-entry form, that accrues interest in accordance with a formula that includes a fixed component and a component indexed to the rate of inflation. See 31 CFR 363.6
  • Service: means the Indian Health Service. See 42 CFR 136.302
  • Servicer: means the person responsible for:

    (1) Receiving any scheduled, periodic payments from a borrower under the terms of a loan, including amounts for taxes, insurance premiums, and other charges with respect to the property securing the loan. See 42 CFR 480.138

  • Services: A contractor's labor, time or efforts which do not involve the delivery of a specific end item, other than documents (e. See 40 CFR 35.2005
  • Set-asides: State and local activities identified in sections 1452(g)(2) and (k) of the Act for which a portion of a capitalization grant may be used. See 40 CFR 35.3505
  • Share insurance communication: means any written communication, excluding the forms in subpart C of this part, that is made by or on behalf of a federally insured credit union that is intended to be read by two or more credit union members and that mentions share insurance conversion or termination. See 43 CFR 2361.0-2
  • Shares: means deposits, shares, share certificates, share drafts, or any other depository account authorized by federal or state law. See 43 CFR 2201.3-1
  • Short sale: means any sale of a security which the seller does not own or any sale which is consummated by the delivery of a security borrowed by, or for the account of, the seller. See 31 CFR 360.20
  • Short sale: means any sale of a security which the seller does not own or any sale which is consummated by the delivery of a security borrowed by, or for the account of, the seller. See 31 CFR 360.92
  • Shortage area: means a defined geographic area designated by the Department as having either a shortage of personal health services (under section 1302(7) of the Public Health Service Act) or a shortage of primary medical care manpower (under section 332 of that Act). See 42 CFR 491.2
  • Similar area: means an area similar to the HMO's or CMP's geographic area but free from special characteristics that would distort the determination of the AAPCC. See 42 CFR 417.582
  • Single Family Housing: RHS Rural Housing loans for individuals for construction of, repair of, or purchase of a dwelling to be occupied by one household. See 25 CFR 162.361
  • Single owner: means the individual named in the registration of a book-entry Treasury security or a converted savings bond without a beneficiary, secondary owner, or coowner. See 31 CFR 363.6
  • Single source drug: means a drug described by section 1847A(c)(6)(D) of the Act. See 42 CFR 414.902
  • Site: A parcel of land proposed as a dwelling site, with or without development. See 25 CFR 162.361
  • Site approval official: The RHS making the determination that a site meets the requirements in this subpart to be acceptable for site loans. See 25 CFR 162.361
  • SLGS rate: means the current Treasury borrowing rate, less one basis point, as released daily by Treasury in a SLGS rate table. See 31 CFR 344.1
  • SLGS rate table: means a compilation of SLGS rates available for a given day. See 31 CFR 344.1
  • Small appliance: means any appliance that is fully manufactured, charged, and hermetically sealed in a factory with five (5) pounds or less of refrigerant, including, but not limited to, refrigerators and freezers (designed for home, commercial, or consumer use), medical or industrial research refrigeration equipment, room air conditioners (including window air conditioners, portable air conditioners, and packaged terminal air heat pumps), dehumidifiers, under-the-counter ice makers, vending machines, and drinking water coolers. See 40 CFR 82.152
  • Small commercial establishments: For purposes of §35. See 40 CFR 35.2005
  • Small Community: For purposes of §§35. See 40 CFR 35.2005
  • Solo practitioner: means a single Taxpayer Identification Number (TIN) with one eligible professional who is identified by an individual National Provider Identifier (NPI) billing under the TIN. See 42 CFR 414.1205
  • Source facility: means the location at which a used controlled substance was recovered from a piece of equipment, including the name of the company responsible for, or owning the piece of equipment, a contact person at the location, the mailing address for that specific location, and a phone number and a fax number for the contact person at the location. See 40 CFR 82.3
  • Special flood hazard area: means the land in the flood plain within a community having at least a one percent chance of flooding in any given year, as designated by the Administrator of FEMA. See 42 CFR 480.138
  • Specialty hospital: means a subsection (d) hospital (as defined in section 1886(d)(1)(B) of the Act) that is primarily or exclusively engaged in the care and treatment of one of the following:

