Terms Used In Hawaii Revised Statutes 346-38

  • Department: means the department of human services. See Hawaii Revised Statutes 346-1
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Recipient: means the person for whose use and benefit services are rendered or a grant of public assistance is made. See Hawaii Revised Statutes 346-1

If the recipient is found incapable of taking care of the recipient’s money or oneself, the department of human services may direct its assistance to be paid to a legal guardian or any other reputable person for the recipient’s benefit or may suspend assistance for such period as it deems fit.
