  • Abuse: means either of the following:

    California Welfare and Institutions Code 14043.1

  • Accepting county: means the county accepting transferred territory by reason of a county boundary change. See California Government Code 14074.2
  • Access: means a personal inspection and review of a record or an accurate copy of a record, or receipt of an accurate copy of a record, an oral description or communication of a record or an accurate copy of a record, and a request to release a copy of any record. See California Education Code 49061
  • Access costs: means living expenses and expenses for transportation, supplies, and books. See California Education Code 69432.7
  • Account: means the Dentally Underserved Account established in Section 1973, which is contained within the fund. See California Education Code 66085
  • Accrediting organization: means an organization approved by the board. See California Education Code 70005
  • Acquire: includes purchase, condemnation, lease, and gift. See California Government Code 31895.5
  • Act: means the federal American Recovery and Reinvestment Act of 2009 (Public Law 111-5). See California Government Code 16941
  • Action: means a judicial proceeding or arbitration in which a payment in money may be awarded or enforced with respect to a foreign-money claim. See California Education Code 69652
  • Action: includes a civil action and a special proceeding of a civil nature. See California Government Code 14105.6
  • action taken: means a collective decision made by a majority of the members of a legislative body, a collective commitment or promise by a majority of the members of a legislative body to make a positive or a negative decision, or an actual vote by a majority of the members of a legislative body when sitting as a body or entity, upon a motion, proposal, resolution, order or ordinance. See California Government Code 31475
  • Acupuncture: means the stimulation of a certain point or points on or near the surface of the body by the insertion of needles to prevent or modify the perception of pain or to normalize physiological functions, including pain control for the treatment of certain diseases or dysfunctions of the body, and includes the techniques of electroacupuncture, cupping, and moxibustion. See California Education Code 52336.1
  • Acupuncturist: means an individual to whom a license has been issued to practice acupuncture pursuant to this chapter, which is in effect and is not suspended or revoked. See California Education Code 52336.1
  • Adequate progress: means all of the following:

  • Administrative fund: means the funds used to administer this article. See California Education Code 69980
  • Advanced transportation technologies: means emerging commercially competitive transportation-related technologies identified by the authority as capable of creating long-term, high-value-added jobs for Californians while enhancing the state's commitment to energy conservation, pollution and greenhouse gas emissions reduction, and transportation efficiency. See California Revenue and Taxation Code 40093
  • Advertise: as used in this chapter , includes, but is not limited to, any public communication, as defined in subdivision (a) of Section 651, the issuance of any card, sign, or device to any person, or the causing, permitting, or allowing of any sign or marking on, or in, any building or structure, or in any newspaper or magazine or in any directory, or any printed matter whatsoever, with or without any limiting qualification. See California Education Code 54400
  • Advisory body: means the advisory body for each individual agriculture program. See California Education Code 54444
  • Advisory Council: means the Dispute Resolution Advisory Council. See California Education Code 52701
  • Advocacy: means those activities undertaken on behalf of persons who are receiving or have received mental health services to protect their rights or to secure or upgrade treatment or other services to which they are entitled. See California Welfare and Institutions Code 5500
  • Affected county: means each county from which territory is proposed to be transferred to create a new county. See California Government Code 14181
  • Agent: means a person who was an officer or director of a corporation, as defined in subdivision (e), at the time the fraudulent acts occurred, was named in a final criminal restitution order in connection with the fraudulent acts, and was acting in the person's capacity as the corporation's officer or director when committing the fraudulent acts. See California Government Code 31452.65
  • Agriculture programs: means the programs specified in Section 221, Chapter 5 (commencing with Section 5301) of Division 4, Sections 6037, 6038, and 9641. See California Education Code 54444
  • Allocation: means a loan of funds by the commission pursuant to the procedures specified in this chapter. See California Government Code 16753
  • Alternative sources: means devices or technologies used for a renewable electrical generation facility, as defined in paragraph (1) of subdivision (a) of Section 25741, a combined heat and power system, as defined in Section 2840. See California Revenue and Taxation Code 40093
  • Antioch Bridge: means the high-level fixed-span bridge across the San Joaquin River near Antioch together with the approaches thereto and the toll collection facilities for the bridge. See California Welfare and Institutions Code 14132
  • Applicant: as used in this chapter , means an unlicensed person who has completed a master's or doctoral degree program, as specified in Sections 4980. See California Education Code 54400
  • Applicant: means any person who has applied for, or is about to apply for, a state gambling license, a key employee license, a registration, a finding of suitability, a work permit, a manufacturer's or distributor's license, or an approval of any act or transaction for which the approval or authorization of the commission or department is required or permitted under this chapter. See California Government Code 55028
  • Applicant: means an individual, including an ordering, referring, or prescribing individual, partnership, group, association, corporation, institution, or entity, and the officers, directors, owners, managing employees, or agents thereof, that apply to the department for enrollment as a provider in the Medi-Cal program. See California Welfare and Institutions Code 14043.1
  • Application: means a request for payment from the fund submitted to the Secretary of State pursuant to this chapter. See California Government Code 31452.65
  • application: includes the original documents or writings filed and any other supporting documents or writings including supporting documents provided or filed contemporaneously, or later, in support of the application whether provided or filed by the applicant or by any other person in support of the application. See California Education Code 52301.5
  • Approaches: means all facilities between the terminus in Alameda County and the first station thereafter in the county for the discharge of passengers, and all facilities between the terminus in the City and County of San Francisco and the easterly end of the passenger platform of the Montgomery Street Station defined as "approaches" in the agreement between the department and the district, dated March 3, 1966. See California Welfare and Institutions Code 14132.02
  • Appropriate volume of business: means a volume that is consistent with the information provided in the application and any supplemental information provided by the applicant or provider, and is of a quality and type that would reasonably be expected based upon the size and type of business operated by the applicant or provider. See California Welfare and Institutions Code 14043.1
  • Authority: means the California Alternative Energy and Advanced Transportation Financing Authority established pursuant to Section 26004, and any board, commission, department, or officer succeeding to the functions of the authority, or to which the powers conferred upon the authority by this division shall be given. See California Revenue and Taxation Code 40093
  • Authority: means the Bay Area Toll Authority created pursuant to Chapter 4. See California Welfare and Institutions Code 14127.7
  • award: as used in this chapter , may include, but is not limited to, contracts, grants, interagency agreements, loans, and other financial agreements designed to fund public interest research, demonstration, and development projects or programs. See California Government Code 17550
  • Award year: means one academic year, or the equivalent, of attendance at a qualifying institution. See California Education Code 70032
  • Award year: means one academic year, or the equivalent, of attendance at a qualifying institution. See California Education Code 69432.7
  • Baldwin Hills area: means the land area currently within the Kenneth Hahn State Recreation Area, the Baldwin Hills community, the surrounding property bordered on the south by Slauson Avenue, and on the east by La Brea Avenue, including the approximately 21 acres of land zoned RE40 and bordered by La Brea Avenue on the east, Don Alberto Place to the south, and Don Ricardo Drive on the north, and including a spur of land extending from Stocker Street to an area between La Brea Avenue and Crenshaw Boulevard, as designated on the Baldwin Hills Conservancy Map, dated March 1, 2001. See California Government Code 31580.2
  • Bank-offered spot rate: means the spot rate of exchange at which a bank will sell foreign money at a spot rate. See California Education Code 69652
  • Beneficiary: means any person who has received benefits or will be provided benefits under this chapter because of an injury for which another person or party may be liable. See California Welfare and Institutions Code 14124.70
  • Benefits: means the payment of higher education expenses on behalf of a beneficiary by the Scholarshare trust during the beneficiary's attendance at an institution of higher education. See California Education Code 69980
  • Benicia-Martinez Bridge: means the toll bridge across the Carquinez Straits on Interstate Route 680 connecting the Cities of Benicia and Martinez, together with any existing or new and additional approaches thereto, necessary or desirable with respect to the present span or any spans and toll collection facilities for the bridge and any additional spans. See California Welfare and Institutions Code 14131.11
  • bicycle: means a device upon which any person may ride, propelled exclusively by human power through a belt, chain, or gears, and having either two or three wheels in a tandem or tricycle arrangement. See California Welfare and Institutions Code 11461
  • bikeway: means all facilities that provide primarily for, and promote, bicycle travel. See California Welfare and Institutions Code 11461.2
  • Board: as used in this chapter means the California Horse Racing Board. See California Education Code 66051
  • board: means and refers to the Youth Authority Board. See California Welfare and Institutions Code 1000.7
  • Board: means the governing board of the Baldwin Hills Conservancy. See California Government Code 31580.2
  • board: refers to any healing arts board, division, or examining committee which licenses or certifies health professionals. See California Education Code 51760.3
  • Board: means the Dental Board of California. See California Education Code 66903.3
  • Board: means the Dental Board of California. See California Education Code 67347.3