    (1) Patients with a cardiac condition. See 42 CFR 411.351

  • Specialty tier: means a formulary cost-sharing tier dedicated to very high cost Part D drugs and biological products that exceed a cost threshold established by the Secretary. See 42 CFR 423.560
  • Standard prescription drug coverage: means coverage of Part D drugs that meets the requirements of §423. See 42 CFR 423.100
  • Standard survey: means a periodic, resident-centered inspection which gathers information about the quality of service furnished in a facility to determine compliance with the requirements for participation. See 42 CFR 488.301
  • Standard survey: means a survey conducted in which the surveyor reviews the HHA's compliance with a select number of standards and/or conditions of participation in order to determine the quality of care and services furnished by an HHA as measured by indicators related to medical, nursing, and rehabilitative care. See 42 CFR 488.705
  • State: means any of the several States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, any territory or possession of the United States, or any agency or instrumentality of a State exclusive of local governments. See 32 CFR 33.3
  • State: means any of the 50 states, the District of Columbia, Guam, the Commonwealth of Puerto Rico, the Virgin Islands, American Samoa, the Commonwealth of the Northern Mariana Islands, or certain of their political subdivisions. See 31 CFR 347.3
  • State: A State, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Trust Territory of the Pacific Islands, and the Commonwealth of the Northern Marianas. See 40 CFR 35.2005
  • State: Each of the 50 States and the Commonwealth of Puerto Rico, which receive capitalization grants and are authorized to establish a Fund under section 1452 of the Act. See 40 CFR 35.3505
  • State agency: The State agency designated by the Governor having responsibility for administration of the construction grants program under section 205(g) of the Act. See 40 CFR 35.2005
  • state authority: means the appropriate state or territorial regulatory or supervisory authority for any such credit union. See 43 CFR 2361.0-2
  • State Auto-IRA program: means a state Auto-IRA retirement savings program. See 31 CFR 347.3
  • State credit union: means any credit union organized and operated according to the laws of any state, the several territories and possessions of the United States, or the Commonwealth of Puerto Rico. See 43 CFR 2361.0-2
  • State fair hearing: means the process set forth in subpart E of part 431 of this chapter. See 42 CFR 438.400
  • State health benefits plan: means a health insurance coverage plan that is offered or organized by the State government on behalf of State employees or other public agency employees within the State. See 42 CFR 457.301
  • Statutory accounting practices: means those accounting principles or practices prescribed or permitted by the domiciliary State insurance department in the State that PSO operates. See 42 CFR 422.350
  • Sterilization: means any medical procedure, treatment, or operation for the purpose of rendering an individual permanently incapable of reproducing. See 42 CFR 441.251
  • Structural defect: A defect in the dwelling or unit, installation or set-up of a unit, or a related facility or a deficiency in the site or site development which directly and significantly reduces the useful life, habitability, or integrity of the dwelling or unit. See 25 CFR 162.372
  • Subaward: An award of financial assistance in the form of money, or property in lieu of money, made under a DoD grant or cooperative agreement by a recipient to an eligible subrecipient. See 32 CFR 22.105
  • Subaward: An award of financial assistance in the form of money, or property in lieu of money, made under an award by a recipient to an eligible subrecipient or by a subrecipient to a lower tier subrecipient. See 32 CFR 32.2
  • Subaward: Financial assistance in the form of money, or property in lieu of money, provided under an award by a recipient to an eligible subrecipient or by a subrecipient to a lower tier subrecipient. See 32 CFR 34.2
  • Subdivision: Five or more contiguous (developed or undeveloped) lots or building sites. See 25 CFR 162.361
  • Subgrant: means an award of financial assistance in the form of money, or property in lieu of money, made under a grant by a grantee to an eligible subgrantee. See 32 CFR 33.3
  • Subgrantee: means the government or other legal entity to which a subgrant is awarded and which is accountable to the grantee for the use of the funds provided. See 32 CFR 33.3
  • Subordinated debt: means an obligation that is owed by an organization, that the creditor of the obligation, by law, agreement, or otherwise, has a lower repayment rank in the hierarchy of creditors than another creditor. See 42 CFR 422.350
  • Subrecipient: The legal entity to which a subaward is made and which is accountable to the recipient for the use of the funds provided. See 32 CFR 32.2
  • Subrecipient: The legal entity to which a subaward is made and which is accountable to the recipient for the use of the funds provided. See 32 CFR 34.2
  • Subrecipient: means an entity that enters into a subagreement with a recipient for the purpose of implementing in the target country activities described in an agreement. See 31 CFR 380.1
  • Subsidiary: A company is a subsidiary of another company if:

    (1) The company is consolidated by the other company under applicable accounting standards. See 31 CFR 360.20

  • Substandard care: means noncompliance with one or more conditions of participation identified on a standard survey, including deficiencies which could result in actual or potential harm to patients of an HHA. See 42 CFR 488.705
  • Substandard quality of care: means one or more deficiencies related to participation requirements under §483. See 42 CFR 488.301
  • Substantial compliance: means a level of compliance with the requirements of participation such that any identified deficiencies pose no greater risk to resident health or safety than the potential for causing minimal harm. See 42 CFR 488.301
  • Substitute: means any chemical or product, whether existing or new, that is used as a refrigerant to replace a class I or II ozone-depleting substance. See 40 CFR 82.152
  • Substitute bond: means a bond or book-entry bond issued as a result of a claim or application for relief under subpart F of this part. See 31 CFR 353.2
  • Substitute bond: means a bond or book-entry bond issued as a result of a claim or application for relief under subpart F of this part. See 31 CFR 360.2
  • Suburban: means a five-digit ZIP code in which the population density is between 1,000 and 3,000 individuals per square mile. See 42 CFR 423.100
  • Supervised securities holding company: means a securities holding company that is supervised by the Board pursuant to this part. See 42 CFR 436.510
  • Supplemental benefits: means benefits offered by Part D plans, other than employer group health or waiver plans, that meet the requirements of §423. See 42 CFR 423.100
  • Supplies: All personal property excluding equipment, intangible property, and debt instruments as defined in this section, and inventions of a contractor conceived or first actually reduced to practice in the performance of work under a funding agreement ("subject inventions"), as defined in 37 CFR part 401, "Rights to Inventions Made by Nonprofit Organizations and Small Business Firms Under Government Grants, Contracts, and Cooperative Agreements. See 32 CFR 32.2
  • Supplies: means all tangible personal property other than "equipment" as defined in this part. See 32 CFR 33.3
  • Supplies: Tangible expendable personal property that is charged directly to the award and that has a useful life of less than one year or an acquisition cost of less than $5000 per unit. See 32 CFR 34.2
  • Surety bond: means one or more bonds issued by one or more surety companies under 31 U. See 42 CFR 489.60
  • Surrender: means the actual receipt of a bond with an appropriate request for payment or reissue by either a Federal Reserve Bank or Branch, the Bureau of the Fiscal Service, or, if a paying agent is authorized to handle the transaction, the actual receipt of the bond and the request for payment by the paying agent. See 31 CFR 353.2
  • Surrender: means the actual receipt of a definitive bond with an appropriate request for payment or reissue by either a Federal Reserve Bank or Branch or the Bureau of the Fiscal Service, or, if a paying agent is authorized to handle the transaction, the actual receipt of the definitive bond and the request for payment by the paying agent. See 31 CFR 360.2
  • Suspension: An action by a DoD Component that temporarily withdraws Federal sponsorship under an award, pending corrective action by the recipient or pending a decision to terminate the award by the DoD Component. See 32 CFR 32.2
  • Suspension: means depending on the context, either:

    (1) Temporary withdrawal of the authority to obligate grant funds pending corrective action by the grantee or subgrantee or a decision to terminate the grant, or

    (2) An action taken by a suspending official in accordance with agency regulations implementing E. See 32 CFR 33.3

  • Suspension: An action by a DoD Component that temporarily withdraws Federal sponsorship under an award, pending corrective action by the recipient or pending a decision to terminate the award by the DoD Component. See 32 CFR 34.2
  • System of records: means a group of records under ODNI's control from which information about an individual is retrieved by the name of the individual or by an identifying number, symbol, or other particular assigned to the individual. See 32 CFR 1701.2
  • System receiver: means the isolated portion of the appliance, or a specific vessel within the appliance, that is used to hold the refrigerant charge during the servicing or repair of that appliance. See 40 CFR 82.152
  • Table funding: means a settlement at which a loan is funded by a contemporaneous advance of loan funds and an assignment of the loan to the person advancing the funds. See 42 CFR 480.138
  • Target country: means the foreign country in which activities are implemented under an agreement. See 31 CFR 380.1
  • Taxpayer identifying number: means a social security account number or an employer identification number. See 31 CFR 353.2
  • Taxpayer Identifying Number: means a social security account number or an employer identification number. See 31 CFR 360.2
  • Teaching hospital: means a hospital engaged in an approved GME residency program in medicine, osteopathy, dentistry, or podiatry. See 42 CFR 415.152
  • Teaching physician: means a physician (other than another resident) who involves residents in the care of his or her patients. See 42 CFR 415.152
  • Teaching setting: means any provider, hospital-based provider, or nonprovider settings in which Medicare payment for the services of residents is made under the direct GME payment provisions of §§413. See 42 CFR 415.152
  • Technician: means any person who in the course of maintenance, service, or repair of an appliance (except MVACs) could be reasonably expected to violate the integrity of the refrigerant circuit and therefore release refrigerants into the environment. See 40 CFR 82.152
  • Temporary management: means the temporary appointment by CMS or by a CMS authorized agent, of a substitute manager or administrator based upon qualifications described in §§484. See 42 CFR 488.805
  • Termination: The cancellation of an award, in whole or in part, at any time prior to the date of completion. See 32 CFR 32.2
  • Termination: means permanent withdrawal of the authority to obligate previously-awarded grant funds before that authority would otherwise expire. See 32 CFR 33.3
  • Termination: The cancellation of an award, in whole or in part, under an agreement at any time prior to either:

    (1) The date on which all work under an award is completed. See 32 CFR 34.2

  • Terminology: As used in this subpart, the following terms have the indicated meanings. See 42 CFR 406.24
  • Testing exemption: means an exemption which may be granted under section 203(b)(1) for the purpose of research investigations, studies, demonstrations or training, but not including national security. See 40 CFR 85.1702
  • Therapeutically equivalent: refers to drugs that are rated as therapeutic equivalents under the Food and Drug Administration's most recent publication of "Approved Drug Products with Therapeutic Equivalence Evaluations. See 42 CFR 423.100
  • Third party applicator: means an applicator of critical use methyl bromide who fumigates or treats commodities, structures, crops, or land on behalf of an approved critical user. See 40 CFR 82.3
  • Third party in-kind contributions: The value of non-cash contributions provided by non-Federal third parties. See 32 CFR 34.2
  • Time of retirement: means the effective commencing date for a retired employee's or Member's annuity. See 7 CFR 58.37
  • TOTAL: is an acronym that stands for "Technology Open to Approved Lenders. See 24 CFR 203.251
  • Total assets: (1) Total assets means a credit union's total assets as measured by either--

    (i) Average quarterly balance. See 43 CFR 2201.3-1

  • total capital: means total Tier 1 and Tier 2 capital as calculated under the standards of that country. See 42 CFR 431.242
  • Total consolidated assets: A company's total consolidated assets are determined based on:

    (1) The average of the bank holding company's total consolidated assets in the four most recent consecutive quarters as reported quarterly on the FR Y-9C. See 31 CFR 360.20

  • Total consolidated assets: (1) A foreign banking organization's total consolidated assets are determined based on:

    (i) The average of the foreign banking organization's total consolidated assets in the four most recent consecutive quarters as reported quarterly on the FR Y-7Q. See 31 CFR 360.92

  • Total Performance Score: means the numeric score ranging from 0 to 100 awarded to each competing HHA based on its performance under the HHVBP Model. See 42 CFR 484.305
  • Transaction: means an instance or process of two or more persons or entities doing business. See 42 CFR 411.351
  • Transfer: means the release of a Medicare inpatient from an inpatient rehabilitation facility to another inpatient rehabilitation facility, a short-term, acute-care prospective payment hospital, a long-term care hospital as described in §412. See 42 CFR 412.602
  • Transfer: is a transaction to move a security, or a portion of a security, to or from a TreasuryDirect account. See 31 CFR 363.6
  • Transfer: means the movement (including the discharge) of an individual outside a hospital's facilities at the direction of any person employed by (or affiliated or associated, directly or indirectly, with) the hospital, but does not include such a movement of an individual who (i) has been declared dead, or (ii) leaves the facility without the permission of any such person. See 42 CFR 489.24
  • Transfer and discharge: includes movement of a resident to a bed outside of the certified facility whether that bed is in the same physical plant or not. See 42 CFR 483.5
  • Transform: means to use and entirely consume (except for trace quantities) a controlled substance in the manufacture of other chemicals for commercial purposes. See 40 CFR 82.3
  • Transhipment: means the continuous shipment of a controlled substance, from a foreign state of origin through the United States or its territories, to a second foreign state of final destination, as long as the shipment does not enter into United States jurisdiction. See 40 CFR 82.3
  • Transplant center: means an organ-specific transplant program (as defined in this rule) within a transplant hospital (for example, a hospital's lung transplant program may also be referred to as the hospital's lung transplant center). See 42 CFR 482.70
  • Transplant hospital: means a hospital that furnishes organ transplants and other medical and surgical specialty services required for the care of transplant patients. See 42 CFR 482.70
  • Transplant hospital: means a hospital that provides organ transplants and other medical and surgical specialty services required for the care of transplant patients. See 42 CFR 486.302
  • Transplant program: means a component within a transplant hospital (as defined in this rule) that provides transplantation of a particular type of organ. See 42 CFR 482.70
  • Treasury: means the United States Department of the Treasury. See 31 CFR 347.3
  • Treatment works: Any devices and systems for the storage, treatment, recycling, and reclamation of municipal sewage, domestic sewage, or liquid industrial wastes used to implement section 201 of the Act, or necessary to recycle or reuse water at the most economical cost over the design life of the works. See 40 CFR 35.2005
  • Treatment works phase or segment: A treatment works phase or segment may be any substantial portion of a facility and its interceptors described in a facilities plan under §35. See 40 CFR 35.2005
