Terms Used In U.S. Code > Title 20 > Chapter 70

  • action team: means a rural natural resources and economic diversification action team established by the Secretary pursuant to section 6613(b) of this title. See 7 USC 6612
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • agricultural commodity: means any agricultural commodity, food, feed, fiber, or livestock (including livestock as it is defined in section 1471(2) of this title and insects), and any product thereof. See 7 USC 5602
  • Amortization: Paying off a loan by regular installments.
  • application: when used in this chapter includes applications and any modifications, amendments, or supplements thereto, or divisions thereof. See 35 USC 184
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Board: means the National Dairy Promotion and Research Board established under section 4504 of this title. See 7 USC 4502
  • Board: means the Board which is established to carry out the provisions of this chapter. See 19 USC 81a
  • Chairman: means the Chairman of the National Advisory Council on International Monetary and Financial Policies. See 22 USC 262r
  • children: means individuals who have not attained the age of 18. See 20 USC 7972
  • claimed invention: means the subject matter defined by a claim in a patent or an application for a patent. See 35 USC 100
  • classified school employee: means an employee of a State or of any political subdivision of a State, or an employee of a nonprofit entity, who works in any grade from prekindergarten through high school in any of the following occupational specialties:

    (A) Paraprofessional, including paraeducator services. See 20 USC 6682

  • Commission: means the United States International Trade Commission. See 19 USC 3002
  • comprehensive plan: means the comprehensive plan prepared under section 5313 of this title. See 7 USC 5302
  • contractor: means any person, small business firm, or nonprofit organization that is a party to a funding agreement. See 35 USC 201
  • Convention: means the International Convention on the Harmonized Commodity Description and Coding System, done at Brussels on June 14, 1983, and the Protocol thereto, done at Brussels on June 24, 1986, submitted to the Congress on June 15, 1987. See 19 USC 3002
  • coordinated program: means the National Nutrition Monitoring and Related Research Program established by section 5311(a) of this title. See 7 USC 5302
  • Counterclaim: A claim that a defendant makes against a plaintiff.
  • court order: includes a court order (as described in section 922(g)(8) of title 18). See 34 USC 40903
  • dairy products: means products manufactured for human consumption which are derived from the processing of milk, and includes fluid milk products. See 7 USC 4502
  • Discretionary spending: Spending (budget authority and outlays)controlled in annual appropriations acts.
  • economically disadvantaged: means economic hardship due to the loss of jobs or income (labor or proprietor) derived from forestry, the wood products industry, or related commercial enterprises such as recreation and tourism in the national forest. See 7 USC 6612
  • effective registration date: means the date of international registration determined by the International Bureau under the treaty. See 35 USC 381
  • entered: means entered, or withdrawn from warehouse for consumption, in the customs territory of the United States. See 19 USC 3002
  • Executive session: A portion of the Senate's daily session in which it considers executive business.
  • Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Federal agency: means any executive agency as defined in section 105 of title 5, and the military departments as defined by section 102 of title 5. See 35 USC 201
  • Federal agency: means any establishment in the executive branch of the United States Government. See 19 USC 3002
  • Federal Deposit Insurance Corporation: A government corporation that insures the deposits of all national and state banks that are members of the Federal Reserve System. Source: OCC
  • Fixed Rate: Having a "fixed" rate means that the APR doesn't change based on fluctuations of some external rate (such as the "Prime Rate"). In other words, a fixed rate is a rate that is not a variable rate. A fixed APR can change over time, in several circumstances:
    • You are late making a payment or commit some other default, triggering an increase to a penalty rate
    • The bank changes the terms of your account and you do not reject the change.
    • The rate expires (if the rate was fixed for only a certain period of time).
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • funding agreement: means any contract, grant, or cooperative agreement entered into between any Federal agency, other than the Tennessee Valley Authority, and any contractor for the performance of experimental, developmental, or research work funded in whole or in part by the Federal Government.   • Grace period: The number of days you'll have to pay your bill for purchases in full without triggering a finance charge. Source: Federal Reserve
  • grantee: means a corporation to which the privilege of establishing, operating, and maintaining a foreign-trade zone has been granted. See 19 USC 81a
  • Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
  • indoor facility: means a building that is enclosed. See 20 USC 7972
  • international application: means an application filed under the treaty. See 35 USC 351
  • international application designating the United States: means an international application specifying the United States as a country in which a patent is sought, regardless where such international application is filed. See 35 USC 351
  • International Bureau: means the international intergovernmental organization which is recognized as the coordinating body under the treaty and the Regulations. See 35 USC 351
  • International Bureau: means the international intergovernmental organization that is recognized as the coordinating body under the treaty and the Regulations. See 35 USC 381
  • international design application: means an application for international registration. See 35 USC 381
  • international registration: means the international registration of an industrial design filed under the treaty. See 35 USC 381
  • invention: means invention or discovery. See 35 USC 100
  • invention: means any invention or discovery which is or may be patentable or otherwise protectable under this title or any novel variety of plant which is or may be protectable under the Plant Variety Protection Act (7 U. See 35 USC 201
  • inventor: means the individual or, if a joint invention, the individuals collectively who invented or discovered the subject matter of the invention. See 35 USC 100
  • Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
  • Joint Implementation Plan for a Comprehensive National Nutrition Monitoring System: means the plan of that title dated August 18, 1981 and submitted by the Department of Agriculture and the Department of Health and Human Services under section 3178 of this title. See 7 USC 5302
  • joint research agreement: means a written contract, grant, or cooperative agreement entered into by 2 or more persons or entities for the performance of experimental, developmental, or research work in the field of the claimed invention. See 35 USC 100
  • Life estate: A property interest limited in duration to the life of the individual holding the interest (life tenant).
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • local government: means a local general unit of government or local educational unit. See 7 USC 5302
  • made: when used in relation to any invention means the conception or first actual reduction to practice of such invention. See 35 USC 201
  • migratory agricultural worker: means an individual who made a qualifying move in the preceding 36 months and, after doing so, engaged in new temporary or seasonal employment or personal subsistence in agriculture, which may be dairy work or the initial processing of raw agricultural products. See 20 USC 6399
  • migratory child: means a child or youth who made a qualifying move in the preceding 36 months--