  • Board: means the Scholarshare Investment Board established pursuant to subparagraph (B) of paragraph (2) of subdivision (a) of Section 69984. See California Education Code 69999.8
  • Board: means the Scholarshare Investment Board established pursuant to Section 69984. See California Education Code 70010.1
  • Board: means the State Public Works Board. See California Education Code 49111
  • Board: includes "bureau" "commission" "committee" "department" "division" "examining committee" "program" and "agency. See California Education Code 52301.3
  • Board: as used in this chapter , includes a board, advisory board, commission, examining committee, committee or other similarly constituted body exercising powers under this code. See California Education Code 52176
  • board: means the board of directors of the district unless the context clearly indicates otherwise. See California Welfare and Institutions Code 14102.5
  • Board: means the State Mining and Geology Board. See California Government Code 31755.1
  • board of supervisors: means the board of supervisors of the county within which the city or territory is situated. See California Government Code 14857
  • Bond: means a state general obligation bond issued pursuant to an act adopting the provisions of this chapter. See California Government Code 16722
  • Bond act: means the act authorizing the issuance of state general obligation bonds and adopting this chapter by reference. See California Government Code 16722
  • bonds: means bonds issued by a local agency payable exclusively from the revenues of the enterprise for which the bonds are issued. See California Government Code 31461.1
  • Building: means any existing or planned structure that includes a heating or cooling system, or both. See California Government Code 16753
  • Building: means any existing structure that includes a heating or cooling system, or both. See California Government Code 16941
  • Business address: means the location where an applicant or provider provides services, goods, supplies, or merchandise, directly or indirectly, to a Medi-Cal beneficiary. See California Welfare and Institutions Code 14043.1
  • Carquinez Bridge: means those certain bridge spans on Interstate Route 80 across the Carquinez Straits near Crockett, together with any existing or new and additional approaches thereto, necessary or desirable to connect with the present spans or any additional spans and the toll collection facilities to serve both the existing bridge span and any additional spans. See California Welfare and Institutions Code 14131.11
  • Carrier: includes any insurer as defined in Section 23 of the Insurance Code, including any private company, corporation, mutual association, trust fund, reciprocal or interinsurance exchange authorized under the laws of this state to insure persons against liability for injuries caused to another, and also any insurer providing benefits under a policy of bodily injury liability insurance covering liability arising out of the ownership, maintenance or use of a motor vehicle which provides uninsured motorist endorsement or coverage, pursuant to Section 11580. See California Welfare and Institutions Code 14124.70
  • certificate: as used in this chapter are deemed to be synonomous. See California Education Code 69960
  • Certificate: means a valid certificate issued by the council pursuant to this chapter. See California Education Code 54465
  • Certified nurse-midwife: means a person to whom a certificate has been issued pursuant to Article 2. See California Education Code 70005
  • child nutrition entity: means any school district, county superintendent of schools, child development program operated pursuant to Chapter 2 (commencing with Section 8200) or Chapter 2. See California Education Code 49530.5
  • city: includes city, county, and city and county. See California Welfare and Institutions Code 14139.36
  • Claimant: means an aggrieved person who resides in the state at the time of the fraud and who submits an application pursuant to this chapter. See California Government Code 31452.65
  • Clerk: means the clerk of a county board of supervisors. See California Government Code 14074.2
  • Clerk: means the clerk of a county board of supervisors. See California Government Code 14181
  • client: means a person who is receiving or has received services from a mental health facility, service, or program and who has personally or through a guardian ad litem, entered into an agreement with a county patients' rights advocate for the provision of advocacy services.   • Client centered advocacy: as used in this chapter , includes, but is not limited to, researching, identifying, and accessing resources, or other activities, related to obtaining or providing services and supports for clients or groups of clients receiving psychotherapy or counseling services.   • Commercial unit: means such a unit of goods as by commercial usage is a single whole for purposes of lease and division of which materially impairs its character or value on the market or in use. See California Education Code 78018
  • Commission: means the County Boundary Review Commission. See California Government Code 14074.2
  • commission: means the Student Aid Commission created by this article. See California Education Code 69515

