  • assessment: as used in this chapter , shall have the same meaning as the term "evaluation" in the Individuals with Disabilities Education Act, as provided in Section 1414 of Title 20 of the United States Code. See California Education Code 56302.5
  • Bailee: means a person that by a warehouse receipt, bill of lading, or other document of title acknowledges possession of goods and contracts to deliver them. See California Education Code 84040.5
  • bioanalyst: means a person licensed under Section 1260 to engage in clinical laboratory practice and direction of a clinical laboratory. See California Education Code 56362
  • board: refers to the State Board of Chiropractic Examiners. See California Education Code 56347
  • Board: means the governing body of a local taxing entity. See California Government Code 975
  • Board: means the Board of Psychology. See California Education Code 81839
  • board: means the State Board of Optometry. See California Education Code 85266.5
  • Board: means the State Allocation Board. See California Government Code 54125
  • capitol building annex project: means any work of construction of a state capitol building annex or restoration, rehabilitation, renovation, or reconstruction of the State Capitol Building Annex described in Section 9105 of the Government Code that is performed pursuant to Article 5. See California Government Code 16368.2
  • Carrier: means a person that issues a bill of lading. See California Education Code 84040.5
  • Certified interior designer: means a person who prepares and submits nonstructural or nonseismic plans consistent with Sections 5805 and 5538 to local building departments that are of sufficient complexity so as to require the skills of a licensed contractor to implement them, and who engages in programming, planning, designing, and documenting the construction and installation of nonstructural or nonseismic elements, finishes and furnishings within the interior spaces of a building, and has demonstrated by means of education, experience and examination, the competency to protect and enhance the health, safety, and welfare of the public.   • clerk: means the engrossing and enrolling clerk or the employee who performs the duties of engrossing and enrolling clerk when no employee is so designated by name. See California Government Code 16366.2
  • CLIA laboratory director: means the person identified as the laboratory director on the CLIA certificate issued to the laboratory by the federal Centers for Medicare and Medicaid Services (CMS). See California Education Code 56364.1
  • clinical histocompatibility scientist: means any person, other than a person licensed to direct a clinical laboratory, or licensed as a clinical laboratory scientist or trainee, who is licensed under Sections 1261, 1261. See California Education Code 56366
  • clinical laboratory scientist: means any person, other than a licensed clinical laboratory bioanalyst or trainee, who is licensed under Sections 1261 and 1262 to engage in clinical laboratory practice under the overall operation and administration of a laboratory director, unless serving as a director of a waived laboratory as provided in Section 1209.   • Commission: means the Public Utilities Commission. See California Government Code 54250
  • committee: means a committee of either the Senate or Assembly, a joint committee of both houses, or, when any of the foregoing committees is authorized to create subcommittees, a subcommittee. See California Government Code 16350
  • committee: means the engrossing and enrolling committee of the house ordering the engrossing or enrolling of a bill or other document or the committee of such house which performs the duties of engrossing and enrolling committee when no committee is so designated by name. See California Government Code 16366.3
  • Consignee: means a person named in a bill of lading to which or to whose order the bill promises delivery. See California Education Code 84040.5
  • Consignor: means a person named in a bill of lading as the person from which the goods have been received for shipment. See California Education Code 84040.5
  • Customer: means a person having an account with a bank or for whom a bank has agreed to collect items, including a bank that maintains an account at another bank. See California Education Code 81645
  • Delivery order: means a record that contains an order to deliver goods directed to a warehouse, carrier, or other person that in the ordinary course of business issues warehouse receipts or bills of lading. See California Education Code 84040.5
  • department: means the State Department of Public Health. See California Education Code 56361.2
  • designated instruction and services: means "related services" as that term is defined in Section 1401(26) of Title 20 of the United States Code and Section 300. See California Education Code 56363
  • displacement: includes , but is not limited to, persons who will have to move from surplus residential property that they occupy when it is sold by a state agency because they are unable to afford to pay the price that the state agency is asking for the residential property. See California Government Code 54236
  • dissenting interest: means the interest of a limited partner that satisfies all of the following conditions:

  • dissenting limited partner: means the recordholder of a dissenting interest, and includes an assignee of record of such an interest. See California Government Code 978.6
  • Documentary draft: means a draft to be presented for acceptance or payment if specified documents, certificated securities (Section 8102) or instructions for uncertificated securities (Section 8102), or other certificates, statements, or the like are to be received by the drawee or other payor before acceptance or payment of the draft. See California Education Code 81645
  • Draft: means a draft as defined in Section 3104 or an item, other than an instrument, that is an order. See California Education Code 81645
  • Drawee: means a person ordered in a draft to make payment. See California Education Code 81645
  • exempt surplus land: means either of the following:

  • Fiscal year: means a year beginning on July 1 and ending on June 30 unless the local public entity has adopted a different fiscal year as authorized by law, in which case "fiscal year" means the fiscal year adopted by such local public entity. See California Government Code 970
  • Foster family home: includes a small family home as defined in paragraph (6) of subdivision (a) of Section 1502 of the Health and Safety Code, a certified family home of a foster family agency as defined in Section 1506 of the Health and Safety Code, and a resource family as defined in Section 1517 of the Health and Safety Code and Section 16519. See California Education Code 56155.5
  • Good faith: means honesty in fact and the observance of reasonable commercial standards of fair dealing. See California Education Code 84040.5
  • Goods: means all things that are treated as movable for the purposes of a contract for storage or transportation. See California Education Code 84040.5
  • interior design organization: means a nonprofit organization, exempt from taxation under Section 501(c)(3) of Title 26 of the United States Code, of certified interior designers whose governing board shall include representatives of the public, except that an organization that is not currently exempt under that section that submits an application to the Internal Revenue Service requesting an exemption under that section shall be eligible to be an interior design organization if it meets the requirements under that section within a reasonable period of time.   • Issuer: means a bailee that issues a document of title or, in the case of an unaccepted delivery order, the person that orders the possessor of goods to deliver. See California Education Code 84040.5
  • Judgment: means a final judgment for the payment of money rendered against a local public entity. See California Government Code 970
  • laboratory director: means any person who is any of the following:

    California Education Code 56364.1

  • landholder: means any person who owns, leases, or has a possessory interest in land. See California Government Code 54144
  • Licensed psychologist: means an individual to whom a license has been issued pursuant to the provisions of this chapter, which license is in force and has not been suspended or revoked. See California Education Code 81839
  • local agency: means county, city, city and county, including a chartered city or county, school district, community college district, public district, county board of education, county superintendent of schools, or any public or municipal corporation. See California Government Code 53600
  • local agency: means city and any district other than school districts required by the Advisory Committee and the Controller to furnish financial reports pursuant to Section 12463. See California Government Code 53900
  • local agency: means city, county, municipality, or political subdivision. See California Government Code 53861
  • local agency: means any city, county, any district, and any community redevelopment agency required to furnish financial reports pursuant to Section 12463. See California Government Code 53890
  • Local agency: means any city, county, city and county, special district, or county service area. See California Government Code 54250
  • Local agency: means city, county, or subdivision of the State. See California Government Code 54030
  • local agency: means city, county, or district agricultural association. See California Government Code 54060
  • Local agency: means any city, city and county, county, or public district. See California Government Code 54125
  • Local agency: means county, city, municipal corporation, or public district. See California Government Code 54141
  • local agency: means every city, county, city and county, district, or any other local governmental body or corporation empowered to expend public funds for the acquisition of property. See California Government Code 54201
  • local agency: means every city, whether organized under general law or by charter, county, city and county, and district, including school districts of any kind or class, empowered to acquire and hold real property. See California Government Code 54221
  • Local public entity: includes a county, city, district, public authority, public agency, and any other political subdivision or public corporation in the state, but does not include the Regents of the University of California and does not include the state or any office, officer, department, division, bureau, board, commission or agency of the state claims against which are paid by warrants drawn by the Controller. See California Government Code 970
  • Local taxing entity: means a local public entity that has the power to levy ad valorem taxes, or ad valorem assessments, upon property within the territory of the entity. See California Government Code 975
  • open-space purposes: means the use of land for public recreation, enjoyment of scenic beauty, or conservation or use of natural resources. See California Government Code 54221
  • optometrist: means a person who is licensed to practice optometry in this state under the authority of this chapter. See California Education Code 85266
  • person: includes firm, association, partnership, individual, limited liability company, and corporation. See California Education Code 56361
  • persons and families of low or moderate income: means persons and families who meet both of the following conditions:

  • Privatization project: as used in this article , includes the Santa Ana Watershed Project Authority's Arlington Basin Groundwater Desalter Project, which will treat groundwater contaminated by wastewater. See California Government Code 54250
  • Privatizer: means any corporation, partnership, or natural person, excluding municipal corporations, which owns and operates a wastewater or sewerage project pursuant to a franchise, license, or service agreement with a local agency. See California Government Code 54250
  • Project: includes , but is not limited to, financing, designing, constructing, repairing, replacing, maintaining, and operating collector systems, pumping stations, treatment plants, and lateral interceptors, and outfall sewers. See California Government Code 54250
  • Property: means real or personal property, easement, license, or other right in property. See California Government Code 54030
  • public beach: means any beach area used for recreational purposes which is owned, operated or controlled by the State, any state agency or any local agency. See California Government Code 54090
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See California Education Code 84040.5
  • related services: means transportation, and such developmental, corrective, and other supportive services (including speech-language pathology and audiology services, interpreting services, psychological services, physical and occupational therapy, recreation, including therapeutic recreation, social work services, school nurse services designed to enable an individual with exceptional needs to receive a free appropriate public education as described in the individualized education program of the child, counseling services, including rehabilitation counseling, orientation, and mobility services, and medical services, except that such medical services shall be for diagnostic and evaluation purposes only) as may be required to assist an individual with exceptional needs to benefit from special education, and includes the early identification and assessment of disabling conditions in children.   • route: means State highway route and the route numbers are those given the State highway routes or portions thereof by the commission. See California Welfare and Institutions Code 10741
  • school meals: includes breakfasts, lunches, or the serving of foods or beverages, or both, during other nutrition periods, or any combination thereof. See California Education Code 49500
  • Service provider: means any public or private nonprofit agency which provides service directly to categorical populations. See California Government Code 16366.2
  • Shipper: means a person that enters into a contract of transportation with a carrier. See California Education Code 84040.5
  • State: includes any department or agency thereof. See California Government Code 54141
  • surplus land: means land owned by any local agency, that is determined to be no longer necessary for the agency's use, except property being held by the agency for the purpose of exchange. See California Government Code 54221
  • surplus residential property: means land and structures owned by any agency of the state that is determined to be no longer necessary for the agency's use, and that is developed as single-family or multifamily housing, except property being held by the agency for the purpose of exchange. See California Government Code 54236
  • trainee: means any person licensed under this chapter for the purpose of receiving comprehensive practical experience and instruction in clinical laboratory procedures in one of the sciences or in general clinical laboratory science under the direct and responsible supervision of a person authorized to direct a laboratory under the provisions of this chapter, clinical laboratory scientist, clinical chemist scientist, clinical microbiologist scientist, clinical toxicologist scientist, clinical immunohematologist scientist, clinical genetic molecular biologist scientist, clinical cytogeneticist scientist, clinical histocompatibility scientist, or other equivalent licensee in the science or specialty or subspecialty for which he or she is licensed in a clinical laboratory certified for this purpose by the department under this chapter.   • United States: includes any department, board, or agency thereof. See California Government Code 54141
  • unlicensed laboratory personnel: means a laboratory aide, histocompatibility technician, cardiopulmonary technician, or other person performing the activities authorized by Section 1269. See California Education Code 56366.4
  • Warehouse: means a person engaged in the business of storing goods for hire. See California Education Code 84040.5