  • Tribal organization: means the elected governing body of any Indian tribe or any legally established organization of Indians which is controlled by one or more such bodies or by a board of directors elected or selected by one or more such bodies (or elected by the Indian population to be served by such organization) and which includes the maximum participation of Indians in all phases of its activities. See 42 CFR 136.302
  • TRQ: means Tariff Rate Quota. See 25 CFR 39.118
  • Uncovered expenditures: means those expenditures for health care services that are the obligation of an organization, for which an enrollee may also be liable in the event of the organization's insolvency and for which no alternative arrangements have been made that are acceptable to CMS. See 42 CFR 422.350
  • Under common corporate governance: means that a qualifying MA organization and a qualifying MA-affiliated eligible hospital have a common parent corporation, that one is a subsidiary of the other, or that the organization and the hospital have a common board of directors. See 42 CFR 495.200
  • Unexpended consumption allowances: means consumption allowances that have not been used. See 40 CFR 82.3
  • Unexpended destruction and transformation credits: means destruction and transformation credits that have not been used. See 40 CFR 82.3
  • Unexpended essential-use allowances: means essential-use allowances that have not been used. See 40 CFR 82.3
  • Unexpended export production allowances: means export production allowances that have not been used. See 40 CFR 82.3
  • Unexpended production allowances: means production allowances that have not been used. See 40 CFR 82.3
  • Uninsured: means there is no share or deposit insurance available on the credit union accounts. See 43 CFR 2361.0-2
  • United States: United States includes the States, the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, Guam, American Samoa, and the U. See 40 CFR 85.1502
  • Unpaid civil money penalty or assessment: means a civil money penalty or assessment imposed by CMS on an HHA under Titles XI, XVIII, or XXI of the Social Security Act, plus accrued interest, that, after the HHA or Surety has exhausted all administrative appeals, remains unpaid (because the civil money penalty or assessment has not been paid to, or offset or compromised by, CMS) and is not the subject of a written arrangement, acceptable to CMS, for payment by the HHA. See 42 CFR 489.60
  • Unpaid claim: means a Medicare overpayment for which the HHA is responsible, plus accrued interest, that, 90 days after the date of the agency's notice to the HHA of the overpayment, remains due (because the overpayment has not been paid to, or recouped or compromised by, CMS) and is not the subject of a written arrangement, acceptable to CMS, for payment by the HHA. See 42 CFR 489.60
  • Urban: means a five-digit ZIP code in which the population density is greater than 3,000 individuals per square mile. See 42 CFR 423.100
  • Urban center: means any city, with a population of 10,000 or more as determined by the United States Census Bureau, which the Secretary determines has a sufficient urban Indian population with unmet health needs to warrant assistance under title V of the Act. See 42 CFR 136.302
  • Urban Indian: means any individual who resides in an urban center, as defined in paragraph(s) of this section, and who meets one or more of the four criteria in paragraphs (h) (1) through (4) of this section. See 42 CFR 136.302
  • Urban Indian organization: means a nonprofit corporate body situated in an urban center which:

    (1) Is governed by an Indian controlled board of directors:

    (2) Has the provision of health programs as:

    (i) Its principal function, or

    (ii) One of its major functions and such health progams are administered by a distinct organizational unit within the organization. See 42 CFR 136.302

  • Urgently needed services: means covered services that are needed by an enrollee who is temporarily absent from the HMO's or CMP's geographic area and that--

    (1) Are required in order to prevent serious deterioration of the enrollee's health as a result of unforeseen injury or illness. See 42 CFR 417.401

  • USDA: means the United States Department of Agriculture. See 31 CFR 380.1
  • Used controlled substances: means controlled substances that have been recovered from their intended use systems (may include controlled substances that have been, or may be subsequently, recycled or reclaimed). See 40 CFR 82.3
  • Useful life: A period of time/mileage as specified in part 86 for a nonconforming vehicle which begins at the time of resale (for a motor vehicle or motor vehicle engine owned by the ICI at the time of importation) or release to the owner (for a motor vehicle or motor vehicle engine not owned by the ICI at the time of importation) of the motor vehicle or motor vehicle engine by the ICI after modification and/or test pursuant to §85. See 40 CFR 85.1502
  • Useful life: The period during which a treatment works operates. See 40 CFR 35.2005
  • User charge: A charge levied on users of a treatment works, or that portion of the ad valorem taxes paid by a user, for the user's proportionate share of the cost of operation and maintenance (including replacement) of such works under sections 204(b)(1)(A) and 201(h)(2) of the Act and this subpart. See 40 CFR 35.2005
  • Valid prescription: means a prescription that complies with all applicable State law requirements constituting a valid prescription. See 42 CFR 423.100
  • Validation: means the review of information, data, and procedures to determine the extent to which they are accurate, reliable, free from bias, and in accord with standards for data collection and analysis. See 42 CFR 438.320
  • Validation survey: means a survey conducted by the Secretary within 2 months following a standard survey, abbreviated standard survey, partial extended survey, or extended survey for the purpose of monitoring State survey agency performance. See 42 CFR 488.301
  • Value engineering: A specialized cost control technique which uses a systematic and creative approach to identify and to focus on unnecessarily high cost in a project in order to arrive at a cost saving without sacrificing the reliability or efficiency of the project. See 40 CFR 35.2005
  • Value-based payment modifier: means the percentage as determined under §414. See 42 CFR 414.1205
  • Vehicle or engine configuration: means the specific subclassification unit of an engine family or certified part application group as determined by engine displacement, fuel system, engine code, transmission and inertia weight class, as applicable. See 40 CFR 85.2113
  • Verification: means confirming the identity of an online applicant for a TreasuryDirect account at account establishment using an online verification service or offline verification. See 31 CFR 363.6
  • Verification service: means a public or private service that confirms the identity of an online applicant for a TreasuryDirect account at account establishment using information provided by the applicant. See 31 CFR 363.6
  • Very high-pressure appliance: means an appliance that uses a refrigerant with a critical temperature below 104 °F or with a liquid phase saturation pressure above 355 psia at 104 °F. See 40 CFR 82.152
  • Visiting nurse services: means part-time or intermittent nursing care and related medical supplies (other than drugs or biologicals) furnished by a registered professional nurse or licensed practical nurse to a homebound patient. See 42 CFR 405.2401
  • Voluntarily submitted information: means business information in EPA's possession--

    (1) The submission of which EPA had no statutory or contractual authority to require. See 40 CFR 2.201

  • Voluntary committed cost sharing or matching contributions: means cost sharing or matching contributions specifically pledged on a voluntary basis by an applicant or recipient, which become binding as part of an agreement. See 31 CFR 380.1
  • Voluntary guardian: means an individual who is recognized as authorized to act for an incompetent, as provided by §353. See 31 CFR 353.2
  • Voluntary guardian: means an individual who is recognized as authorized to act for an incompetent, as provided by §360. See 31 CFR 360.2
  • Voluntary representative: means the person qualified by the Department of the Treasury to request payment or distribution of a decedent's savings bonds pursuant to §353. See 31 CFR 353.2
  • Voluntary representative: means the person qualified by the Department of the Treasury to request payment or distribution of a decedent's savings bonds pursuant to §360. See 31 CFR 360.2
  • Voluntary termination: means that a provider or supplier, including an individual physician or nonphysician practitioner, submits written confirmation to CMS of its decision to discontinue enrollment in the Medicare program. See 42 CFR 424.502
  • Weighted-average life: means the weighted-average time to the return of a dollar of principal, calculated by multiplying each portion of principal received by the time at which it is expected to be received (based on a reasonable and supportable estimate of that time), and then summing and dividing by the total amount of principal. See 43 CFR 2201.3-1
  • Wholly owned supplier: means a supplier whose total ownership interest is held by a provider or by a person, persons, or other entity with an ownership or control interest in a provider. See 42 CFR 420.201
  • Working capital advance: A procedure whereby funds are advanced to the recipient to cover its estimated disbursement needs for a given initial period. See 32 CFR 32.2
  • Working day: Any day on which Federal government offices are open for normal business. See 40 CFR 85.1502
  • your: refers to a SLGS program user or a potential SLGS program user. See 31 CFR 344.1
  • your: refers to an owner of a Series EE savings bond. See 31 CFR 351.3
  • your: refers to an owner of a Series I savings bonds. See 31 CFR 359.3
  • yourself: refer to a person who submits an offer to perform or performs, directly or indirectly, contractual services or functions on our behalf. See 42 CFR 493.1365
  • Zero-percent certificate of indebtedness: is a one-day, non-interest-bearing security that automatically matures and is rolled over each day until you request that it be redeemed. See 31 CFR 363.6