  • Construction: includes the extension, enlargement, repair, renovation, restoration, improvement, furnishing, and equipping of any public building. See California Government Code 31895.5
  • Consumer: means any individual who seeks or acquires, by purchase or lease, any goods, services, money, or credit for personal, family, or household purposes. See California Education Code 52556
  • Consumer lease: means a lease that a lessor regularly engaged in the business of leasing or selling makes to a lessee who is an individual and who takes under the lease primarily for a personal, family, or household purpose. See California Education Code 78018
  • contiguous counties: include those counties separated by any of the waters of this State. See California Welfare and Institutions Code 14103
  • Controlled gambling: means to deal, operate, carry on, conduct, maintain, or expose for play any controlled game. See California Government Code 55028
  • Controlled game: means any controlled game, as defined by subdivision (e) of Section 337j of the Penal Code. See California Government Code 55028
  • controlled substances: means those substances referred to in Division 10 (commencing with Section 11000) of the Health and Safety Code. See California Welfare and Institutions Code 5341
  • Conversion date: means the banking day next preceding the date on which money, in accordance with this title, is (i) paid to a claimant in an action or distribution proceeding, (ii) paid to the official designated by law to enforce a judgment or award on behalf of a claimant, or (iii) used to recoup, setoff, or counterclaim in different moneys in an action or distribution proceeding. See California Education Code 69652
  • Convicted: means any of the following:

    California Welfare and Institutions Code 14043.1

  • Corporation: means a domestic corporation as defined by Section 162 or 2509 or a foreign corporation that is qualified to transact business in California pursuant to Section 2105. See California Government Code 31452.65
  • Council: means the California Massage Therapy Council created pursuant to this chapter, which shall be a nonprofit organization exempt from taxation under Section 501(c)(3) of Title 26 of the United States Code. See California Education Code 54465
  • county: includes the City and County of San Francisco. See California Government Code 31755.1
  • County placing agency: means the county social service department or county probation department. See California Education Code 49061
  • Court: means the trial court in which the action is pending, unless otherwise specified. See California Government Code 14105.6
  • Court of competent jurisdiction: means a state or federal court situated in California. See California Government Code 31452.65
  • Currency: means any coined money, banknotes, or other paper money as are authorized by law which circulates from hand to hand as the medium of exchange. See California Education Code 67358.4
  • Customer: means a natural person who deals with a depositary. See California Civil Code 1858
  • dealer: includes a retailer. See California Welfare and Institutions Code 14125.1
  • Debt due and owing: means 60 days have passed since a notice or demand for repayment of an overpayment or another amount resulting from an audit or examination, for a penalty assessment, or for another amount due to the department was sent to the provider, regardless of whether the provider is an institutional provider or a noninstitutional provider and regardless of whether an appeal is pending. See California Welfare and Institutions Code 14043.1
  • Defendant: means a person (including corporation, association, partnership and firm or governmental entity) against whom a litigation is brought or maintained or sought to be brought or maintained. See California Education Code 69550
  • Dentally underserved area: means a geographic area eligible to be designated as having a shortage of dental professionals pursuant to Part I of Appendix B to Part 5 of Chapter 1 of Title 42 of the Code of Federal Regulations or an area of the state in which unmet priority needs for dentists exist as determined by the California Healthcare Workforce Policy Commission pursuant to Section 128224 of the Health and Safety Code.   • Department: means the Department of Consumer Affairs. See California Education Code 66010.91
  • department: refers to the State Department of Health Services. See California Education Code 51510
  • department: means the State Department of Health Services, and "director" means the State Director of Health Services. See California Welfare and Institutions Code 10720

  • Diagnosed mental disorder: includes a congenital or acquired condition affecting the emotional or volitional capacity that predisposes the person to the commission of criminal sexual acts in a degree constituting the person a menace to the health and safety of others.   • Direct supervision: means supervision of dental procedures based on instructions given by a licensed dentist, who must be physically present in the treatment facility during the performance of those procedures. See California Education Code 67347.3
  • director: means the Director of the State Department of Health Care Services. See California Welfare and Institutions Code 5601
  • director: means the State Director of Health Services. See California Welfare and Institutions Code 14061
  • Director: means the Director of the Department of Consumer Affairs. See California Education Code 52556

  • Dispute resolution: includes , but is not limited to, mediation, conciliation, and arbitration. See California Education Code 52701
  • dissenting shareholder: means the recordholder of dissenting shares and includes a transferee of record. See California Government Code 17092
  • dissenting shares: means shares to which all of the following apply:

  • Distribution proceeding: means a judicial or nonjudicial proceeding for the distribution of a fund in which one or more foreign-money claims is asserted and includes an accounting, an assignment for the benefit of creditors, a foreclosure, the liquidation or rehabilitation of a corporation or other entity, and the distribution of an estate, trust, or other fund. See California Education Code 69652
  • district: means the district within which lie the lands deemed by the legislative body to be benefited by the establishment of the pedestrian mall, the boundaries of which have been finally fixed and established pursuant to Section 11500, and in this event such district so established shall be the "district" within the meaning of this chapter even though the legislative body may have determined pursuant to Section 11505 that assessments shall not be levied as contemplated by Section 11202.   • District: means the San Francisco Bay Area Rapid Transit District. See California Welfare and Institutions Code 14132.02
  • district: means a bridge and highway district unless the context clearly indicates otherwise. See California Welfare and Institutions Code 14102
  • Diversion program: means a treatment program created by this article for osteopathic physicians and surgeons whose competency may be threatened or diminished due to abuse of drugs or alcohol. See California Education Code 69741.5
  • Division: means the Division of Consumer Services. See California Education Code 52556
  • Division of Licensing: shall be deemed to refer to the board. See California Education Code 66261
  • effective date: means January 1, 1977. See California Government Code 31460
  • Eligible institution: means a school, hospital, public care institution, or a unit of local government. See California Government Code 16753
  • Eligible savings and loan association: means a state or federal savings association, as defined in Section 5102 of the Financial Code, located in this state, insured by the Federal Savings and Loan Insurance Corporation, and selected by the Treasurer for the safekeeping of money belonging to or in the custody of the state. See California Government Code 16600
  • Encroachment: includes any tower, pole, pole line, pipe, pipe line, fence, billboard, stand or building, or any structure, object of any kind or character not particularly mentioned in this section, or special event, which is in, under, or over any portion of the highway. See California Welfare and Institutions Code 11322.87
  • Energy conservation measure: means an installation or modification of an installation in a building that is primarily intended to reduce energy consumption or allow the use of a more cost-effective energy source. See California Government Code 16941
  • enterprise: means systems, plants, works, or undertakings used or useful in the collection, treatment, and disposal of waste, refuse, and garbage, or of sewage, waste, and storm water. See California Government Code 31460
  • establishment: means a fixed location where massage is performed for compensation, excluding those locations where massage is only provided on an out-call basis. See California Education Code 54465
  • Executive director: means the administrator of the Scholarshare trust appointed by the board to administer and manage the Scholarshare trust. See California Education Code 69980
  • Experience: as used in this chapter , means experience in interpersonal relationships, psychotherapy, marriage and family therapy, direct counseling, and nonclinical practice that satisfies the requirements for licensure as a marriage and family therapist pursuant to Section 4980. See California Education Code 54400
  • extramural dental facility: means any clinical facility that has contracted with an approved dental hygiene educational program for instruction in dental hygiene, that exists outside or beyond the walls, boundaries, or precincts of the primary campus of the approved program, and in which dental hygiene services are rendered. See California Education Code 66027
  • fee: includes , but is not limited to, any application fee, license fee, permit fee, inspection fee, certification fee, registration fee, identification fee, analysis fee, or certificate fee. See California Education Code 54525
  • Final judgment: means a judgment, arbitration award, or criminal restitution order for which appeals have been exhausted or for which the period for appeal has expired, enforcement of which is not barred by the order of any court or by any statutory provision, which has not been nullified or rendered void by any court order or statutory provision, and for which the claimant has not otherwise been fully reimbursed. See California Government Code 31452.65
  • Finance lease: means a lease with respect to which (A) the lessor does not select, manufacture, or supply the goods, (B) the lessor acquires the goods or the right to possession and use of the goods in connection with the lease, and (C) one of the following occurs:

  • frog: means all species of frog. See California Government Code 54715
  • frog-jumping contest: means a contest generally and popularly known as a frog-jumping contest which is open to the public and is advertised or announced in a newspaper. See California Government Code 55000
  • Fund: means the Victims of Corporate Fraud Compensation Fund created by Section 2280. See California Government Code 31452.65
  • Fund: means the Baldwin Hills Conservancy Fund created pursuant to subdivision (b) of Section 32574. See California Government Code 31580.2
  • Fund: means the State Dentistry Fund. See California Education Code 66085
  • Fund: means the fund created by that act, and into which the proceeds from the sale of the bonds are paid. See California Government Code 16722
  • Fund: means the California Memorial Scholarship Fund established pursuant to Section 5066 of the Vehicle Code. See California Education Code 70010.1
  • Fund: means the Higher Education Capital Outlay Bond Fund, created pursuant to subdivision (e) of Section 67354. See California Education Code 49111
  • Fund: means the Energy Efficient State Property Revolving Fund or the Energy Efficiency Retrofit State Revolving Fund. See California Government Code 16941
  • Fund: means the 1988 Higher Education Capital Outlay Bond Fund created pursuant to Section 67333. See California Education Code 67332
  • Fund: means the June 1990 Higher Education Capital Outlay Bond Fund created pursuant to Section 67346. See California Education Code 67345.2
  • Fund: means the 1992 Higher Education Capital Outlay Bond Fund created pursuant to Section 67358. See California Education Code 67358.2
  • Gambling: means to deal, operate, carry on, conduct, maintain, or expose for play any controlled game. See California Government Code 55028
  • Gambling enterprise: means a natural person or an entity, whether individual, corporate, or otherwise, that conducts a gambling operation and that by virtue thereof is required to hold a state gambling license under this chapter. See California Government Code 55028
  • gambling game: means any controlled game. See California Government Code 55028
  • Gambling operation: means exposing for play one or more controlled games that are dealt, operated, carried on, conducted, or maintained for commercial gain. See California Government Code 55028
  • General supervision: means supervision of dental procedures based on instructions given by a licensed dentist but not requiring the physical presence of the supervising dentist during the performance of those procedures. See California Education Code 67347.3
  • Geotechnical report: means a report prepared by a certified engineering geologist or a civil engineer practicing within the area of his or her competence, which identifies seismic hazards and recommends mitigation measures to reduce the risk of seismic hazard to acceptable levels. See California Government Code 31755.1
  • Goods: means all things that are movable at the time of identification to the lease contract, or are fixtures (Section 10309), but the term does not include money, documents, instruments, accounts, chattel paper, general intangibles, or minerals or the like, including oil and gas, before extraction. See California Education Code 78018
  • governing boards: means the local boards of trustees and the Board of Governors of the California Community Colleges, the Trustees of the California State University, and the Regents of the University of California. See California Education Code 66011
  • Green Party: means the Green Party of California. See California Education Code 51514
  • Gross revenue: means the total of all compensation received for conducting any controlled game, and includes interest received in payment for credit extended by an owner licensee to a patron for purposes of gambling, except as provided by regulation. See California Government Code 55028
  • high school grade point average: includes senior year coursework. See California Education Code 69432.7
  • Highway: includes all, or any part, of the entire width of the right-of-way of a state highway, whether or not the entire area is actually used for highway purposes. See California Welfare and Institutions Code 11322.87
  • hosting platform: means a marketplace that is created for the primary purpose of facilitating the rental of a residential unit offered for occupancy for tourist or transient use for compensation to the offeror of that unit, and the operator of the hosting platform derives revenues, including booking fees or advertising revenues, from providing or maintaining that marketplace. See California Education Code 66010.3
  • Hours of operation: means the period during which a gambling establishment is open to conduct the play of controlled games within a 24-hour period. See California Government Code 55028
  • immediate family: includes the spouse and children of the provider of service, the parents of the provider of service and his spouse, and the spouses of the children of the provider of service. See California Welfare and Institutions Code 14030
  • improve: means reconstruct, replace, extend, repair, better, equip, develop, embellish, or otherwise improve. See California Government Code 31461
  • Incontinence medical supplies: means disposable medical supplies that are covered benefits under the Medi-Cal program pursuant to subdivision (s) of Section 14132 when prescribed by a physician for the treatment of individuals who are incontinent. See California Welfare and Institutions Code 14125.1
  • Individual dentist practice: means a dentist licensed by the Dental Board of California enrolled or enrolling in Medi-Cal as an individual provider who is a sole proprietor of his or her practice or is a corporation owned solely by the individual dentist and the only dentist practitioner is the owner. See California Welfare and Institutions Code 14043.1
  • Individual physician practice: means a physician and surgeon licensed by the Medical Board of California or the Osteopathic Medical Board of California enrolled or enrolling in Medi-Cal as an individual provider who is sole proprietor of his or her practice or is a corporation owned solely by the individual physician and the only physician practitioner is the owner. See California Welfare and Institutions Code 14043.1
  • injurious object: shall mean those objects specified in the following sections:

  • Intern: as used in this chapter , means an unlicensed person who has earned his or her master's or doctoral degree qualifying him or her for licensure and is registered with the board. See California Education Code 54400

  • Investment manager: means a manager contracted to perform functions delegated by the board. See California Education Code 69980
  • Judgment debtor: means a corporation or agent against which a judgment, arbitration award, or criminal restitution order has been entered for conduct constituting intentional fraud. See California Government Code 31452.65

  • Junkyard: means any establishment or place of business which is maintained, operated, or used for storing, keeping, buying, or selling junk, or for the maintenance or operation of an automobile graveyard. See California Welfare and Institutions Code 11362
  • Key employee: means any natural person employed in the operation of a gambling enterprise in a supervisory capacity or empowered to make discretionary decisions that regulate gambling operations, including, without limitation, pit bosses, shift bosses, credit executives, cashier operations supervisors, gambling operation managers and assistant managers, managers or supervisors of security employees, or any other natural person designated as a key employee by the department for reasons consistent with the policies of this chapter. See California Government Code 55028
  • Key employee license: means a state license authorizing the holder to be employed as a key employee. See California Government Code 55028
  • law: includes the charter of any local agency. See California Government Code 31459.1
  • Lease: means a transfer of the right to possession and use of goods for a term in return for consideration, but a sale, including a sale on approval or a sale or return, or retention or creation of a security interest is not a lease. See California Education Code 78018
  • Lease agreement: means the bargain, with respect to the lease, of the lessor and the lessee in fact as found in their language or by implication from other circumstances including course of dealing or usage of trade or course of performance as provided in this division.   • Lease contract: means the total legal obligation that results from the lease agreement as affected by this division and any other applicable rules of law. See California Education Code 78018
  • Legislative body: means the board of supervisors or its chairman in the case of the county, or the city council or the mayor in the case of a city. See California Government Code 17615

  • licensee: as used in this chapter means the holder of a physician's and surgeon's certificate or doctor of podiatric medicine's certificate, as the case may be, who is engaged in the professional practice authorized by the certificate under the jurisdiction of the appropriate board.   • licensing agency: means a panel of the Division of Medical Quality. See California Education Code 51451
  • Licensing authority: means the board, which has jurisdiction over a particular licensee. See California Education Code 69776
  • Lien: means the director's claim for recovery, from a beneficiary's tort action or claim, of the reasonable value of benefits provided on behalf of the beneficiary. See California Welfare and Institutions Code 14124.70
  • Litigation: means any civil action or proceeding, commenced, maintained or pending in any state or federal court. See California Education Code 69550
  • Local agency: means a county or city, whether chartered or general law. See California Government Code 17615
  • Local agency: means any county, city, city and county, or public district which provides or has authority to provide or perform municipal services or functions. See California Government Code 17615.4
  • Local agency: means county, city, or any public district empowered to distribute water or engage in flood control. See California Government Code 31458.3

