  • Account: means any deposit or credit account with a bank, including a demand, time, savings, passbook, share draft, or like account, other than an account evidenced by a certificate of deposit. See California Education Code 81645
  • Activities: means , but is not limited to, all of the following:

  • Added sweetener: means an additive other than 100 percent fruit juice that enhances the sweetness of a beverage. See California Education Code 49430
  • Adequate progress: means all of the following:

  • Afternoon: means the period of a day between noon and midnight. See California Education Code 81645
  • Appropriate committee: means the committee responsible for anesthesia practice which is responsible to the executive committee of the medical staff. See California Education Code 81312
  • area: as used in this part means an area designated as provided in this part. See California Welfare and Institutions Code 14304
  • assessment: as used in this chapter , shall have the same meaning as the term "evaluation" in the Individuals with Disabilities Education Act, as provided in Section 1414 of Title 20 of the United States Code. See California Education Code 56302.5
  • Assessment: means a levy for the purpose of acquiring, constructing, installing, or maintaining improvements and promoting activities which will benefit the properties or businesses located within a multifamily improvement district. See California Welfare and Institutions Code 14499.75
  • Assisted reproduction: means conception by any means other than sexual intercourse. See California Health and Safety Code 104181
  • Assisted reproduction agreement: means a written contract that includes a person who intends to be the legal parent of a child or children born through assisted reproduction and that defines the terms of the relationship between the parties to the contract. See California Health and Safety Code 104181
  • Banking day: means the part of a day on which a bank is open to the public for carrying on substantially all of its banking functions. See California Education Code 81645
  • Best value: means a value determined by objective criteria and may include, but need not be limited to, price, features, functions, life-cycle costs, and other criteria deemed appropriate by the community college district. See California Education Code 49424
  • Board: means the Board of Registered Nursing. See California Education Code 81146
  • Board: means the governing board of a community college district. See California Education Code 49431
  • Board: means the legislative body of the local agency. See California Government Code 53800
  • Bond: includes warrant or other evidence of indebtedness. See California Government Code 53430
  • Bond: includes warrant or other evidence of indebtedness. See California Government Code 53460
  • Bonds: means bonds, notes, warrants, or other evidence of indebtedness payable, both principal and interest, from the proceeds of ad valorem taxes that may be levied without limitation as to rate or amount upon property subject to taxation by the legislative body.   • Bonds: means bonds, warrants, notes or other evidences of indebtedness of a local agency or zone or improvement district thereof. See California Government Code 53530