    (A) as a migratory agricultural worker or a migratory fisher. See 20 USC 6399

  • migratory fisher: means an individual who made a qualifying move in the preceding 36 months and, after doing so, engaged in new temporary or seasonal employment or personal subsistence in fishing. See 20 USC 6399
  • milk: means any class of cow's milk. See 7 USC 4502
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgage loan: A loan made by a lender to a borrower for the financing of real property. Source: OCC
  • Mortgagee: The person to whom property is mortgaged and who has loaned the money.
  • Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
  • National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department. A national bank can be recognized because it must have "national" or "national association" in its name. Source: OCC
  • National Bank Examiner: An employee of the Comptroller of the Currency whose function is to examine national banks periodically to determine the financial position of a bank and the security of its deposits. The examiner also verifies that the bank maintains procedures consistent with federal banking laws and regulations. Source: OCC
  • National Credit Union Administration: The federal regulatory agency that charters and supervises federal credit unions. (NCUA also administers the National Credit Union Share Insurance Fund, which insures the deposits of federal credit unions.) Source: OCC
  • nonprofit organization: means universities and other institutions of higher education or an organization of the type described in section 501(c)(3) of the Internal Revenue Code of 1986 (26 U. See 35 USC 201
  • nutrition monitoring and related research: means the set of activities necessary to provide timely information about the role and status of factors that bear on the contribution that nutrition makes to the health of the people of the United States, including--

    (A) dietary, nutritional, and health status measurements. See 7 USC 5302

  • nutritional quality: means --

    (A) the appropriate levels of individual nutrients in the diet. See 7 USC 5302

  • old Schedules: means title I of the Tariff Act of 1930 (19 U. See 19 USC 3002
  • patentee: includes not only the patentee to whom the patent was issued but also the successors in title to the patentee. See 35 USC 100
  • person: means any State or local subdivision of a State, agency of such State or subdivision, corporation, or partnership that owns or operates or otherwise controls and provides children's services or any individual who owns or operates or otherwise controls and provides such services. See 20 USC 7972
  • person: means any individual, group of individuals, partnership, corporation, association, cooperative, or any other entity. See 7 USC 4502
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • practical application: means to manufacture in the case of a composition or product, to practice in the case of a process or method, or to operate in the case of a machine or system. See 35 USC 201
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Probate: Proving a will
  • Probation officers: Screen applicants for pretrial release and monitor convicted offenders released under court supervision.
  • process: means process, art or method, and includes a new use of a known process, machine, manufacture, composition of matter, or material. See 35 USC 100
  • producer: means any person engaged in the production of milk for commercial use. See 7 USC 4502
  • promotion: means actions such as paid advertising, sales promotion, and publicity to advance the image and sales of and demand for dairy products. See 7 USC 4502
  • Public debt: Cumulative amounts borrowed by the Treasury Department or the Federal Financing Bank from the public or from another fund or account. The public debt does not include agency debt (amounts borrowed by other agencies of the Federal Government). The total public debt is subject to a statutory limit.
  • Public defender: Represent defendants who can't afford an attorney in criminal matters.
  • qualifying move: means a move due to economic necessity--

    (A) from one residence to another residence. See 20 USC 6399

  • Ranking minority member: The highest ranking (and usually longest serving) minority member of a committee or subcommittee.
  • Receiving Office: means a national patent office or intergovernmental organization which receives and processes international applications as prescribed by the treaty and the Regulations. See 35 USC 351
  • research: means studies testing the effectiveness of market development and promotion efforts, studies relating to the nutritional value of milk and dairy products, and other related efforts to expand demand for milk and dairy products. See 7 USC 4502
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • rural community: means --

    (A) any town, township, municipality, or other similar unit of general purpose local government, or any area represented by a not-for-profit corporation or institution organized under State or Federal law to promote broad based economic development, or unit of general purpose local government, as approved by the Secretary, that has a population of not more than 10,000 individuals, is located within a county in which at least 15 percent of the total primary and secondary labor and proprietor income is derived from forestry, wood products, and forest-related industries such as recreation, forage production, and tourism and that is located within the boundary, or within 100 miles of the boundary, of a national forest.   • Tenancy in common: A type of property ownership in which two or more individuals have an undivided interest in property. At the death of one tenant in common, his (her) fractional percentage of ownership in the property passes to the decedent
  • Testator: A male person who leaves a will at death.

  • Trustee: A person or institution holding and administering property in trust.
  • unfair trade practice: means any act, policy, or practice of a foreign country that--

    (i) violates, or is inconsistent with, the provisions of, or otherwise denies benefits to the United States under, any trade agreement to which the United States is a party. See 7 USC 5602

  • United States: includes each of the States, the District of Columbia, Puerto Rico, and the territories and possessions of the United States. See 7 USC 5602
  • United States: when used in a geographical sense, means all of the States, the District of Columbia, and the Commonwealth of Puerto Rico. See 7 USC 4502
  • User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.
  • Victim advocate: work with prosecutors and assist the victims of a crime.
  • zone: means a "foreign-trade zone" as provided in this chapter. See 19 USC 81a
