Terms Used In Indiana Code 12-30-2-5

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • board of commissioners of a county: includes a person delegated by the board under section 7 of this chapter to the extent of the authority delegated by the board to the person for purposes of this article. See Indiana Code 12-30-1-0.5
  • Probate: Proving a will
   Sec. 5. The board of commissioners of a county may remove the superintendent of the county home from office at any time, but only for cause, which must be entered in the record book of the board of commissioners. A superintendent removed from office under this section may appeal the removal action to the circuit court, superior court, or probate court of the county within ten (10) days in the same manner as other appeals are taken from actions of the board of commissioners.