  • Business: means all types of businesses, including, but not limited to, the operation of multifamily residential properties, retail stores, commercial properties, financial institutions, and professional offices. See California Welfare and Institutions Code 14499.75
  • Buyer: means a person who buys or contracts to buy goods. See California Education Code 79227
  • Certified interior designer: means a person who prepares and submits nonstructural or nonseismic plans consistent with Sections 5805 and 5538 to local building departments that are of sufficient complexity so as to require the skills of a licensed contractor to implement them, and who engages in programming, planning, designing, and documenting the construction and installation of nonstructural or nonseismic elements, finishes and furnishings within the interior spaces of a building, and has demonstrated by means of education, experience and examination, the competency to protect and enhance the health, safety, and welfare of the public.   • Chief: refers to the chief of the bureau. See California Government Code 53735
  • City: means a city, county, city and county, or an agency or entity created pursuant to the Joint Exercise of Powers Act, Article 1 (commencing with Section 6500) of Chapter 5 of Division 7 of Title 1 of the Government Code, the public member agencies of which includes only cities, counties, or a city and county. See California Welfare and Institutions Code 14499.75
  • City council: means the city council of a city or the board of supervisors of a county, or the agency, commission, or board created pursuant to a joint powers agreement and which is a city within the meaning of this part. See California Welfare and Institutions Code 14499.75
  • city lands: means lands already owned by the city which are located within the boundaries of an existing or proposed district and which are either being used for the purpose of public off-street parking or are not needed by the city for any other purpose and are available for such use. See California Welfare and Institutions Code 14184.71
  • Clerk: means clerk of the legislative body. See California Welfare and Institutions Code 14499.75
  • Combination foods: means products that contain two or more components representing two or more of the recommended food groups: fruit, vegetable, dairy, protein, or grains. See California Education Code 49430
  • Commission: means the California Health Facilities Commission. See California Welfare and Institutions Code 14610
  • committee: means a committee of either the Senate or Assembly, a joint committee of both houses, or, when any of the foregoing committees is authorized to create subcommittees, a subcommittee. See California Government Code 16350
  • Committee: means an intervention evaluation committee created by this article. See California Education Code 81146
  • Community college: means a community college maintained by the district issuing bonds under this chapter. See California Education Code 49431
  • Competitive foods: means all food and beverages other than meals reimbursed under programs authorized by the federal Richard B. See California Education Code 49430
  • Construction: includes the extension, enlargement, repair, renovation, restoration, improvement, and equipping of any public building. See California Government Code 53800
  • Construction or alteration: as used in this article , includes any construction, reconstruction, or alteration of, or addition to, any school building. See California Education Code 81130.5
  • Contract for sale: includes both a present sale of goods and a contract to sell goods at a future time. See California Education Code 79420
  • corporation: includes a limited liability company. See California Government Code 53601.2
  • Corporation: includes a corporation, a company, an association, and a joint stock association. See California Government Code 53735
  • County: means the county, or city and county, in which all or a majority of the assessed valuation of the community college district lies at the time bonds are issued under this chapter. See California Education Code 49431
  • County treasurer: means the treasurer of the county in which all or a majority of the assessed valuation of the district lies at the time bonds are issued under this chapter. See California Education Code 49431
  • Customer: means a person having an account with a bank or for whom a bank has agreed to collect items, including a bank that maintains an account at another bank. See California Education Code 81645
  • Deep fried: means a food item that is cooked by total submersion in oil or fat. See California Education Code 49430
  • Department: as used in this division , means the State Department of Alcohol and Drug Programs. See California Government Code 53840
  • department: means the State Department of Health Services. See California Welfare and Institutions Code 14062
  • Department: means State Department of Health Services. See California Welfare and Institutions Code 14601
  • Department: refers to the Department of Consumer Affairs. See California Government Code 53735
  • Deposit holder: as used in this chapter means the district attorney, county officer, or trustee designated by the court to receive assets deposited pursuant to this chapter to secure future support payments. See California Government Code 53760
  • Design-build: means a procurement process in which both the design and construction of a project are procured from a single entity. See California Education Code 49424
  • Design-build entity: means a corporation, limited partnership, partnership, or other association that is able to provide appropriately licensed contracting, architectural, and engineering services as needed pursuant to a design-build contract. See California Education Code 49424
  • director: means the State Director of Health Services. See California Welfare and Institutions Code 14061
  • Director: refers to the Director of Consumer Affairs. See California Government Code 53735
  • district: means a multifamily improvement district established pursuant to this part. See California Welfare and Institutions Code 14499.75
  • Division: means permanent road division. See California Welfare and Institutions Code 14570
  • Documentary draft: means a draft to be presented for acceptance or payment if specified documents, certificated securities (Section 8102) or instructions for uncertificated securities (Section 8102), or other certificates, statements, or the like are to be received by the drawee or other payor before acceptance or payment of the draft. See California Education Code 81645
  • Draft: means a draft as defined in Section 3104 or an item, other than an instrument, that is an order. See California Education Code 81645
  • Drawee: means a person ordered in a draft to make payment. See California Education Code 81645
  • Elementary school: means a school operated and maintained by a school district or county office of education that maintains any grade from kindergarten to grade 6, inclusive, but no grade higher than grade 6. See California Education Code 49430
  • eligible special district: means a special district, subsidiary district, or multicounty special district which, during the three fiscal years prior to the 1978-79 fiscal year, received, on the average, more than 50 percent of its total revenue directly or indirectly from property tax and performs any of the following activities: cemetery, flood control, library, pest abatement, park and recreation, or garbage disposal pursuant to Chapter 1 (commencing with Section 4100) of Part 2 of Division 5 of the Health and Safety Code.   • encroachment: includes any tower, pole, poleline, pipe, pipeline, driveway, private road, fence, billboard, stand or building, or any structure or object of any kind or character not particularly mentioned in this section, which is placed in, under or over any portion of the highway. See California Welfare and Institutions Code 15376
  • equipment: includes (1) schoolbuses, (2) other motor vehicles, (3) test materials, educational films, and audiovisual materials, and (4) all other items defined as equipment or service systems in the Community College Budget and Accounting Manual. See California Education Code 81550
  • Flash fried: means a food item that is quickly fried on both sides in oil with a temperature of 400 degrees Fahrenheit or higher. See California Education Code 49430
  • Flood hazard zone: means an area subject to flooding that is delineated as either a special hazard area or an area of moderate hazard on an official flood insurance rate map issued by the Federal Emergency Management Agency. See California Health and Safety Code 9647
  • Fund: means the Tobacco Settlement Fund. See California Government Code 53856.1
  • Fund: means the Household Movers Fund established pursuant to Section 19229. See California Government Code 53735
  • General fund reserves: means the general fund reserve balance as of July 1, 1978, that is not legally obligated. See California Government Code 16271
  • General obligation bonds: means bonds, warrants, notes or other evidence of indebtedness of a local agency payable, both principal and interest, from the proceeds of ad valorem taxes or ad valorem assessments which may be levied without limitation as to rate or amount upon property in the local agency subject to taxation or assessment. See California Government Code 53500
  • goods: means goods used or bought for use primarily for personal, family or household purposes. See California Education Code 81349
  • Governing body: means the board of supervisors except that in the case of a subsidiary district "governing body" means the city council, and in the case of a multi-county district "governing body" means the governing body of the multi-county district itself. See California Government Code 16271
  • Grant anticipation note: means a note issued upon the security of specified accounts receivable from state or federal governments, including, without limitation, grants, loans, or a combination of both, for which funds have been appropriated and committed to a local agency. See California Government Code 53859
  • High school: means a school operated and maintained by a school district or county office of education maintaining any of grades 9 to 12, inclusive. See California Education Code 49430
  • highway: includes all or any part of the entire width of right of way of a county highway, whether or not such entire area is actually used for highway purposes. See California Welfare and Institutions Code 15376
  • Highway: means any county road or highway or any public roadway right of way or any private easement or roadway not accepted or acceptable into the county highway system but upon which a permanent public easement is offered or any privately owned road which meets the requirements of and in connection with which the necessary findings of Section 969. See California Welfare and Institutions Code 14570
  • Household mover: includes every corporation or person, their lessees, trustee, receivers, or trustees appointed by any court whatsoever, engaged in the permitted or unpermitted transportation for compensation or hire as a business by means of a motor vehicle or motor vehicles being used in the transportation of used household goods and personal effects over any public highway in this state. See California Government Code 53735
  • immediate family: means an individual's spouse and minor dependent children and any other person over which the individual has legal control. See California Welfare and Institutions Code 14478
  • Improvement: means the acquisition, construction, installation, or maintenance of any tangible property with an estimated useful life of five years or more, including, but not limited to:

    California Welfare and Institutions Code 14499.75

  • Insurer: includes an insurance company and any person authorized to represent the insurer with respect to a claim. See California Education Code 56244
  • interior design organization: means a nonprofit organization, exempt from taxation under Section 501(c)(3) of Title 26 of the United States Code, of certified interior designers whose governing board shall include representatives of the public, except that an organization that is not currently exempt under that section that submits an application to the Internal Revenue Service requesting an exemption under that section shall be eligible to be an interior design organization if it meets the requirements under that section within a reasonable period of time. See California Education Code 56322
  • Investing agency: means the Public Employees' Retirement System, as defined by Section 20004. See California Government Code 53800
  • Issuer: means a city, county, city and county, school district, community college district, or special district, secured by the levy of ad valorem taxes, authorized to issue bonds pursuant to this article. See California Government Code 53507
  • Item: means an instrument or a promise or order to pay money handled by a bank for collection or payment. See California Education Code 81645
  • Landlord: includes a tenant who is a sublandlord under a sublease. See California Civil Code 1997.020
  • Last equalized assessment roll: means the last assessment roll made up by the county assessor, including the changes ordered by the board of supervisors sitting as a board of equalization. See California Welfare and Institutions Code 14570
  • Lease: means a lease or sublease of real property for other than residential purposes, and includes modifications and other agreements affecting a lease. See California Civil Code 1997.020
  • lease or agreement: shall include a lease purchase agreement. See California Education Code 81331
  • Legislative body: means the legislative body of the local agency as defined in Section 53000. See California Government Code 53500
  • Legislative body: means the governing body of the issuer. See California Government Code 53507
  • Legislative body: means the legislative body, as defined in Section 53000, of the local agency. See California Government Code 53540
  • license: includes certificate, registration, or any other authorization to engage in practice regulated by this chapter. See California Education Code 81133.1
  • License: as used in this chapter also includes a "permit". See California Government Code 53437
  • Loan: includes , but is not limited to, a borrowing by a local agency represented or to be represented by bonds of a local agency. See California Government Code 53859
  • Local agency: means county, city, irrigation district, reclamation district, school district, or other municipal corporation. See California Government Code 53430