  • Mapped highway: means a highway which is laid out, surveyed, and delineated on a map of such size, scale, and detail that the exact location on the ground which the highway is to occupy can be ascertained. See California Welfare and Institutions Code 11340
  • Massage: means the scientific manipulation of the soft tissues. See California Education Code 54465
  • Massage practitioner: means a person who is certified by the council pursuant to Section 4604. See California Education Code 54465
  • Massage therapist: means a person who is certified by the council under Section 4604 and who administers massage for compensation. See California Education Code 54465
  • material: includes a statement or omission substantially related to the qualifications, functions, or duties of the business or profession. See California Education Code 52301.5
  • mayor: includes president of the legislative body. See California Government Code 14858
  • Medi-Cal: means the California Medical Assistance Program. See California Welfare and Institutions Code 14063
  • Medi-Cal threshold languages: means primary languages spoken by limited-English-proficient (LEP) population groups meeting a numeric threshold of 3,000 eligible LEP Medi-Cal beneficiaries residing in a county, 1,000 Medi-Cal eligible LEP beneficiaries residing in a single ZIP Code, or 1,500 LEP Medi-Cal beneficiaries residing in two contiguous ZIP Codes. See California Education Code 66085
  • mediation: means a process in which a neutral person or persons facilitate communication between the disputants to assist them in reaching a mutually acceptable agreement. See California Education Code 70000
  • meeting: means any congregation of a majority of the members of a legislative body at the same time and location, including teleconference location as permitted by Section 54953, to hear, discuss, deliberate, or take action on any item that is within the subject matter jurisdiction of the legislative body. See California Government Code 31473
  • Mental health service: means any service directed toward early intervention in, or alleviation or prevention of, mental disorder, including, but not limited to, diagnosis, evaluation, treatment, personal care, day care, respite care, special living arrangements, community skill training, sheltered employment, socialization, case management, transportation, information, referral, consultation, and community services. See California Welfare and Institutions Code 5601
  • Merchant lessee: means a lessee that is a merchant with respect to goods of the kind subject to the lease. See California Education Code 78018
  • Mitigation: means those measures that are consistent with established practice and that will reduce seismic risk to acceptable levels. See California Government Code 31755.1
  • Money: means a medium of exchange for the payment of obligations or a store of value authorized or adopted by a government or by intergovernmental agreement. See California Education Code 69652
  • Money exchange house: means any individual or business engaged in the business of exchanging or dealing in the currency of the United States, Mexico, or any other country. See California Education Code 67358.4
  • Money of the claim: means the money determined as proper pursuant to Section 676. See California Education Code 69652
  • Multidisciplinary committee: means the Veterinary Medicine Multidisciplinary Advisory Committee established pursuant to Section 4809. See California Education Code 52055.730
  • Municipal services or functions: includes , but is not limited to, firefighting, police, ambulance, utility services, and the improvement, maintenance, repair, and operation of streets and highways. See California Government Code 17615.4
  • National Federal Emergency Management Agency standard of flood protection: means the level of flood protection that is necessary to withstand flooding that has a 1-in-100 chance of occurring in any given year using criteria developed by the Federal Emergency Management Agency for application in the National Flood Insurance Program. See California Health and Safety Code 9647
  • Native amphibians: as used in this article means salamanders, toads, or any other member of the class amphibia native to California. See California Government Code 55021
  • needy child: means a child living in a family as described in Section 11250, or a child as described in Section 11401. See California Welfare and Institutions Code 11202
  • new law: means this division of the Corporations Code as amended by act of the California Legislature, 1975-76 Regular Session, effective January 1, 1977, and as in effect on that date. See California Government Code 31460

  • Notice: includes all papers and orders required to be served in any proceedings before any court, board, or officer, or when required by law to be served independently of such proceeding. See California Government Code 26660
  • obligor: means any person owing a duty of support. See California Welfare and Institutions Code 11478.1
  • office: means the Office of Emergency Services. See California Government Code 14659.09
  • Old property: means any or all of the following:

    California Welfare and Institutions Code 14145.3

  • Open educational resources: include , but are not limited to, full courses, course materials, modules, textbooks, faculty-created content, streaming videos, tests, software, and any other tools, materials, or techniques used to support access to knowledge. See California Government Code 31585
  • Owner: includes any person entitled to the use or possession of real property. See California Welfare and Institutions Code 11340
  • Owner licensee: means an owner of a gambling enterprise who holds a state gambling license. See California Government Code 55028
  • Package: includes cartons, wrappers, or other containers which are used for the sale of butter to the retail trade. See California Education Code 68022
  • Parent: means a natural parent, an adopted parent, or legal guardian. See California Education Code 49061
  • parking places: includes parking lots, garages, buildings, and other improvements for the parking of motor vehicles. See California Welfare and Institutions Code 14139.34
  • Participant: means a California-licensed osteopathic physician and surgeon. See California Education Code 69741.5
  • Participant: means an individual, trust, estate, partnership, association, company or corporation, a custodian under the California Uniform Transfers to Minors Act (Part 9 (commencing with Section 3900) of Division 4 of the Probate Code) or similar provisions adopted by another state, a state or local government agency, or a legal representative of a participant who has entered into a participation agreement pursuant to this article. See California Education Code 69980
  • Participant: means a surviving dependent of a California resident killed as a result of injuries sustained during the terrorist attacks of September 11, 2001, who has executed, or on whose behalf has been executed, an agreement pursuant to Section 70011. See California Education Code 70010.1
  • Participating institution: means any campus of the California State University or the University of California that elects to participate in the DREAM Program pursuant to the requirements specified for a qualifying institution as set forth in this article. See California Education Code 70032
  • Participating party: means a person, federal or state agency, department, board, authority, or commission, state or community college, or university, or a city or county, regional agency, public district, school district, or other political entity engaged in the business or operations in the state, whether organized for profit or not for profit, that applies for financial assistance from the authority for the purpose of implementing a project.   • Person: means any individual, organization, or corporate body, except that only individuals may be licensed under this chapter. See California Education Code 52336.1
  • Person: means an individual, a corporation, government or governmental subdivision or agency, business trust, estate, trust, joint venture, partnership, association, two or more persons having a joint or common interest, or any other legal or commercial entity.   • person: means any individual, partnership, corporation, limited liability company, or association. See California Education Code 49410
  • Phototherapy device: means equipment that emits ultraviolet radiation used by a health care professional in the treatment of disease. See California Education Code 66010.91
  • Plaintiff: means the person who commences, institutes or maintains a litigation or causes it to be commenced, instituted or maintained, including an attorney at law acting in propria persona. See California Education Code 69550
  • Podiatric licensing authority: refers to any officer, board, commission, committee, or department of another state that may issue a license to practice podiatric medicine. See California Education Code 69521
  • podiatric medicine: means the diagnosis, medical, surgical, mechanical, manipulative, and electrical treatment of the human foot, including the ankle and tendons that insert into the foot and the nonsurgical treatment of the muscles and tendons of the leg governing the functions of the foot. See California Education Code 69522
  • podiatric residency: means a program of supervised postgraduate clinical training, one year or more in duration, approved by the board. See California Education Code 69525
  • Practice setting: means either of the following:

  • Predatory: means an act is directed toward a stranger, a person of casual acquaintance with whom no substantial relationship exists, or an individual with whom a relationship has been established or promoted for the primary purpose of victimization.   • preenrollment: includes the period of time during which an application package for enrollment, continued enrollment, or for the addition of or change in a location is pending. See California Welfare and Institutions Code 14043.1

