  • Anadromous fish: means fish of the species listed in the Annex to the Convention that migrate into the Convention area. See 16 USC 460nnn-82
  • Anadromous stocks: means stocks of species listed in the Annex to the Convention that migrate into the Convention area. See 16 USC 460nnn-82
  • applicable program: means any program for which the Secretary or the Department has administrative responsibility as provided by law or by delegation of authority pursuant to law. See 20 USC 1226a-1
  • Arrest: Taking physical custody of a person by lawful authority.
  • Authorized officer: means a law enforcement official authorized to enforce this chapter under section 5008(a) of this title. See 16 USC 460nnn-82
  • Commission: means the North Pacific Anadromous Fish Commission provided for by article VIII of the Convention. See 16 USC 460nnn-82
  • Contract: A legal written agreement that becomes binding when signed.
  • Convention: means the Convention for the Conservation of Anadromous Stocks of the North Pacific Ocean, signed in Moscow, February 11, 1992. See 16 USC 460nnn-82
  • Convention area: means the waters of the North Pacific Ocean and its adjacent seas, north of 33 degrees North Latitude,1 beyond 200 nautical miles from the baselines from which the breadth of the territorial sea is measured. See 16 USC 460nnn-82
  • county: includes a parish, or any other equivalent subdivision of a State or Territory of the United States. See 19 USC 2292
  • Department: means the Department of Education. See 20 USC 1226a-1
  • Directed fishing: means fishing targeted at a particular species or stock of fish. See 16 USC 460nnn-82
  • Ecologically related species: means living marine species which are associated with anadromous stocks found in the Convention area, including, but not restricted to, both predators and prey of anadromous fish. See 16 USC 460nnn-82
  • Enforcement officer: means a law enforcement official authorized by any Party to enforce this chapter. See 16 USC 460nnn-82
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Exclusive economic zone: means the zone established by Proclamation Numbered 5030, dated March 10, 1983. See 16 USC 460nnn-82
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fish: means finfish, mollusks, crustaceans, and all other forms of marine animal and plant life other than marine mammals and birds. See 16 USC 460nnn-82
  • Fishing: means --

    (A) the catching, taking, or harvesting of fish, or any other activity that can reasonably be expected to result in the catching, taking, or harvesting of fish. See 16 USC 460nnn-82

  • Fishing vessel: means --

    (A) any vessel engaged in catching fish within the Convention area or in processing or transporting fish loaded in the Convention area. See 16 USC 460nnn-82

  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Incidental taking: means catching, taking, or harvesting a species or stock of fish while conducting directed fishing for another species or stock of fish. See 16 USC 460nnn-82
  • individual: shall include every infant member of the species homo sapiens who is born alive at any stage of development. See 19 USC 2297
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • officer: includes any person authorized by law to perform the duties of the office. See 19 USC 2291
  • Party: means Canada, Japan, the Russian Federation, the United States, and any other nation that may accede to the Convention. See 16 USC 460nnn-82
  • Plan: means the Regional Electric Power and Conservation plan (including any amendments thereto) adopted pursuant to this chapter and such plan shall apply to actions of the Administrator as specified in this chapter. See 20 USC 7246
  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • Secretary: means the Secretary of State. See 16 USC 460nnn-82
  • Secretary: means the Secretary of Education. See 20 USC 1226a-1
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • United States Section: means the United States Commissioners of the Commission. See 16 USC 460nnn-82
  • vessel: includes every description of watercraft or other artificial contrivance used, or capable of being used, as a means of transportation on water. See 19 USC 2293