  • Medi-Cal: means the California Medical Assistance Program. See California Welfare and Institutions Code 14063
  • Middle school: means a school operated and maintained by a school district or county office of education that maintains grade 7 or 8, grades 7 to 9, inclusive, or grades 7 to 10, inclusive. See California Education Code 49430
  • milk plant: as used in this article , means any place, structure, or building where a handler receives market milk and weighs, tests, standardizes, pasteurizes, homogenizes, separates, bottles or packages such milk. See California Education Code 81421
  • Motor vehicle: means every motor truck, tractor, or other self-propelled vehicle used for transportation of property over the public highways, other than upon fixed rails or tracks, and any trailer, semitrailer, dolly, or other vehicle drawn thereby. See California Government Code 53735
  • National Federal Emergency Management Agency standard of flood protection: means the level of flood protection that is necessary to withstand flooding that has a 1-in-100 chance of occurring in any given year using criteria developed by the Federal Emergency Management Agency for application in the National Flood Insurance Program. See California Health and Safety Code 9647
  • Nonresident: means a person who is not a resident of this State at the time the accident or collision occurs or at the time a cause of action or claim for relief arises against him, and also means a person who, at the time the accident or collision occurs or at the time a cause of action or claim for relief arises against him is a resident of this State but subsequently becomes a nonresident of this State. See California Government Code 53503
  • Nurse anesthetist: means a person who is a registered nurse, licensed by the board and who has met standards for certification from the board. See California Education Code 81312
  • offsite building: is a building that is situated on land which is neither owned by a community college district nor leased by a community college district under a lease containing an option to purchase the land. See California Education Code 81130.5
  • on-premises advertising displays: means any structure, housing, sign, device, figure, statuary, painting, display, message placard, or other contrivance, or any part thereof, that has been designed, constructed, created, intended, or engineered to have a useful life of 15 years or more, and intended or used to advertise, or to provide data or information in the nature of advertising, for any of the following purposes:

  • owner: means any person shown as the owner of land on the last equalized assessment roll or otherwise known to be the owner of land by the city council. See California Welfare and Institutions Code 14499.75
  • Par fried: means a food item that is fried to reach an internal temperature of 160 degrees Fahrenheit then it is cooled to room temperature so that it may be refrigerated or frozen for future frying. See California Education Code 49430
  • Parent and child relationship: as used in this part means the legal relationship existing between a child and the child's natural or adoptive parents incident to which the law confers or imposes rights, privileges, duties, and obligations. See California Health and Safety Code 104162.1
  • Person: includes an individual, a firm, or a copartnership. See California Government Code 53735
  • Person: includes any individual, firm, corporation, association, copartnership, trust, business trust, or receiver or any trustee or conservator for any thereof, but does not include the state or any public corporation, political subdivision, city, county, district or any agency thereof or of the state. See California Education Code 49431
  • plan: means a proposal as described in Section 36713. See California Welfare and Institutions Code 14499.75
  • Pledge: means pledge, assign, place a charge upon and place a lien upon. See California Government Code 53500
  • Private entity: means any private organization with appropriate experience and expertise to negotiate Medi-Cal hospital reimbursement rates on behalf of the state. See California Welfare and Institutions Code 14610
  • Program manager: means the staff manager of the intervention program, as designated by the executive officer of the board. See California Education Code 81146
  • Project: means any one or more dormitories or other housing facilities, boarding facilities, student union or activity facilities, vehicle parking facilities, or any other auxiliary or supplementary facilities for individual or group accommodation, owned or operated or authorized to be acquired, constructed, furnished, equipped, and operated by the board for use by students, faculty members, or other employees of any one or more community colleges, or a combination of such facilities, which may include facilities already completed and facilities authorized for future completion, designated by the board as a project in providing for the issuance of revenue bonds. See California Education Code 49431
  • Property: means real property situated within a multifamily improvement district. See California Welfare and Institutions Code 14499.75
  • Public agency: includes any city, public corporation, political subdivision, or district. See California Welfare and Institutions Code 15376
  • Public building: includes any structure, building, facility, or work which a local agency is authorized to construct and automobile parking lots, landscaping, and other facilities, including equipment, incidental to the use of any building, and also includes the site thereof, and any easements or rights-of-way appurtenant thereto or necessary for its full use. See California Government Code 53800
  • Qualified court investigator: as used in this article , has the meaning provided by Section 8543. See California Government Code 53603
  • Rate: means the rate of reimbursement per unit of service which is agreed to by the department and a hospital. See California Welfare and Institutions Code 14610
  • related services: means transportation, and such developmental, corrective, and other supportive services (including speech-language pathology and audiology services, interpreting services, psychological services, physical and occupational therapy, recreation, including therapeutic recreation, social work services, school nurse services designed to enable an individual with exceptional needs to receive a free appropriate public education as described in the individualized education program of the child, counseling services, including rehabilitation counseling, orientation, and mobility services, and medical services, except that such medical services shall be for diagnostic and evaluation purposes only) as may be required to assist an individual with exceptional needs to benefit from special education, and includes the early identification and assessment of disabling conditions in children.   • Restriction on use: means a provision in a lease that restricts the use of leased property by a tenant, whether by limiting use to a specified purpose, mandating use for a specified purpose, prohibiting use for a specified purpose, limiting or prohibiting a change in use, or otherwise. See California Civil Code 1997.020
  • Revenue-producing facility: means an improvement, works, system or facility furnishing or providing services or products for which the local agency is authorized to impose a charge. See California Government Code 53500
  • Road commissioner: means the county road commissioner appointed pursuant to Section 2006. See California Welfare and Institutions Code 15376
  • route: means State highway route and the route numbers are those given the State highway routes or portions thereof by the commission. See California Welfare and Institutions Code 10741
  • Sacramento-San Joaquin Valley: means lands in the bed or along or near the banks of the Sacramento River or San Joaquin River, or their tributaries or connected therewith, or upon any land adjacent thereto, or within the overflow basins thereof, or upon land susceptible to overflow therefrom. See California Health and Safety Code 9647
  • School building: as used in this article , means any building used, or designed to be used, for community college purposes and constructed by the state, by any city, county, or city and county, by any district of any kind within the state, by any regional occupational center or program created by or authorized to act by an agreement under joint exercise of power, or by the United States government, or any agency thereof. See California Education Code 81050
  • School building: as used in this article , means and includes any building used, or designed to be used, for community college purposes and constructed, reconstructed, altered, or added to, by the state or by any city or city and county, by any political subdivision, by any district of any kind within the state, by any regional occupational center or program created by or authorized to act by an agreement under joint exercise of power, or by the United States government, or any agency thereof. See California Education Code 81130.5
  • School building: as used in this article excludes any building which is used for community college district administrative buildings located on a site separate from the community college campuses of the district, and into which students are not required to enter. See California Education Code 81160
  • School campus: means all areas of the property under the jurisdiction of the school that are accessible to pupils during the schoolday. See California Education Code 49430
  • Schoolday: means the period from the midnight before to 30 minutes after the end of the official schoolday. See California Education Code 49430
  • Seller: means a person who sells or contracts to sell goods. See California Education Code 79227
  • site: includes one or more sites, and also may include any building or buildings located or to be located on a site. See California Education Code 81330
  • Snack: means a food that is generally regarded as supplementing a meal, including, but not limited to, chips, crackers, yogurt, cheese, nuts, seeds, fruit, or vegetables. See California Education Code 49430
  • Sold: means the exchange of food or beverages for money, coupons, vouchers, or order forms when any part of the exchange occurs on a school campus. See California Education Code 49430
  • Special district: includes a county service area, a maintenance district or area, an improvement district or improvement zone, or any other zone or area formed for the purpose of designating an area within which a property tax rate will be levied to pay for a service or improvement benefitting that area. See California Government Code 16271
  • special district: means any agency of the state for the local performance of governmental or proprietary functions within limited boundaries. See California Government Code 53835
  • state agency: includes every state office, officer, department, division, bureau, board, and commission. See California Government Code 11000
  • Subsidiary district: means a special district in which the city council of a city has been empowered to act as ex officio members of the board of directors of such district and either:

  • substantial financial interest: means the ownership of common stock, preferred stock, warrants, options, loans, partnership interests, debt instruments, or other ownership interest, if consisting of, or convertible to, equity investments in an entity contracting with the department under the provisions of this chapter or an entity contracting with a current or proposed contractor doing business with the department under the provisions of this chapter, and such ownership interest in terms of fair market value is not less than the greater of the following:

  • Tenant: includes a subtenant or assignee. See California Civil Code 1997.020
  • Undetermined risk area: means an urban or urbanizing area within a moderate flood hazard zone, as delineated on an official flood insurance rate map issued by the Federal Emergency Management Agency, which has not been determined to have an urban level of protection.   • Urban level of flood protection: means the level of protection that is necessary to withstand flooding that has a 1-in-200 chance of occurring in any given year using criteria consistent with, or developed by, the Department of Water Resources. See California Health and Safety Code 9647