  • Purchase: includes taking by sale, lease, mortgage, security interest, pledge, gift, or any other voluntary transaction creating an interest in goods. See California Education Code 78018
  • Qualified higher education expenses: means the expenses of attendance at an institution of higher education as provided in paragraph (3) of subsection (e) of Section 529 of the Internal Revenue Code of 1986, as it is amended from time to time, if, as determined by the board, the amendment is consistent with the purposes of this article, and as determined and certified by the institution of higher education in the same manner as prescribed in Title IV of the Higher Education Act of 1965 (20 U. See California Education Code 69980
  • qualified trust company: means the trust department of any state or national bank in this state or a trust company authorized to act as such in this state. See California Government Code 16625
  • Qualifying institution: means an institution that complies with paragraphs (2) and (3) and is any of the following:

    California Education Code 69432.7

  • Rapid transit tube: means a subaqueous tube across San Francisco Bay between the City and County of San Francisco and the County of Alameda, its approaches and fixed transit facilities, including, but not limited to, ventilation towers and equipment, tracks, and electrical distribution, control, lighting, and communication systems for the accommodation of rail rapid transit. See California Welfare and Institutions Code 14132.02
  • Rate of exchange: means the rate at which money of one country may be converted into money of another country in a free financial market convenient to or reasonably usable by a person obligated to pay or to state a rate of conversion. See California Education Code 69652
  • Reasonable value of benefits: means both of the following:

    California Welfare and Institutions Code 14124.70

  • referral: means (1) the referral of a recipient by a provider of service to any other provider of service. See California Welfare and Institutions Code 14030
  • Refunding warrants: refers to warrants drawn by the Controller on the General Fund pursuant to this article to provide funds for the payment of reimbursement warrants bearing a fixed maturity date or warrants issued pursuant to Section 17211. See California Government Code 17240
  • Regional occupational program: as used in this chapter , means a sequence of career technical or technical training programs that meet the criteria and standards of instructional programs in regional occupational centers and are conducted in a variety of physical facilities that are not necessarily situated in one single plant or site. See California Education Code 52303
  • Regulations: means the rules and regulations set forth in Division 20 (commencing with Section 2000) of Title 16 of the California Code of Regulations. See California Education Code 52055.730
  • Reichert-Meissl number: means the number of milliliters of decinormal alkali which are required to neutralize the acidity of the distillate from five grams of fat treated in the manner specified in the regulations adopted by the director. See California Education Code 69432.8
  • Reimbursement warrants: refers to warrants drawn by the Controller on the General Fund pursuant to this article to reimburse the General Cash Revolving Fund for demands against the General Fund for which warrants were drawn against the General Cash Revolving Fund. See California Government Code 17240
  • Resolution of an investigation for fraud or abuse: means there is no documentation to indicate either that a charge or accusation has been filed against the provider and either (1) the investigation has not been active at any time during the previous 12 months or (2) the department has made a documented good faith effort and has been unable, for a period of 12 months, to contact an investigator or responsible representative of any agency investigating the provider. See California Welfare and Institutions Code 14043.1
  • Revenue: means all rents, receipts, purchase payments, loan repayments, and all other income or receipts derived by the authority from a project, or the sale, lease, or other disposition of alternative source or advanced transportation technology facilities, or the making of loans to finance alternative source or advanced transportation technology facilities, and any income or revenue derived from the investment of money in any fund or account of the authority. See California Revenue and Taxation Code 40093
  • route: means State highway route and the route numbers are those given the State highway routes or portions thereof by the commission. See California Welfare and Institutions Code 10741
  • Sacramento-San Joaquin Valley: means lands in the bed or along or near the banks of the Sacramento River or San Joaquin River, or their tributaries or connected therewith, or upon any land adjacent thereto, or within the overflow basins thereof, or upon land susceptible to overflow therefrom. See California Health and Safety Code 9647
  • Satisfactory academic progress: means those criteria required by applicable federal standards published in Title 34 of the Code of Federal Regulations. See California Education Code 69432.7
  • Satisfactory academic progress: means those criteria required by applicable federal standards published in Title 34 of the Code of Federal Regulations. See California Education Code 70032
  • Scholarshare trust: means the trust created pursuant to this article. See California Education Code 69980
  • Scholarship: means a participant's account as established by the board with moneys deposited in the fund. See California Education Code 70010.1
  • school building: as used in this article includes a facility that a county office of education is authorized to use pursuant to Article 3 (commencing with Section 17280) of Chapter 3. See California Education Code 17582
  • School district: means any school district maintaining any kindergarten or any of grades 1 to 12, inclusive, any public school providing instruction in any kindergarten or any of grades 1 to 12, inclusive, the office of the county superintendent of schools, or any special school operated by the department. See California Education Code 49061
  • Security: means an undertaking to assure payment, to the party for whose benefit the undertaking is required to be furnished, of the party's reasonable expenses, including attorney's fees and not limited to taxable costs, incurred in or in connection with a litigation instituted, caused to be instituted, or maintained or caused to be maintained by a vexatious litigant. See California Education Code 69550
  • service: includes the cost of maintaining any facility used to provide any service. See California Government Code 54708
  • Sexually violent offense: means the following acts when committed by force, violence, duress, menace, fear of immediate and unlawful bodily injury on the victim or another person, or threatening to retaliate in the future against the victim or any other person, and that are committed on, before, or after the effective date of this article and result in a conviction or a finding of not guilty by reason of insanity, as defined in subdivision (a): a felony violation of Section 261, 262, 264. See California Welfare and Institutions Code 6600
  • Sexually violent predator: means a person who has been convicted of a sexually violent offense against one or more victims and who has a diagnosed mental disorder that makes the person a danger to the health and safety of others in that it is likely that he or she will engage in sexually violent criminal behavior. See California Welfare and Institutions Code 6600
  • social media: means an electronic service or account, or electronic content, including, but not limited to, videos or still photographs, blogs, video blogs, podcasts, instant and text messages, email, online services or accounts, or Internet Web site profiles or locations. See California Education Code 45385
  • social services: includes in-home supportive services, protective services, and children's out-of-home care services as such services are defined by the department in order to secure maximum federal financial participation. See California Welfare and Institutions Code 12251
  • Solar device: means the equipment associated with the collection, transfer, distribution, storage, and control of solar energy. See California Government Code 17274
  • Solar energy system: means a solar energy device that has the primary purpose of providing for the collection and distribution of solar energy for the generation of electricity, that produces at least one kW, and not more than five MW, alternating current rated peak electricity, and that meets or exceeds the eligibility criteria established pursuant to Section 25782. See California Government Code 17615.5
  • Special event: means any street festival, sidewalk sale, community-sponsored activity, or community-approved activity. See California Welfare and Institutions Code 11322.87
  • Spot rate: means the rate of exchange at which foreign money is sold by a bank or other dealer in foreign exchange for immediate or next day availability or for settlement by immediate payment in cash or equivalent, by charge to an account, or by an agreed delayed settlement not exceeding two days. See California Education Code 69652
  • State: means the State of California or any department, agency, or officer thereof. See California Government Code 31458.3
  • State: means a State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, or a territory or insular possession subject to the jurisdiction of the United States. See California Education Code 69652
  • State agency: means a unit of state government, including any department, agency, board, or commission under the State of California. See California Government Code 16941
  • state agency: includes every state office, officer, department, division, bureau, board, and commission. See California Government Code 11000
  • state gambling license: means any license issued by the state that authorizes the person named therein to conduct a gambling operation. See California Government Code 55028
  • state hospital: means any hospital specified in Section 4100. See California Welfare and Institutions Code 4001
  • state or local officer or employee who is responsible for the expenditure of substantial amounts of funds under Medi-Cal: means (1) the Director of the State Department of Health Services, and (2) those other state officers or employees, and those local officers or employees, who are determined by the director by regulation to be responsible for the expenditure of substantial amounts of funds under the California Medical Assistance Act and California's State Plan under Title XIX of the federal Social Security Act. See California Welfare and Institutions Code 14030
  • substitution: means the replacement of old property by new property. See California Welfare and Institutions Code 14145.3
  • Substitution proceeding: means a proceeding taken under or pursuant to this chapter. See California Welfare and Institutions Code 14145.3
  • Supervisor: as used in this chapter , means an individual who meets all of the following requirements:

  • Supplier: means a person from whom a lessor buys or leases goods to be leased under a finance lease. See California Education Code 78018
  • surgical center: means a surgical clinic that is licensed under Section 1203 of the Health and Safety Code. See California Welfare and Institutions Code 14132.1
  • Tanning device: means an ultraviolet tanning device and any accompanying equipment, including, but not limited to, protective eyewear, timers, and handrails. See California Education Code 66010.91
  • Tanning facility: means any location, place, area, structure, or business that provides persons access to any tanning device. See California Education Code 66010.91
  • Tender: means a term of a bond that gives the holder the right to have the bond purchased from the holder at a predetermined price prior to maturity. See California Government Code 16722
  • Territory: means the land in the Baldwin Hills area that is under the jurisdiction of the conservancy. See California Government Code 31580.2
  • to the extent resources are available: means to the extent that funds deposited in the mental health account of the local health and welfare fund are available to an entity qualified to use those funds. See California Welfare and Institutions Code 5601
  • Toll bridge: means that certain bridge across San Francisco Bay known as the San Francisco-Oakland Bay Bridge and the approaches thereto. See California Welfare and Institutions Code 14127.7
  • toll bridge: means a toll bridge, with at least four lanes, across Los Angeles Harbor from San Pedro at or near Boschke Slough to Terminal Island, and the approaches thereto. See California Welfare and Institutions Code 14129.5
  • tolls: include tolls, charges, rentals, rates, traffic charges, and other income and revenue actually received or receivable by, or for the account of, the district for the use and operation of equipment, rolling stocks, ferries, properties, and facilities for travel that are constructed, owned, operated, or maintained by the district. See California Welfare and Institutions Code 14103.2
  • Trainee: as used in this chapter , means an unlicensed person who is currently enrolled in a master's or doctoral degree program, as specified in Sections 4980. See California Education Code 54400
  • Transferring county: means the county from which territory is, or is proposed to be, transferred by reason of a county boundary change. See California Government Code 14074.2
  • Trust fund: means the Agriculture Trust Fund created pursuant to Section 232. See California Education Code 54444
  • UC campus foundation: means the following corporations organized under the laws of the State of California: University of California, Berkeley Foundation, UC Davis Foundation, the University of California, Irvine Foundation, the UCLA Foundation, University of California, Merced Foundation, UC Riverside Foundation, U. See California Education Code 51101.1
  • Ultraviolet tanning device: means equipment that emits electromagnetic radiation with wavelengths in the air between 200 and 400 nanometers used for tanning of the skin, including, but not limited to, a sunlamp, tanning booth, or tanning bed. See California Education Code 66010.91
  • Unapplied money: means money in the General Fund in the treasury for which outstanding warrants have not already been drawn and which would remain in the General Fund if all outstanding warrants theretofore drawn were paid. See California Government Code 17220
  • Undetermined risk area: means an urban or urbanizing area within a moderate flood hazard zone, as delineated on an official flood insurance rate map issued by the Federal Emergency Management Agency, which has not been determined to have an urban level of protection. See California Health and Safety Code 9647
  • United States: includes any department, board, agency, or officer thereof. See California Government Code 31458.3
  • Urban level of flood protection: means the level of protection that is necessary to withstand flooding that has a 1-in-200 chance of occurring in any given year using criteria consistent with, or developed by, the Department of Water Resources. See California Health and Safety Code 9647
  • Vexatious litigant: means a person who does any of the following:

  • Visible: means capable of being seen without visual aid by a person of normal visual acuity while driving on the main traveled way of an interstate or primary highway. See California Welfare and Institutions Code 11362
  • Work permit: means any card, certificate, or permit issued by the commission, or by a county, city, or city and county, whether denominated as a work permit, registration card, or otherwise, authorizing the holder to be employed as a gambling enterprise employee or to serve as an independent agent. See California Government Code 55028
